PLANNING BOARD
SPECIAL MEETING MINUTES
Wednesday, August 16, 2000 9.30 A M
Chairman Alfred E. Bresnahan called the Regular Meeting to order in
Commission Chambers at 9:30 A.M.
Deputy Town Clerk Jane Dillon called the roll. Present were
Chairman Bresnahan, Vice Chair Gerald Church, Members S. Myron
Browner, Neil W. Burd, Guido Teichner, Harold Hagelmann, Theresa M.
Colarullo and Eugene Diliberto. Also present were Building Official
Bob Dawson, Town Attorney Thomas Sliney and members of the general
public.
NEW BUSINESS
PRELIMINARY REVIEW FOR DEMOLITION AND CONSTRUCTION OF A SINGLE
FAMILY HOUSE FOR PROPERTY LOCATED AT 4621 SOUTH OCEAN BLVD;
APPLICANT: BENEDICT GROUP, ARCHITECTS / OWNER: JACURA FLORIDA.
Chairman Bresnahan read a letter from Mrs. Lucia Milani, who is the
neighbor to the North of subject property. She asked that three
• concerns be addressed: 1)location of air conditioners and pool
equipment, 2) landscaping plans not filed with the Building
Department, and 3) existing, legal, non-conforming guest house.
(Letter attached hereto and made a part of these minutes.)
Mr. Benedict responded to these concerns as follows: 1) The air
conditioners can be located further West on the same side of the
house, and the pool equipment can be moved to the South side of the
house. 2) Landscaping plans have now been filed with the Building
Department. 3) Guest house, which is actually a 3 car garage with
an apartment, will remain. The stairway will be moved and a second
bedroom added.
It was noted that the garage/guest house was not on the plans being
considered, and it was asked if, under the new code, the entire
property needed to be brought into conformity. It was suggested
that applicant go before the Board of Adjustment for a variance for
non-conformance use of the garage, prior to the Planning Board's
approval of the main house.
Attorney Sliney stated that he would need to meet with Mr. Dawson
and review the new code as it pertains to existing legal non-
conformance buildings.
After further discussion, the following MOTION was made by MR.
CHURCH/MR. TEICHNER:

MOTION TO TABLE APPLICATION UNTIL THE TOWN ATTORNEY CAN
PROVIDE AN OPINION IN TERMS OF THE CONFORMITY OF THE
PROPOSED BUILDING, AND THE FACT THAT THERE IS A NON-
CONFORMING USE ON IT. BASED ON THAT DETERMINATION, THE
BOARD WOULD BE IN A POSITION TO MAKE A JUDGEMENT ON WHAT
THE APPLICANT WOULD LIKE TO DO.

1 am the owner of 4612 South Ocean Blvd. which is located im~nediatdy north of the
subject property. Please provide the Ptanaiag Board witb this letter on my behalf.
• 1 have had an opportunity to review the site plan [or the above referenced property
And have the following coacerps:
1. The fonr {4) Air conditioning unlb and the pool equipment
on the north side will be located in the vicinity of my muster
bedroom suite. This equipment generates a sig»itlcant amount vE
noise sad should not be pereaitted close to sleeping areas.
2. No landscape plans were available for revietiv :nd I have concerns
thAt adequate landscaping be done to protect my privacy and
mitigate the visual impact such a massive structure wiU have on
my property.
3. The esisteng guest house Z understand wilt remain as is which is a
legal non cont'ormiag use. Please advise me in writing if sad when
any changes are proposed to this structure.
