TOWN COMMISSION
WORKSHOP MEETING MINUTES
Tuesday, March 28, 2006 1:30 p.m.
Mayor Harold R. Hagelmann called the Workshop Meeting to order in Commission
Chambers at 1:30 P.M. Deputy Town Clerk Jane Dillon called the roll. The Mayor, Vice
Mayor Joseph J. Asselta and Commissioners Miriam S. Zwick, Jim Newill and Scala-
Pistone were present. Town Attorney Thomas E. Sliney and Acting Town Manager Doris
Trinley also present, as well as members of the general public.
1. ADDITIONS. DELETIONS OR ACCEPTANCE OF AGENDA
The agenda was amended under new business to include a discussion re the FRS
pension. Also included under Resolutions and Ordinances is a proposed resolution re
the Cultural Society Board.
2. PUBLIC COMMENTS AND REQUESTS
Leonard Bell, stated his pleasure in having the history room in the new library dedicated
to the late Mayor, Tom Reid. He noted how Town Attorney Thomas Sliney many years
• ago, felt that the Town should preserve the history of the Town, and when mentioned to
Tom Reid, he went forth to pursue this idea. Mr. Bell asked the Commission to consider
a "thank you" of some sort be displayed in the room, noting Mr. Sliney suggestion. The
Commission expressed its support. Mayor Hagelmann will work with Town Manager
Dale Sugerman on this project.
Dr. Strauss, noted that the Lyric Chamber Orchestra will be conducting a concert at St.
Lucy Church Friday, March 31 at 7:30 p.m.
Donna Friedman, Bel Lido Isle, had several observations to make today re the following:
1) The roads in Bel Lido, 2) Entrance way landscaping, 3) Dead wood on trees on A1A.

B) BOARD VACANCIES: ONE (1) ON BEACHES & SHORES ADVISORY BOARD.
Acting Town Manager noted that Commissioner Scala-Pistone requested that talent bank
applicants with no board preference be contacted, inquiring about their interest in the
Board. Ms. Trinley noted that two had no preference, one had no interest and one did
not respond.

5. PROPOSED ORDINANCES AND RESOLUTIONS
(1) AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND
BEACH, FLORIDA, AMENDING CHAPTER 4-8(c), LIGHTING RESTRICTIONS
FOR PROTECTION OF SEA TURTLES. (first reading 3R/06; published 3/27/06)
PLEASE REFER TO TOWN MANAGER'S MARCH 23 MEMO, ATTACHED.
Attorney Sliney spoke about the County ordinance which states lights out from dusk to
dawn, whereby, Highland Beach code states from 11 p.m. to 6 a.m. He suggested
• changing the Towns ordinance to be in conjunction with the County, though they may
remain the same. The only problem may be if the Town decides in the future to apply
for funds for beach protection, then the County would review ordinance to see if it was
stringent enough, and if not, the Town could probably amend the ordinance at that time.
He noted that he would like to discuss this with Mr. Sugerman.
(2) AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING
ORDINANCE NO. 710, WHICH APPROPRIATED FUNDS FOR THE
FISCAL YEAR 2004-2005, WHICH BEGAN OCTOBER 1, 2004 AND
ENDED SEPTEMBER 30, 2005. (first reading; published 3/27/06)
Attorney Sliney noted that the first reading will be done at next week's Regular meeting.
Finance Director Stan Novak discussed the appropriations with the Commission,
addressing particular issues of concern.
3. A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND
BEACH, FLORIDA, ESTABLISHING A SPECIAL LAW ENFORCEMENT
TRUST FUND FOR THE HIGHLAND BEACH POLICE DEPARTMENT.
Chief Glenn Goss explained how monies from criminal investigations, causing people to
be put under arrest and assets obtained from the defendant. In order for the Town to
• accept the asset forfeitures by state law, is to have an account (LFTF) set up to be sure
that the municipality can only use those gains for law enforcement related

purposes. These forfeitures cannot be obtained unless the municipality already has an
account set up, and these gains may be shared by other municipalities involved in the
investigation.
Funds may be used for additional needed operational equipment for the department
which may not have been budgeted. (Statute Ch. 932). There was consensus by the
Town Commission that an account should be set up.
4. A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND
BEACH AMENDING RESOLUTION NO. 833 WHICH ESTABLISHED A
CULTURAL BOARD.
The Cultural Society Board- requests that the Commission approve dropping the word
"Society" from the Board's name, as it has no relevance to the work of the Board. There
was consensus by the Commission; item placed on the April 6, 2006 agenda.
6. NEW BUSINESS
PROPOSED AMENDMENT TO THE FRS PROGRAM FOR DEPARTMENT
• HEADS.
Finance Director Stan Novak noted that this is a program being offered to all senior
management within the FRS program, offering a 2% value per year of service. Total
cost to the Town will be approximately $12,000. This will be discussed further at the
April 6, 2006 Regular Meeting.

8. REPORTS -TOWN COMMISSION
COMMISSIONER JIM NEWILL, CPA Made comments about certain items in the
Comprehensive Annual Financial Report.
COMMISSIONER ZWICK None.
COMMISSIONER SCALA-PISTONE Spoke about residents concern re
handicapped spaces being reduced at Toscana. Mayor Hagelmann noted that this is
• being looked into.

VICE MAYOR ASSELTA Thanked the residents for overwhelmingly supporting
the referendum for the water plant.
MAYOR HAGELMANN Thanked the Commission, Town Manager and Dept. Town
Heads for the smooth running of the Town.
9. REPORTS -TOWN ATTORNEY None.
10. REPORTS -ACTING TOWN MANAGER Noted that the Palm Beach Post
newsrack was removed from the front of Town Hall (it appeared mysteriously several
weeks ago). Asked that the Commission approve $550 for gift cards for the poleworkers
for their work at the municipal election ($50 each). Commission will take action on this
at the April 6 Regular Meeting.
11. CONSENT AGENDA None.
12. PUBLIC COMMENTS AND REQUESTS RELATED TO ITEMS DISCUSSED AT
MEETING
• Joe Yucht spoke on the following three items: 1) Resolution No. 3 (Law Enforcement
Trust Account) is a win/win situation. 2) When a speaker refers to a chart, map,
document, etc., that an overhead projector and screen be used for the audience to view.
3) Discussion re budget; a sum of money to be expended, how does it get paid for?
The whole budgetary process should be brought up to date.
13. ADJOURNMENT
There being no further business to come before the Commission at this time, MOTION

TOWN OF HIGHLAND BEACH
Workshop Meeting March 28, 2006 1:30 pm.
I am a resident of Bel Lido Isle, 4220 Tranquility Drive. I contributed $400 earmarked for the
purchase of plants and trees in the entry island and sides of the entry which is owned by the
Town of Highland Beach.
I, along with other residents of Bel Lido, felt that the entryway did not reflect the rising value of
our homes. I agreed to be a part of a project to work with the town by contributing funds toward
the purchase of Medjool Date Palms and landscaping which would compliment the trees.
I was interested in a professionally landscaped island to reflect the value of our homes.
I believe over $13,000 was collected and contributed toward that end. I feel that the plants and
trees do not present a professional look nor do they compliment our neighborhood. The Royal
Palms which were planted are extremely high and may fall on the wires during a storm. The
other plants are scattered, thinly planted and do not match each other. The entryway needs much
work The new wooden borders that were put in to house the plants only last month have akeady
broken. I had to get out of my car and push them over to the side to avoid driving over them.
They are still there. The bridge and sign need painting. The lights purchased for the posts are
undersized. I am not being critical just concerned. I am asking for an accounting of the monies
donated by Bel Lido with purchase orders and receipts totaling our contribution.
I also ask that someone investigate the roads which were put in in Bel Lido. They did not last the
first summer. They literally "melted" with big gouges in them from dumpsters and construction
trucks. I fell in a gouge while roller blading and twisted my ankle; I am concerned others may do
the same. Most of the reflectors have disappeared. They appear to be of poor quality with a very
thin coating. The road reclamation project, as it was explained, was to give us better drainage.
The fact is we have worse drainage in many areas. I have requested the drain in front of my
house be reopened over 6 times in the last year. It remains closed
I also notice that the trees along A 1 A have not had dead foliage trimmed off of them since I
moved in here 2 years ago. I avoid walking under them for fear the dead wood might fall. The
hurricanes have made it worse. Are there any plans to increase the staff who tend the
landscaping? Since Highland Beach has grown, perhaps we need more staff to keep the borders
along AlA consistent with our property values.
I would be happy to help form a beautification committee for the town to work with our existing
employees rather than just submit issues.
