CODE ENFORCEMENT SPECIAL MAGISTRATE
REGULAR MEETING

CALL TO ORDER:
Special Magistrate Ansay called the Code Enforcement Hearing to order at 2:00 p.m.
• SWEARING IN:
Special Magistrate swore in all those who would testify.
VIOLATION HEARING:
Case #2010-55 2395 South Ocean Blvd., Krishna and Sumentra Persaud
Michael Desorcy, Building Official/Code Enforcement Officer -Documents entered into
evidence as Exhibit # 1 with the approval of Frank Ramotar, Authorized Agent for
Krishna Persaud.
On April 28t", the property revealed weeds and wild growth in excess of 12", which is a
violation of code section 13-2; photographs were taken. May 4t", the Notice of Violation
was sent certified mail to the respondent giving seven days from receipt of mailing to
come into compliance. The Notice of Violation came back on May 21St as undeliverable.
The Notice of Violation was then posted on the property on June 1St and an Affidavit of
Posting is on file; the notice was mailed certified on June 2°d. The Notice to Appear
required the respondent to appear at the July 1St hearing, which was postponed to July
22°d. The second posting was on June 30t" and sent certified mail then returned
undeliverable on July 1St. June 15t", Mr. Persaud requested that the violation go away and
that the grass would be cut. The property came into compliance on June 28t". Then on
• June 30t", spoke with Mr. Persaud and explained that even though all of the letters were
returned undeliverable he is required to appear at the hearing. Mr. Persaud indicated that
he would be out of the country and would like to receive the mail at 11767 Bayfield
• Drive, Boca Raton. As a courtesy, a letter was sent via regular mail to 11767 Bayfield,
Boca Raton.
The Town is requesting that the Special Magistrate consider an order to not repeat the
violation and to recover code enforcement costs. Administrative Cost Sheet entered into
evidence as Exhibit #2 and approved by Frank Ramotar, Authorized Agent.
Frank Ramotar, Authorized Agent for Krishna Persaud - Mr. Persaud is out of the
country; however, he has set up a contract to have the grass maintained.
Special Magistrate Ansay -Based on the evidence provided this morning, the
property located at 2395 S. Ocean Boulevard was in violation of code section 13-2;
the violation no longer exists today, as of the date of the hearing. However, since the
violation did not come into compliance on or before the original date provided for
on the Notice of Violation, there will be an order entered that owners of the
property not violate code section 13-2 in the future, and the respondents are
responsible for the Town's administrative costs. The fee will be within the range of
five-hundred to six-hundred dollars ($500.00-$600.00). A copy of the order will be
delivered in the manner required by state statue; however, as a courtesy to the
property owner, a copy of the order will be supplied to the address provided by the
respondent. The property owner will have thirty (30) days to pay the administrative
costs.

There being no further business the Special Magistrate adjourned the meeting at 2:20
p.m.
