1999.08.11_PB_Minutes_Regular (2)• • • TOWN OF HIGHLAND BEACH PLANNING BOARD PUBLIC HEARING MINUTES Tuesday August 11 1999 10:55 A.M. Chairman Alfred E. Bresnahan called the Regular Meeting to order in Commission Chambers at 9:30 A.M. Deputy Town Clerk Jane Dillon called the roll. Present were Chairman Alfred E. Bresnahan, Members Victor P. Hadeed, S. Myron Browner, Guido Teichner, Eugene Diliberto and Gerald Church. Harold R. Hagelmann was absent. Also present were Town Attorney Thomas Sliney, Building Official Bob Dawson and members of the general public. Chairman Bresnahan stated for the record that subject Public Hearing was duly advertised, and the Board will be reviewing draft amendments regarding building height issues as follows: 1) Determination of finished floor (FFE) area for the west side of SRAlA; 2) Determination of FFE for the east side of SRA1A; 3) Measurement of building height; 4) Exceptions to building height: and 5) Definitions for building height exception, habitable spade, and usable space. Planning Board Consultant Marty Hodgkins reviewed with the Board the draft code amendments which were discussed at the August 2 Workshop Meeting. Some changes were made for clarification purposes. (amendments attached hereto and made a part of these minutes.) Several builders/architects were in the audience, who spoke against subject changes, declaring limitations to the now commonly built larger homes. After all concerns were made, the Public Hearing was closed at 11:50 a.m. With the Board now open to discussion, Mr. Hadeed expressed his disapproval of changes stating that they would not be in the interest of the residents of Highland Beach, and may encourage liability against the Town. He expressed agreement with counsel and some members of the audience that some homes would become non- conforming, and the onus would be on the Board of Adjustment to settle building issues. With discussion ended, the following MOTION was made by MR. TEICHNER/MR. BROWNER: THE PLANNING BOARD APPROVES SUBJECT PROPOSED CHANGES, AND WILL FORWARD TO THE TOWN COMMISSION FOR THEIR CONSIDERATION, AND RECOMMENDS ADOPTION OF SAME. • The following rollcall vote was taken: Mr. Church yes Mr. Diliberto yes Mr. Teichner yes Mr. Hadeed no Mr. Browner yes Mr. Bresnahan yes MOTION passed with a 5/1 majority vote.
