• The Public Hearing, held at St. Lucy's Church, on Tuesday, August
28, 1973, was called to order by Chairman Ralph Walton at 2:35 P.M.
The purpose of this Public Hearing was to hear representatives
from Boca Hi in their request to consider their application for
rezoning for RPUD.
In attendance were Chairman Ralph Walton, Messrs. Kemery, Nick
Johnson, Dr. Guelzow and Col. Fran'-Johnaon, Messrs. Richard Rodgers,
William Johnson, Dan Abernathy, David Dickinson, Thomas Sliney,
Mrs. Roberts, Mr. Foster, Mrs. Barker and several interested
townspeople.. Mr. David Martin, Architect, was also in attendance.
Mr. Rodgers spoke first and explained that the plan they have
prepared is in keeping with the Comprehensive Plan for the Town
of Highland Beach and that they wish to cooperate fully with
the Town - which, he felt they had shown in their building of
Aberdeen Arms and their entranceway to the Town.
Mr. Dan Abernathy then spoke and briefly gave a summary of the
type of customers Bair4-Abernathy has and explained that the contract
with the Town of Highland expired in April of 1972 and they
entered into a contract with Boca Hi in October of 1972. Mr,
is
Abernathy wanted the above points to be made'very clear.
Mr. Abernathy then proceeded to read several sections of the
Zoning Ordinance and the Comprehensive Plan and wished to inform
the Planning & Zoning Board and the interested citizens that Boca
Hi had made up their plans according to what was allowed-- they
had dropped their units from 800 to 657 - and the average apartment
would have 1600 feet of living space and they would sell for
approximately $80,000.
Mr. Martin explained that he had talked with Mr. Ulrich regarding
fire precautions at Boca Hi and Mr. Kemery inquired as to whether
the plans had had final approval by the Fire Marshall. Mr. Martinsaid
that he did not have final approval as yet - but that everything
was being worked out satisfactorily to all concerned.
Mr. Rodgers then summarized their presentation and stated that of
all the meetings that have been held, there appears to be three
major areas in which there is still some difference of opinion, namely:
1. Height of buildings
2. Length of buildings
• 3. Transferring of developable property from the east side
of AlA to the west side of AlA.

• Dr. Guelzow brought up the fact that there was only one entry way
onto AlA and Mr. Rodgers answered that, if necessary, a second
entrance way was available.

Mr. Walton pointed out that State Statute 163 empowered the
Board to act for the people of the Town and responses from the
people of the Town indicated that serious consideration should
be given to:
1. length of buildings being no more than 240'
2. no more high monstrosities here like they have down the
road.
The motion was made by Mr. Nick Johnson and seconded by Dr.
Guelzow that the meeting be adjourned at 5:15 P.M.
