perimeter of the community due to unusual conditions resulting from hurricane

4. For a variance to be favorably considered, the Board of
Adjustment must find that the following four requirements have
been met. After each paragraph, state fully your reasons
justifying the granting of this variance.
(a) That special conditions and circumstances exist which are
peculiar to the land, structure, or building involved and
which are not applicable to other lands, structures or
buildings in the same district;
The special conditions that exist are the proximity of an active utility
plant, additional traffic to the Town services, water plant and library
that did not exist at the time the homes were built. Constant construction
noise disturbs the quiet enjoyment of the lives of the North owners.
(b) That the special conditions and circumstances do not

result from the actions of the applicant;
The circumstances do not result from any action by this applicant.
(c) That granting the variance requested will not confer on
the applicant any special privilege that is denied by
this ordinance to other lands, buildings or structures in
the same district;
• Granting of the requested variance will not impact any other
individual or community of be considered a special privilege.
The South perimeter of the community is already bordered by a

permanent wall that divides them from the Toscana and the North
perimeter wall would be a consistent use of the property border.
(d) That literal interpretation of the provisions of this
ordinance would deprive the applicant of the rights
commonly enjoyed by other properties in the same district
under the terms of this ordinance and would work
unnecessary and undue hardship on the applicant.
The community would be deprived of the quiet enjoyment of their homes
because of an active utility plant, additional traffic to the Library
and other Town buildings causing noise that otherwise did not exist
previously.
