Page 3 RESOLUTION NO. 2024-004 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, DECLARING EACH UNOPPOSED CANDIDATE FOR THE TOWN COMMISSION ELECTED TO OFFICE; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the Town of Highland Beach’s General Election was scheduled for March 19, 2024 in accordance with the law and Town Charter; and WHEREAS, the candidate qualifying period for the Town’s General Election commenced November 14, 2023 at noon and ended on November 28, 2023 at noon, with one candidate qualifying for the office of Mayor-Commissioner, one candidate qualifying for the office of Vice Mayor-Commissioner, and one candidate qualifying for the office of Commissioner; and WHERAS, according to Section 101.151(7), Florida Statutes, except for justices or judges seeking retention, the names of unopposed candidates shall not appear on the general election ballot, and each unopposed candidate shall be deemed to have voted for himself or herself; and WHEREAS, in these circumstances the Election Code authorizes the governing body to declare the unopposed candidate elected to office; and WHEREAS, no candidate for the office of Mayor-Commissioner, the office of Vice Mayor-Commissioner, nor for the office of Commissioner appeared on the ballot in the March 19, 2024 election; and WHEREAS, the Town Commission deems approval of this Resolution to be in the best interest of the health, safety and welfare of the residents and citizens of the Town of Highland Beach and the public at large. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, that: Section 1. Recitals. The above recitals are true and correct and are incorporated herein by this reference. Section 2. Election Results. The Town Commission hereby declares that each unopposed candidate is elected to the office of Commissioner as summarized as follows: (a) That Natasha Moore has been elected to the office of Mayor-Commissioner for a two-year unexpired term beginning March 26, 2024 and ending March of 2026; and (b) That David Stern has been elected to the office of Vice Mayor-Commissioner for a three-year term beginning March 26, 2024 and ending March of 2027; and Page 4 Resolution No. 2024-004 2 (c) That Judith Goldberg has been elected to the office of Commissioner for a three- year term beginning March 26, 2024 and ending March of 2027; and Section 3. Effective Date. This Resolution shall become in full force and effect immediately upon its passage and adoption. Page 6 TOWN OF HIGHLAND BEACH AGENDA MEMORANDUM MEETING TYPE: Commission Meeting MEETING DATE 03/26/2024 SUBMITTED BY: Chief Craig Hartmann, Police Department SUBJECT: Resolution No. 2024-006 A Resolution of the Town Commission of the Town of Highland Beach, Florida, for assistance 2024 under the Florida Inland Navigation District – Waterways Assistance Program and providing for an effective date. SUMMARY: Consideration to approve Resolution No. 2024-006 of the Town Commission of the Town of Highland Beach Florida, for assistance 2024 under the Florida Inland Navigation District (FIND)– Waterways Assistance Program. The Marine Unit of the Highland Beach Police Department was started in 2022 after a series of waterway accidents. Since that time, the patrol boat has been housed at a slip owned by Boca Highlands Condominium. To establish a Town-owned police/fire dock, we intend to make application to the Florida Inland Navigation District – Waterway Assistance Program, for a 50% matching grant to fund Phase One of the project. The proposed dock will be installed behind the Town Library and will serve public safety needs to include Police and Fire/ Rescue. Phase One of the project includes design, engineering, and permitting. The total estimated cost of Phase One is $100,000.00. FISCAL IMPACT: $50,000.00 (50% Matching Grant from FIND) ATTACHMENTS: Resolution No. 2024-006 Chapter 66B-2 Waterway Assistance Program, Draft Application to FIND. RECOMMENDATION: Staff recommends that the Town Commission adopt Resolution No. 2024-006 for the FIND - Waterways Assistance Program. Page 7 RESOLUTION NO. 2024-006 A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, SEEKING FINANCIAL ASSISTANCE FROM THE 2024 FLORIDA INLAND NAVIGATION DISTRICT WATERWAYS ASSISTANCE PROGRAM AND PROVIDING THE REQUIRED CERTIFICATIONS AND ASSURANCES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Town of Highland Beach is interested in carrying out the following described project for the safety of the citizenry of the Town of Highland Beach and the State of Florida: Project Title: Highland Beach Police Department Public Safety Dock Total Estimated Cost $100,000.00 Phase #1 Brief Description of Project: Public Safety Police and Fire Rescue emergency dock. AND, Florida Inland Navigation District financial assistance is required for the program mentioned above, NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, that the project described above be authorized, AND, be it further resolved that said Town of Highland Beach make application to the Florida Inland Navigation District in the amount of 50% of the actual cost of the project of said Town of Highland Beach, AND, be it further resolved by the Town of Highland Beach that it certifies to the following: 1. That it will accept the terms and conditions set forth in FIND Rule 66B-2, F.A.C. and which will be a part of the Project Agreement for any assistance awarded under the attached proposal. 2. That it is in complete accord with the attached proposal and that it will carry out the Program in the manner described in the proposal and any plans and specifications attached thereto unless prior approval for any change has been received from the District. 3. That it has the ability and intention to finance its share of the cost of the project and that the project will be operated and maintained at the expense of said Town of Highland Beach for public safety use. That it will not discriminate against any person on the basis of race, color, or national origin in the use of any property or facility acquired or developed pursuant to this proposal, and shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P.L. 88-352 (1964) and design and construct all facilities to comply fully with statutes relating to accessibility by persons with disabilities as well as other federal, state, and local laws, rules, and requirements. 5. That it will maintain adequate financial records on the proposed project to substantiate claims for reimbursement. 6. That it will make available to FIND if requested, a post-audit of expenses incurred on the project prior to, or in conjunction with, request for the final 10% of the funding agreed to by FIND. This to certify that the forgoing is a true and correct copy of the resolution duly and legally adopted by the Town Commission of the Town of Highland Beach, Florida at the Town Commission Special Meeting held on this 26th day of March, 2024.
