Literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of the ordinance, and would work unnecessary and undue hardship on the applicant. 5. The reasons set forth in the applicant's petition justify the granting of the variance, and the variance granted is the minimum reasonable variance that will make possible the reasonable use of land, structure or building. 6. Granting of the variance will be in harmony with the general purpose and intent of the ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Chapter 30, Zoning Code /Article III; Sec. 30- 40(h): A variance, when implemented in accordance with the approval granted by the Board of Adjustment and Appeals, shall run with the land in perpetuity. Unless a lesser time is approved by the Board of Adjustment and Appeals, a variance that is not implemented shall expire eighteen (18) months following approval. Present Structures (type): NONE 2. The proposed use will be: 15 Residential Condominium Units 1 e EE3 1 3. If this Petition is granted, the effect will be to allow for the construction of a residential building (15 units on permissible 27.36 unit parcel with zoning density of 16 units per acre) with a height of 83'2" (highest point of 91 %" which would include the elevator, penthouse stair to roof and cooling tower), for which the Owner will set back the building well in excess of that required by Code.. The effect will be to allow the completion of the streetscape that has been started and allow "in-fill" on a parcel that has been left vacant. 4. For a variance to be favorably considered, the Board of Adjustment must find that the following four requirements have been met. After each paragraph, state fully your reasons justifying the granting of this variance. a. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same district: This parcel does in fact, have a special and singular circumstance in the Town which is not applicable to other buildings in the same District. Buildings constructed on neighboring parcels within the District were constructed to not less than the available height of predecessor Code sections at a time when this District, and particularly this corridor,was being developed. This parcel can be clearly differentiated by the fact that its predecessor owners proposed inordinate densities which incurred litigation and other impediments to the construction of a building upon it generally contemporaneously to its neighbors under prior Code. The proposed plan is fully cognizant of this unfortunate history, and the new ownership has purposely self-imposed a minimal density of 15 units (as opposed to 27.36 units) in a "light and airy" architectural style. The Owner's deference to the Town's previously stated objectives for the site can be accomplished by permitting the contemplated building to benefit by the vertical envelope that was available to its neighbors, thereby allowing the completion of the streetscape that has already been started. We respectfully submit that the most current Code height modification was not intended to single out or purposely prejudice the development of this parcel. Rather, the protracted delays and ultimate failure of the predecessor owners to construct a building on this parcel compatible with the Town's concerns — which were never a function of height, but rather of density— renders the parcel under a current Code which unintentionally inhibits the development of the parcel to a density even less than ever requested by the Town. These special conditions particular to this site 2 00n ? 4582 create a dilemma of an almost unsolvable problem that would keep this property fallow forever. " This parcel is one of the last vacant buildable lots remaining in the Town of Highland Beach and in this District. This circumstance, coupled with the unfortunate history of the parcel, which your current applicant (who is in no manner related to prior owners) wishes to rectify by the construction of a compatible building purposely designed to a minimal density of both parcel- covering bulk and number of units, is indeed a unique and special circumstance. The grant of the requested variance and the resulting ability of the Owner to provide greater open/green space will also positively address the concern and consideration for the substantial number of mangroves on the site. The environmentally sensitive components of the parcel will be preserved and protected without the need for off-site mitigation by the Owner's self-imposed maximization of setbacks and green space which will be made available by "uncompacting" the bulk of the building to the benefit of the extension of the vertical element. b. That the special conditions and circumstances do not result from the actions of the applicant Affirmed. The special condition is the direct result of the dilemma created by the zoning reduction in height, with no decrease in density. Zoning density allows for 27.36 units which cannot be built at a height that is compatible to the neighboring buildings. The proposed building resolves this dilemma. c. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings or structures in the same district The grant of the variance will have the opposite effect of conferring any special right or privilege to this applicant. As discussed above, the documented history of this parcel evidences why it was not developed in the same generation of adjacent and neighboring buildings of the height for which the current owner must request this variance. Height was not the issue; density was the issue. Rather than confer a "special" benefit, the grant of variance will allow a specially designed, unobtrusive building to be constructed as a height compatible addition to the landscape of the Town. The construction of this building to a height less than its immediate neighbors but more than the current Code limitation will end the incongruity of either the current unimproved tract among a matured set of neighboring buildings. Likewise, if constructed without 3 000 4582 the benefit of the variance, the new building would, as built under today's Code, be of such bulk and appearance of mandated compaction to likewise not be an optimum addition to the Town's landscape. As submitted, the grant of the variance will simply do no more than avail the new owner of the same height envelope of its immediate neighbors and other buildings in the same corridor. Accordingly, it is respectfully submitted that the grant of a variance will not confer a special benefit but rather bestow an equalization of sorts to this, the last of the parcels to be built in this corridor; which coupled with the resulting ability of the owner to avoid development of ground space otherwise available under the Code will render this building a future icon in the Town. The building as proposed complies with the Town's Code, Section 30-66 by providing a "wedding cake" design, providing for increased setbacks in the building exterior as the elevation increases. Therefore, granting of this variance will not confer a special benefit, but rather provides the same opportunity that anyone else would enjoy should they find themselves in the same situation whereby this same section of Code would be used. d. That literal interpretation of the provisions of this ordinance would deprive the applicant of the rights commonly enjoyed by other properties in the same district under the terms of this ordinance and would work unnecessary and undue hardship on the applicant. The requested variance would not result in any advantage or in any manner render a superior right of this parcel within the District. The result of the grant of the variance will be to bring the subject undeveloped parcel to a degree of conformity with neighboring properties as a developed parcel. A discerning reasonable literal interpretation of the applicable Code provisions would not, we respectfully submit, necessarily require the grant of a variance for the owner to develop this parcel as contemplated. We suggest that Section 30-66 of the Town's Code, both by its written provisions and accompanying graphic illustration (see Figure 301), clearly contemplates and allows for a height above 50 feet in the RMH Zoning District conditioned upon a continuing commensurate increase in setbacks for which the calculation of height for setback is contained in Section 30-66. As is evidenced by the attached supplementary exhibits, the proposed plans for the building provide self- imposed setbacks greater than those which would be otherwise mandated by the Section 30-66 calculations and Figure 301 illustration. However, applicant nonetheless submits this application for variance to evidence its desire and intention in good faith to finally have an exemplary building constructed upon this previously controversial parcel. 4 00024582 FEB 1 9 2003 p �. �, 1�4'�-�--��-J Wo.r-, " A variance which would allow this newest budding to be of a greater height orb otherwise rill more than the building envelope of its neighbors would be patently inappropriate. To the contrary, a variance is needed for the proper development of residences on this parcel. Were a new building to be constructed on this parcel of a height not reasonably commensurate with the taller buildings on either side, the future residents of the new building will be prejudiced by the absence of sight fines, the imposition of shadows, the loss of light and air which are not only generally encouraged and preserved by budding codes, but which is a hallmark of the Town. If a new building was to be built on the subject site within available Code, its adjacent neighbors would likewise be prejudiced by the unfortunate monolithic bulk, loss of sight lines, air and light by the inherent compacted structure. These negative impacts will be ameliorated by a variance which notwithstanding is grant would be a non- identifiable addition to the landscape. Your applicant is a builder of waterfront residential buildings in the nature of the proposed Renaissance at Highland Beach. Neither intention nor request is made to construct a building with greater rights or development capacity than those to which the proposed building would be a neighboring constituent. The requested variance will provide to the owner less rights than those pursuant to which the neighboring buildings were constructed and which, if granted, will avoid the appearance that the subject parcel was intentionally sandwiched or otherwise subordinated both in available quality level and aesthetics by a prior change in Code, for which there is no evidence that its application would have been intended to prejudice the development of the subject property on par with other residential buildings within the same zoning district and, particularly, within the same corridor of the Town. 5. Has any previous application or appeal been filed with the last year in connection with these premises?
