Literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of the ordinance, and would work unnecessary and undue hardship on the applicant. 5. The reasons set forth in the applicant's petition justify the granting of the variance, and the variance granted is the minimum reasonable variance that will make possible the reasonable use of land, structure or building. 6. Granting of the variance will be in harmony with the general purpose and intent of the ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Chapter 30, Zoning Code /Article III; Sec. 30- 40(h): A variance, when implemented in accordance with the approval granted by the Board of Adjustment and Appeals, shall run with the land in perpetuity. Unless a lesser time is approved by the Board of Adjustment and Appeals, a variance that is not implemented shall expire eighteen (18) months following approval. Extensions of variance approvals shall not be granted by the Board of Adjustment and Appeals. (a) That special conditions and circumstances exist. which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same district; Most condominiums in Highland Beach have separate structures in close proximity to -A1A which display the name, address, etc. in sufficient size for one to read as one travels north and south along AlA. Highland Towers sign on its Porte - Cochere is. over 120' from south bound/ traffic on A1A. (b) That the special conditions and circumstances do not result from . the actions of the applicant; Although we removed our existing signage for renovation purposes, we assume this could be reinstalled. However, the existing sign is in script (as indicated in the photograph) and in our designer's opinion needed a change in type and more in keeping with our renovations. (c) That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings or structures in the same district; The original sign recently removed for renovations was installed when ° the building was constructed (1955). That sign, which hung on the Porte - Cochere for over 50 years, was 25 SF in size. Our proposed new sign would only be 18 SF. (d) That literal interpretation of the provisions of this ordinance would deprive the applicant of the rights commonly enjoyed by other properties in the same district under the terms of this ordinance and would work unnecessary and undue hardship on the applicant. As can be seen from the photographs provided, a 10 SF sign 120' from A1A is too small, barely readable and is aesthetically unbalanced and unpleasant Our designer has provided what he considers the best compromise of 18 SF.
