Chairman Neil W. Burd called the Regular Meeting to order in Commission Chambers
at 9:30 a.m. Present were Vice-Chair Terry Colarullo, Gerald B. Church, Leonard D.
Bell, Victor P. Hadeed and Louis P. Stern. Robert Silverberg was absent. Also present
was Town Attorney Thomas E. Sliney, Code Enforcement Officer Richard Olbrych and
members of the general public.
APPROVAL OF MINUTES
Upon MOTION by MR. HADEED/MRS. COLARULLO, the Minutes of the May 12, 2004
Regular Meeting were unanimously approved.
NEW BUSINESS
PRELIMINARY REVIEW FOR ADDITION TO EXISTING HOUSE FOR PROPERTY
LOCATED AT 1006 GRAND COURT. APPLICANT: CHARLES AND ELLEN SOLLINS.
During discussion, Mr. Olbrych stated that the application meets the Towns zoning
• criteria. Chairman Burd asked the square footage of the existing lot, of which the
applicant did not have on hand. After viewing the plans, and further discussion the
following MOTION was made to give a FINAL CONDITIONAL approval subject to the
applicant providing square footage of lot to Building Official in accordance with the Town
zoning codes.
A recess was called at 10:25 in order that the applicant could obtain the information for
the members. (during the course of the recess it was discovered that existing house is
larger than the town allows for). After resuming the meeting this item was discussed.
It was believed by the Town Attorney that when the homes were constructed in Grand
Cay some 20 years ago, there was a settlement of some sort allowing larger homes to
be built. While Mr. Sliney did not recall the details, he suggested the applicant obtain
this agreement from his homeowners assoc., and the Town try to locate their agreement.
It was also noted that if the agreement did allow an exception, can the Planning Board
now approve an addition, creating an even larger home.
Mr. Church withdrew his motion for conditional approval. All were in agreement.
After further discussion, a FINAL APPROVAL was granted subject to the Town Attorney
and the Building Dept. determining if application conforms to subject litigation settlement.
There will be no approval for construction until concurrence of agreement.
• MOTION met with unanimous approval.

Mr. Church recommended that future applications come before the Baord as a Final
Approval if Mr. Dawson notes that they meet all Town codes, rather than come before
the Board under Preliminary Review. The members agreed to this change.
ADJOURNMENT
nth no further business to come before the Board, MOTION to adjourn was made by
