2000.02.09_PB_Minutes_Regular• TOWN OF HIGHLAND BEACH PLANNING BOARD REGULAR MEETING MINUTES Wednesday, February 9, 2000 9:30 A.M. Chairman Alfred E. Bresnahan called the Workshop Meeting to order in Commission Chambers at 9:30 A.M. Deputy Town Clerk Jane Dillon called the roll. Present were Chairman Alfred E. Bresnahan, Vice Chair Gerald Church, Members Victor P. Hadeed, S. Myron Browner, Eugene Diliberto, Harold Hagelmann and Guido Teichner. Also present was Building Official Bob Dawson, Town Attorney Thomas Sliney and members of the general public. -~ APPROVAL OF MINUTES Upon MOTION by MR. BROWNER/MR. HAGELMANN, the following sets of minutes were unanimously approved: JANUARY 05, 2000 - WORKSHOP JANUARY 12, 2000 - REGULAR JANUARY 12, 2000 - WORKSHOP JANUARY 17, 2000 - WORKSHOP • JANUARY JANUARY 24, 26, 2000 _ 2000 WORKSHOP SPECIAL (ROTHENBERG) FEBRUARY 02, 2000 - WORKSHOP NEW BUSINESS PRELIMINARY REVIEW FOR CONSTRUCTION TRAILER AT 2367 S. OCEAN BLVD. APPLICANT: ADDISON DEVELOPMENT/DAN SWANSON. The following MOTION was made by MR. TEICHNER/MR. HADEED: THE PLANNING BOARD GIVES FINAL APPROVAL FOR CONSTRUCTION TRAILER AT 2367 S. OCEAN BLVD.; APPLICANT: ADDISON DEVELOPMENT/DAN SWANSON. MOTION met with unanimous vote. PRELIMINARY REVIEW FOR NEW SINGLE FAMILY RESIDENCE; ALTERATIONS TO SITE WALL; FOR PROPERTY LOCATED AT 2342 S. OCEAN BLVD. APPLICANT: JEFF NORMAN. This is an existing 3 parcel track with one house currently on the middle parcel. Mr. Norman, who is closing on the property within the month, presented plans for a house on the South parcel. This will create a non-conformity in regard to setback requirements, with the existing house. Mr. Norman plans to lease existing house for a • year while the South house is being built, then demolish the existing house in order to build a new one in its place. At that • Planning Board Regular Meeting Februarv 9, 2000 Page 2 of 3 time, South house will come into conformance with setback requirements. It was recommended by the Town Attorney, that this be backed up by Mr. Norman not receiving a Certificate of Occupancy for the South house until the existing house is demolished. There was further discussion that a bond be obtained by Mr. Norman to back up his intent. Representatives of the Camelot Homeowners Association were present to inform the Board that Mr . Norman's project needs to be presented to the Association for their review and approval. Mr. Levine, Mr. Norman's attorney, stated that he has been attempting to contact the association in order to bring this before them. After further discussion the following MOTION was made by MR. TEICHNER/MR. HADEED: THE PLANNING BOARD GRANTS APPROVAL FOR NEW SINGLE FAMILY RESIDENCE, FOR PROPERTY LOCATED AT 2342 S. OCEAN BLVD., APPLICANT: JEFF NORMAN; UNDER THE CONDITION THAT THE CERTIFICATE OF OCCUPANCY FOR THIS HOUSE BE DIRECTLY TIED TO THE PRIOR DEMOLITION OF THE ADJACENT HOUSE AS DISCUSSED HERE, WITH THE ADVICE MR. SLINEY HAS GIVEN US; AND THAT THIS WILL BE IN A FORM THAT IS ENFORCEABLE AND FULLY • COMPLIANT; THAT THE NON-CONFORMITY CONDITION WILL BE GRANTED STRICTLY AS A TEMPORARY ONE TO ALLOW THE PROPERTY TO BE LEASED AS AN INTERIM MEASURE. After further discussion of the Motion which was made, the following Rollcall Vote was taken: Mr. Hadeed yes Mr. Teichner yes Mr. Hagelmann no Mr. Diliberto no Mr. Browner no Mr. Church no Mr. Bresnahan no MOTION denied by a 5/2 vote. In order to obtain possible approval, the Board recommended that Mr. Norman either obtain a bond to back his intent to demolish the existing house, or consider demolishing it prior to the beginning of any construction. Chairman Bresnahan asked Mr. Norman to return on Feb. 23 to present his resolution to this situation, and at that time the Board will review the house plans. • •~ Planning Board • Februarv 9, 2000 Pane 3 of 3 ADJOURNMENT With no further business to come before the Board, MOTION to adjourn was made by MR.
