PLANNING BOARD REGULAR MEETING MINUTES
Wednesdav, June 12, 1996 9.30 A M
Chairman Robert L. Lowe called the Regular Meeting to order in
Commission Chambers at 9:30 A.M.
Deputy Town Clerk Jane Dillon called the roll. Present were
Chairman Robert L. Lowe, Vice Chair .Leonard D. Bell, Members
William Maltz, Felix R. Goldenson and Michael W. Hill. Alfred E.
Bresnahan and Paul R. Kane were absent.
Also present were Town Manager Mary Ann Mariano, Building Official
Ed Hardy, Town Attorney Thomas E. Sliney and members of the general
public.
APPROVAL OF MINUTES
Upon MOTION by MR. HILL/MR. GOLDENSON, the minutes of the May 8,
1996 Regular Meeting were unanimously approved.
NEW BUSINESS
PRELIMINARY REVIEW FOR DEMOLITION OF EXISTING SINGLE FAMILY HOME,
AND BUILDING A NEW SINGLE FAMILY HOME AT PROPERTY LOCATED AT 4409

Mr. Hardy stated that the applicant has met all town ordinances as
far as setbacks are concerned. Mr. Conway then offered an overview
of the future home stating that a new structural system would be
installed, thereby not utilizing the old pilings. He described
some of the desirable features of the home.
Mr. Goldenson expressed a concern about the hurricane requirements
for a new home. Mr Hardy stated that Highland Beach ordinance
requires that a home must withstand a 140 mile per hour winds load.
A permit obtained prior to October 1, 1996 does not required the
home to have hurricane shutters, after October 1 all homes must
install shutters or impact resistant glass. Mr. Hardy and Mr.
Conway stated that subject home will be constructed with hurricane
shutters in place.
After review of the plans and all questions were answered to the
satisfaction of the board, MOTION was made by MR. MALTZ/MR. HILL.

DISCUSSION RE PROHIBITION OF BOAT BASINS ON LOTS OF LESS THAN ONE
(1) ACRE.
Discussion revolved around the possibility of the town endorsing an
ordinance to prohibit boat basins on pieces of property of less
than one acre. This would incorporate most of the residential
areas within Highland Beach, but leave open the option to construct
basins on larger parcels of land of an acre or more.
Discussion showed that boat basins on the inner waterways (canals)
are "catch basins" for stagnant water, debris, oil, etc. due to the
lack of the "flushing action" of these canals. Boat basins may
deflect from the surrounding neighbors' view, and would also take
away required lot footage for an existing home or a future home on
subject property.
Mr. Sliney referenced the Town Code Book, stating page 1779,
Chapter 30, Section 5, as to where the ordinance would be added,
creating a new section a under 5.2. This would show definition of
a boat basin, and criteria for same.
Mr. Goldenson felt strongly that stating a required size for basins
should be included. With further discussion, it was felt that any
applicant who may come forth for same, would be reviewed on a
one/one basis and the issue of size would then be addressed.
Mr. Sliney, Ms. Mariano and Mr. Hardy will draft an ordinance with
appropriate language which will be reviewed by the Planning Board
at the July 10 Regular Meeting.
With no further business to come before the Board, MOTION to
adjourn was made by MR. HILL/MR. MALTZ at 10:35 A.M.
