PLANNING BOARD
REGULAR MEETING
MINUTES
Wednesdav, December 13 1995 9.35 A M
Chairman Robert L. Lowe called the Regular Meeting to order in
Commission Chambers at 9:35 A.M.
Deputy Town Clerk Jane Dillon called the roll. Present were
Chairman Robert L. Lowe, Vice Chairman Leonard D. Bell and Members
William Maltz, Alfred E. Bresnahan, Michael W. Hill and Felix R.
Goldenson. Paul R. Kane was absent.
Also present was Building Official Ed Hardy, Town Attorney Thomas
E. Sliney, Town Manager Mary Ann Mariano and members of the general
public.
MINUTES
Upon MOTION by MR. BRESNAHAN/MR. MALTZ, the Minutes of the November
8, 1995 Regular Meeting were approved.
OLD BUSINESS
None.
NEW BUSINESS
PRELIMINARY REVIEW OF SITE PLAN FOR ENTIRE COMPLEX AND GUARD HOUSE
AND WALL, FOR PROPERTY LOCATED AT 2625 SOUTH OCEAN BLVD., LOT 122
EAST, HIGHLAND BEACH, FL. (DOLPHIN APARTMENTS.) CHARLES JOHNSON
(APPLICANT), A. H. HARRIS ENTERPRISES (OWNER.)
Chairman Lowe asked Attorney Sliney to give some discussion with
regard to the approval of the frontage from 40 feet to 25 feet.
Attorney Sliney explained the variances requested at recent Board
of Adjustment/Public Hearing meetings for the front setback
(approved) and the cabanas (denied), and continued to explain the
eight single family homes which will be built. Mr. Hardy confirmed
that all the other requests would meet with standards of Town code.
Randall Stoff of Randall Stoff Architects gave an overview of the
site plan, using a visual display showing the layout and explained
it as a Mediterranean style village. Discussion centered around
the homes being attached, and the fact that ultimately, they will
be attached but since the homes are being built individually, the
attachments may not be completed until project completion which
could be about 5 years.

1) The Developer will file amongst the public records of Palm Beach
County, Florida, a Declaration of Restrictions and Covenants or
such other document that the Town Attorney approves which provides
as a covenant and restriction running with the land, to which
grantees of lots within the project be made subject that each
residence constructed upon any lot in the project be attached
in at least one location to the residence on at least one
contiguous lot and that the homeowners' association, which is the
successor to the developer be bound by such a condition and be
required to enforce that condition and further, that the developer
and the association assign to the. Town, its enforcement rights as
to the afore-described requirement which the Town may, at its own
option, enforce at the expense of the developer or, after turn-
over, the Association.
2) The manner of attachment of the residences shall comply with the
Town Code.
The MOTION was passed on unanimous roll call vote.
NOTE FOR CLARIFICATION: The site plan has been given final
approval as is presented for all purposes associated with final
site plan approval such as, but not limited to, utility placement
and roadways requiring amendment only in the event that the general
configuration of the lot demarcations as shown are not
substantially modified. Notwithstanding the foregoing, the site
plan for each individual residence and appurtenances thereto to be
constructed on any of the lots shall be subject to approval by the
applicable Town Boards.
GENERAL DISCUSSION
Mr. Bell brought up several concerns with prior project approvals
by the Planning Board; the Lang residence being one, and his
concern that more isn't being changed in the house than was
approved. Mr. Hardy assured Mr. Bell that he inspects on a
continual basis to be sure all is in compliance with the approved
plans.

There was also discussion on a previous matter involving a beach
walkway and cabana on property a resident owned, and if in the
future a home could be built. Mr. Sliney felt that if the owners
came in with an amended plan, a home. could be built on that site.
With no further business to come before the board at this time, a
MOTION to adjourn was made by MR. MALTZ/MR. LOWE at 10:45 A.M.
