PLANNING BOARD
REGULAR/SPECIAL MEETING
MINUTES
Wednesday, September 11 1996 9 30 A M
Chairman Robert L. Lowe called the Regular Meeting to order in
Commission Chambers at 9:30 A.M.
Deputy Town Clerk Jane Dillon called the roll. Present were
Chairman Robert L. Lowe, Members Alfred E. Bresnahan, Paul R. Kane,
William Maltz, Michael W. Hill and Felix R. Goldenson. Vice Chair
Leonard D. Bell was absent.
Also present were Town Manager Mary Ann Mariano, Town Attorney
Thomas E. Sliney, Building Official Jim Duvall and members of the
general public.
APPROVAL OF MINUTES
Upon MOTION by MR. BRESNAHAN/MR. BROWNER the minutes of the July
10, 1996 Regular Meeting were unanimously approved.
With no further business to come before the Board at this time, the
Regular Meeting was adjourned at 9:35 A.M.
• NEW BUSINESS
Immediately following the Regular Meeting, Chairman Lowe called the
Planning Board Advertised Public Hearing Meeting to order at 9:36
A.M. He noted that all the preceding members were present.
The agenda item to be heard was a proposed ordinance amending the
town code of the Town of Highland Beach, Florida, Chapter 30,
entitled "Zoning" to provide that section 5.2 entitled "Accessory
Uses and Structures" be amended by the addition of Section 5.2 (e)
entitled "Boat Basins Prohibited."
Following deliberation and consideration of public comments, the
Board will make a recommendation to the Town Commission.
Attorney Sliney presented the procedure in which the meeting should
be conducted, at which time the audience was asked if anyone would
be speaking; there was no response. The recording secretary was
asked to read the dates of publication for the record.
Ms. Mariano presented a staff report on behalf of the Building
Department and the former building official, stating the reasons
for considering prohibiting such basins; such as stagnant water,
less than adequate flushing on minimum lot size, and the issue of
concerns of neighboring properties. Approval of subject ordinance
• would reduce the need for a resident to come before the board
seeking approval of same, which may ultimately result in a

denial due to said reasons; unless a hardship could be validated.
Because there were no public comments, Chairman Lowe opened
discussion to the Board. There was lengthy discussion on the
language within the ordinance, that it portray the intentions of
what the ordinance was to accomplish. After the issues were
discussed, the Board agreed on the verbiage as it was presented.

minutes).
Thereafter, MOTION was made by MR. MALTZ/MR. BRESNAHAN as follows:
THE PLANNING BOARD RECOMMENDS THAT THE PROPOSED
ORDINANCE BE ADOPTED BY THE TOWN COMMISSION.
The following roll call vote was taken:
Mr. Maltz Yes Mr. Kane Yes
Mr. Hill. No Mr. Browner. Yes
Mr. Bresnahan Yes Chairman Lowe. Yes
In a vote of 5 to 1, it was recommended that subject ordinance go
before the Town Commission for adoption.
. OTHER BUSINESS
Ms. Mariano introduced Jim Du Vall, the Town's new Building
official, to the Board. Mr. Du Vall presented his background to
the members.
At Mr. Maltz's suggestion, Mr. Du Vall will compile a list of
contractors licensed in Highland Beach, and distribute to all
condominiums for residents use in seeking a contractor for work.
This should help alleviate the problem of unlicensed contractors
performing work in town.
The next Planning Board meeting is scheduled for October 9 at 9:30
A.M. The Board will hear a presentation from Jim Parks of Gee &
Jenson on the Town's Comprehensive Plan Evaluation and Appraisal
Report.
With no further business to come before the Board, MOTION to
adjourn was made by MR. BANE/MR. BROWNER at 10:50 A.M.

FLORIDA, AMENDING THE TOWN CODE OF THE TOWN OF
HIGHLAND BEACH, FLORIDA, CHAPTfiR 30, ENTITLED
"ZONING" , TO PROVIDE THAT SFsCTION 5 .2 ENTITLED
"ACCESSORY USES AND STRUCTURES" BE AMENDED BY
THg ADDITION OF S$CTION 5.2(e) ENTITLED
"BOAT BASINS PROHIBITED."
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN
OF HIGHLAND BEACH, FLORIDA. THAT:
Section 5.2 of Chapter 3o entitled "Zoning" is hereby
amended by the addition of Section 5.2 (e) which shall read as
follows:
5.2(e). Boat Basins Prohibited. Boat basins
are prohibited in all zoning districts on lots
less than one (1} acre in size. A Boat Basin
is defined as a harbor created by decreasing
the land area of any existing lot and which
provides for dockage, covered or uncovered, or
wet or dry storage.

BEACH, FLORIDA, THIS DAY OF A_D_, 1996_
THIS ORDINANCE SHALL BECOME EF`FSCTIVE IMMEDIATELY UPON ITS PASSAGE.
