TOWN COMMISSION
WORKSHOP MEETING MINUTES
Tuesday, Septembern 27, 2005 1:30 p.m.
Mayor Harold R. Hagelmann called the Workshop Meeting to order in Commission
Chambers at 1:30 P.M.
Deputy Town Clerk Jane Dillon called the roll. The Mayor, Vice Mayor Joseph J. Asselta
and Commissioners Jim Newill and Rachael Scala-Pistone were present. Miriam S.
Zwick was absent.
Town Attorney Thomas E. Sliney was also present, as were members of the general
public. Town Manager Dale Sugerman was absent.
1. ADDITIONS. DELETIONS OR ACCEPTANCE OF AGENDA
Vice Mayor Asselta asked to speak about a potential resolution re the police department.
This will be placed as item #2 under new business.
• Mayor Hagelmann asked that the presentation of two checks to Major Charles Smith of
the Salvation Army be moved to this point, in order that Major Smith would not be held
up due to public comments. All were in approval. Therefore, the Mayor came down to
the public floor and presented two checks to the Major after thanking the Salvation Army
for all they do. Major Smith then gave a speech. Photos were taken of the presentation
which will be in the next community newsletter.
2. PUBLIC COMMENTS AND REQUESTS
Joe Yucht, Boca High, spoke on the following issues: 1) The importance of a signal light
at the Highland Beach fire station, noting that all town's have these signal lights at their
stations, and how important it is for the safety of the public. 2) That the appointed rep
on the airport authority committee does not report back to the Commission, and that he
should report to the Commission monthly with updates. 3) Boca Raton and Delray Beach
are also building new libraries and have enhanced fire protection features. He requests
that the architect be invited to the next Commission meeting and be asked if the
Highland Beach library has these features.
3. PRESENTATIONS
PRESENTATION OF TWO (2) CHECKS TO MAJOR CHARLES SMITH OF THE
SALVATION ARMY IN SUPPORT OF THE VICTIMS OF HURRICANE KATRINA.
Mayor presented checks to Major Smith prior to public comments.

5. PROPOSED ORDINANCES AND RESOLUTIONS
AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF
HIGHLAND BEACH, FLORIDA, AMENDING SECTION 2-29,
"EMERGENCY MANAGEMENT," BY ENACTING SECTION 2-36,
"PORTABLE GENERATORS," TO PROVIDE FOR THE REGULATION OF
PORTABLE GENERATORS; PROVIDING A SAVING CLAUSE, A
GENERAL REPEALER CLAUSE AND AN EFFECTIVE DATE.
(first reading 9/13/05; published 9/22/05)
• Mayor noted that he would like to put this on the consent agenda for the October 11
Regular Meeting. This was agreed to unanimously
6. NEW BUSINESS
(1) DISCUSSION RE: DECLARING THE TOWN'S ABANDONED WELLFIELD
SITE AS SURPLUS PROPERTY.
Mayor read Town Manager Dale Sugerman's memorandum re declaring the wellfield
property surplus (attached hereto and made a part of these minutes). Vice Mayor
Asselta noted that he would also like to add the Federal Highway property as surplus.
Mayor asked if everyone was in favor of placing this on the Consent Agenda for October
11 meeting. Commissioner Newill was not in favor of placing either properties on the
consent agenda due to a Commissioner being absent today who should have a say in
the decision. It was decided to place this issue as an agenda item for further discussion
at the October 11 Regular Meeting.
(2) RESOLUTION RE POLICE DEPARTMENT.
Vice Mayor Asselta introduced what he wished to become a resolution to amend
"Agreement between Town of Highland Beach Florida and Florida State Lodge, Fraternal
• Order of Police, Inc. (copy attached) in regard to promoting a police officer only after the
officer has had three years of continuous service with the HBPD. He felt that there could

11. CONSENT AGENDA None.
12. PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT
MEETING
Joe Yucht spoke on the following four issues: 1) Generators -how are our generators
protected in case of a storm. The town should look into this. 2) Sale of property -the
Town should be interested in getting the most money, by receiving individual bids. 3)
The previous meeting did not rerun, only getting a blue screen. 4) Milani Park -the west
side and its appearance (gravel, lake, weed infested, etc.)
Mayor Hagelmann stated that he called County Commissioner Mary McCarty about this,
and read a note from her stating that Palm Beach County will cut the property in the next
couple of weeks and then maintain it quarterly.
13. ADJOURNMENT
There being no further business to come before the Commission at this time, MOTION
to adjourn was made by VICE SCALA-PISTONE/COMMISSIONER NEWILL at 3:15 p.m.

be to much of a chance that a newer officer would be promoted rather than one with
more longevity. Chief Goss spoke and stated that this issue will be discussed at the
Executive FOB meeting on October 6. Reorganization of the Police Dept. was also
discussed. Vice Mayor Asselta deferred this issue until after the October 6 FOP
meeting.

8. REPORTS -TOWN COMMISSION
• COMMISSIONER JIM NEWILL, CPA: Spoke about the insurance consultant and
that the Commission will have an answer on the proposals before the next Town
Commission meeting. He restated that he will not approve the sale of the two
properties until it has been determined what the money will be designated for.
COMMISSIONER MIRIAM S. ZWICK: (absent)
COMMISSIONER RACHAEL SCALA-PISTONE: Is in concurrence with
Commissioner Newill that next year the Commission should have a Workshop
Meeting to review the budget.
VICE MAYOR JOSEPH J. ASSELTA: No report.
MAYOR HAROLD R. HAGELMANN: Determining which members of the Town
Commission will attend the 45th Annual Florida League of
Cities Legislative Conference -Orlando, FL, Nov 17 and 18.
Mayor Hagelmann asked the Commissioners to let Town Manager Dale Sugerman know
what their plans are in regard to this.

RE: New Business Item- September 27th Workshop Meeting
Discussion re: Declaring the Town's Abandoned Wellfield Site as
Surplus Property
Mayor Hagelmann has asked that this item be placed on the Workshop Meeting
agenda for September 27th. He has asked that the Commission discuss moving
forward with the sale of the abandoned wellfield site. The first step for doing so is
to declare the property surplus so that it can be put up for public sale.
At the same time, the Mayor would like to have the Commission discuss the
• appointment of a committee (which could be accomplished at the October 11
regular Commission Meeting) to actually move the sale forward.
Of course, since this is a workshop meeting, no action can be taken. However,
the item can be placed on the Consent Agenda for the next regular meeting.

FLORIDA and FLORIDA STATE LODGE, FRATERNAL ORDER OF POLICE,
INC. through Sept. 30, 2005 -Article 10, Promotional opportunities, add to last
paragraph:
"Further, it is the policy of the Town that any candidate for promotion have at
least 3 years of continuous service in the Police Department of Highland Beach."
