The reasons set forth in the applicant's petition justify the granting of the variance, and the variance granted is the minimum reasonable variance that will make possible the reasonable use of land, structure or building. 6. Granting of the variance will be in harmony with the general purpose and intent of the ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Chapter 30 Zoning Code /Article III; Sec.30- 40(h): A variance, when implemented in accordance with the approval granted by the Board of Adjustment and Appeals, shall run with the land in perpetuity. Unless a lesser time is approved by the Board of Adjustment and Appeals, a variance that is not implemented shall expire eighteen (18) months following approval. Extensions of variance approvals shall not be granted by the Board of Adjustment and Appeals. If this Petition is granted, the effect will be to eliminate only the requirement for the connection of the two existing homes on the oceanside to the proposed new dwelling . (brief description - i.e., to reduce side yard from 7 -1/2' to 2') TOWN OF HIGHLAND BEACH BOARD OF ADJUSTMENT PETITION Page 2 of 5 4. For a variance to be favorably considered, the Board of Adjustment must find that the following four requirements have been met. After each paragraph, state fully your reasons justifying the granting of this variance. (a) That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same district; There are clearly special conditions and circumstances peculiar to this land and project which are not applicable to other land in the same RMM zoning district. For one, the irregular configuration requiring the connections of the lots is unique to this particular development. This particular configuration has been designed to create a low density project, much less dense than permitted in the zoning district or that of the surrounding area. In fact, the development consists of approximately 1.88 acres. Since the RMM zoning district allows for a maximum of 12 units per acre, 22 units could be built on this property. Our project was originally approved with 8 units, but since we will be combining the lots which are subject to this variance, there will now only be 7 total units at a density of only 3.72 units per acre. (b) That the special conditions and circumstances do not result from the actions of the application. The special conditions and circumstances are not a result of the actions of the applicant. In fact, the minutes of the May 10, 2000 Board Meeting indicate that it was suggested to the applicant to go before the Board of Adjustment for a variance to omit the connection between the two sections concerning the connection of the west side houses to the east side houses over the interior roadway to allow easier access for fire vehicles and to make the project look more attractive aesthetically. At this meeting, the Town Attorney in fact suggested that the applicant submit for a variance regarding the attachment which is the subject of this variance. (c) That granting the variance request will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings or structures in the same district. Granting the variance request will not confer on the applicant any special privileges. In fact, the applicant developed the property at a much lower density and intensity TOWN OF HIGHLAND BEACH BOARD OF ADJUSTMENT PETITION Page 3 of 5 than was permitted at the approbation of the Town. Additionally, Unit 3 and Unit 6 are now being combined into one lot so the project will even be less dense. Therefore, the removal of the attachment between the buildings in this one instance is clearly reasonable. The variance will allow easier access for fire vehicles and make the project look more attractive aesthetically since there will not be a full connection over the roadway. Moreover, the requested variance will improve the quality of life for those beachfront homeowners on the east side of the internal roadway. (d) That literal interpretation of the provision of this ordinance would deprive the applicant of the rights commonly enjoyed by other properties in the same district under the terms of this ordinance and would work unnecessary and undue hardship on the applicant. The literal interpretation of provisions of this requirement would deprive the applicant of the right commonly enjoyed by other properties in the same district and would work an unnecessary undo hardship on the applicant. As indicated by the minutes, the Board has previously indicated that a literal interpretation of this requirement should be avoided as it would deprive the applicant of rights enjoyed by other properties in the same district. The applicant developed this project with much less density than was allowed. It is clearly a reasonable variance request not to require this connection over the interior roadway in this instance. The variance will clearly improve the aesthetics and safety of the project and be a general asset for the entire development. The variance will not negatively impact the surrounding uses. The request improves the character of the project. The site layout as designed does not allow for alternative options that may eliminate or further reduce the variance request. Thus, the proposed variance is the best way to achieve the desired intent and continue to promote residential quality of life. CONCLUSION In summary, the variance granted is a minimum variance that will make possible reasonable use of the property. The granting of the variance will be in harmony with the general intent and purpose of the Town Code and will not be injurious to the area involved or otherwise detrimental to the public welfare. On the contrary, it will be beneficial to the public health, safety and welfare. Moreover, the applicant is willing to add additional pavement to increase the turning radius to allow emergency vehicles easier ingress and egress through the development. Therefore, the requirements for a TOWN OF HIGHLAND BEACH BOARD OF ADJUSTMENT PETITION Page 4 of 5 variance have each been met. For all these reasons, we respectfully request that this variance be granted. 5. Has any previous application or appeal been filed within the last year in connection with these premises?
