1976.02.12_BAA_Minutes_Regular MINUTES: HOUSING BOARD OF ADJUSTMENT AND APPEALS n MEETING HELD WEDNESDAY, FEBRUARY 12, 1976 The meeting was called to order at 10 :25 A.M. by the Chairman and opened with the salute to the flag. PRESENT WERE: Chairman Santangelo, Vice Chairman Genovese, Secretary Vendeland, Mr. Carl Krauss and Mr. Ben Stephenson. ABSENT: Alternates John Kanner and Lyman Jenkins In attendance were Mrs . Roberts, the Town Manager, and Mr. John O' Grady, the Building Official. Minutes of the previous meeting were read by Secretary Vendeland. Motion made by Mr. Genovese, seconded by Mr. Stephenson to accept the minutes as read. Unanimously carried. Mr. O 'Grady reported that Boca Cove has completed the east side and will be working on the west side. Mr. Krauss inquired regarding the lot next to his home in Bel Lido on which the trucks have plowed and wanted to know if the lot could be restored. Mr. O'Grady Ps\, replied that this problem should be taken care of by the end of the week. ELECTIONS: Mr. Genovese offered the name of Judge Santangelo be placed in nomination for Chairman, seconded by Mr. Stephenson. No other nominations were offered. Voice vote was unanimous. The Chairman then placed the name of Peter Genovese as Vice Chairman, seconded by Mr. Stephenson. Mr. Genovese' s nomination was approved unanimously. It was then moved by Mr. Stephenson, seconded by Mr. Krauss that Mrs. Vendeland be Secretary of the Board. Unanimously carried. Mrs. Roberts stated that she was happy with the selection of officers. Mr. Genovese reported that Mrs. Roberts gave a lovely talk to the residents of Boca Hi and stated that it was a commendation for the Town of Highland Beach that Mrs. Roberts is thought of so highly by all of the people in the Town and urged her to accept any future in- vitations to speak. The Procedures as drafted were read by Mrs. Vendeland, and certain minor changes were suggested. The Procedures as drafted with the S 7 Minutes of Meeting of Housing Board n of Adjustment and Appeals February 12, 1976 page 2 changes will become a part of these minutes. Mrs. Roberts sug- gested that we do not consider adopting these procedures in their final form until we get this amendment to the code. A motion was made by Mr. Stephenson, seconded by Mr. Krauss at 11:40 A.M. to adjourn the meeting. Building Official serves notice of any violations in writing, including statement of reasons and time for completion by: a. delivery of notice to owner personally, or with person / ��� � � of suitable age and discretion at usual place of a-awtma. P� - of owner; or i � b. by U. S. mail^wof n'btic to owner at last known address; Or c. posting of notice for 24 hours in a conspicuous place on premises involved. 2 . Building Official allows 120 days for performance of required acts. 3. Building Official institutes legal proceedings charging with a violation of this Code, if required acts are not completed within stated time set forth in written notice. SECTION 104. INSPECTIONS: .SOAl 1. Building Official shall make or cause to be made inspections reg: U condition, and shall be given free access at all reasonable times. SECTION 105. HARDSHIPS: • jEf 1. Building Official decisions may be appealed to Housing Board of Adjustment and Appeals--refer to Section 7 . SECTION 106. 1 HOUSING BOARD OF ADJUSTMENT AND APPEALS: 1. Board consists of: a. not less than 3 members b. residents of Town c. appointment for 3 year terms except that on initial appointment, appointment shall be at least 1 for 1 year, 1 for 2 years and 1 for 3 years; d. removal of replacement by Governing body for cause of stated charges after public hearing before governing body e. vacancy filled by governing body for unexpired term of such vacancy f. members serve without compensation. 2. After appointment: a. members meet and organize b. elect a Chairman, Vice Chairman and Secretary c. thereafter elect officers at first annual meeting. SECTION 106.2 BOARD MEETINGS: _I n 4- Fr page -2- . 1 2-. 1 PROCEDURES SOUTHERN STANDARD HOUSING CODE SECTION 106.3 BOARD RECORDS: 00 1 . Secretary of the Board to keep minutes of all meetings, all records, and perform such additional duties as Board deems proper. SECTION 106.4 BOARD DUTIES: 1. To consider and determine appeals re : decisions of Building Offical 2. To permit a reasonable extension of time for action required by Building Official (not more than 8 months from date of Notice of violations) . 3 . No appeal considered where an appeal case was decided previously involving same premises. SECTION 106.5 BOARD DUTIES PROCEDURE: 1. Board to establish own rules of procedure for accomplishment of duties and functions--not to be in conflict with provisions of this Code and State Laws. SECTION 106.6 BOARD DECISIONS: • 1. All Board decisions shall: a. specifiy in what manner such variance or modification is made b. conditions upon which it is made c. reasons therefore d. to be in writing e. indicate vote upon decision f. copy promptly filed in office of Building Official and • Town Manager � �` •✓� (v\ g. open to public inspection 0 ' 4.h. Secretary to notify appellant in writing^of final action of Board. SECTION 107 APPEALS: 1. An appeal in writing may be filed by person receiving written notice from Building Official, within 15 days following date of such notice, to Housing Board of Adjustment and Appeals stating: a. location of property b. date of notice of violations c. number of such notice d. variance or modification requested e. reasons therefore 4 f. hardship or conditions upon which appeal is made. 2.
