1991.10.03_CRB_Minutes_Regular TOWN OF HIGHLAND BEACH, FLORIDA CHARTER REVIEW BOARD ORGANIZATIONAL MEETING Thursday, October 03 . 1991 10 : 00 A.M. Town Attorney Thomas E . Sliney, acting in the capacity of tempora- ry chairman, called the organizational Meeting of the Charter Review Board of the Town of Highland Beach to order at 10 : 00 A.M. on Thursday, October 03 , 1991 . Members present were : Leonard Bell , Edison Brandt, Leon Canova, Betty Dodd, Betty Goldenson, Helene Harris , Paul Kane, Robert Lowe , Ray Murphy and Daniel Stump. Absent was Member Russell Richardson . Also in attendance were Town Manager Mary Ann Mariano, Town Clerk Anne M. Kowals and Commissioner Arlin Voress . Members were given packets which contained a copy of the Town Charter, Resolution No . 595 which created a Charter Review Board, a list of the Charter Review Board Members as well as a listing (submitted by the Municipal Code Corporation) of recommendations for possible amendments to the Town Charter . The Town Attorney noted the Charter Review Board was established by Resolution for the purpose of having the current Town Charter reviewed as some sections have become obsolete . Also noted was the fact that it has been approximately fifteen ( 15 ) years ago that the Town Charter was reviewed by a Committee . Town Attorney Sliney stated that the Town recently adopted the recodified Code of Ordinances, done in conjunction with Municipal Code Corporation, Tallahassee, Florida, who also went through the Town Charter and made certain recommendations . Commissioner Voress noted the Town Commission has high hopes this Board will provide tremendous effort to go over the Charter, take the Town Attorney' s lead and look into this matter . The Town Attorney advised a Chairman and Vice Chairman of the Charter Review Board must be appointed by the Members . The nomination of Leonard Bell as Chairman was proposed by PAUL KANE/LEON CANOVA. Mr. Bell declined the nomination and proposed the Members be asked "Who would like to be Chairman?" At this point, LEON CANOVA nominated Ray Murphy as Chairman. The nomination was seconded by EDISON BRANDT. The nomination was favorably received. PAUL KANE nominated Betty Dodd as Vice Chairman of the Charter Review Board. HELENE HARRIS seconded the nomination which was accepted without objection. • Charter Review Board Organizational Meeting Minutes October 03 , 1991 teTh Page 2 of Town Manager Mariano suggested the Members of the Charter Review Board not get bogged down by the Municipal Code Corporation' s recommendations for possible amendments to the Charter because much of the Charter is governed by the State Statutes . It was further suggested that the Board look for things that are unique to and just for the Town of Highland Beach . The Town Attorney stated the Town Charter is legal - it just needs to be up-dated inasmuch as parts of the Charter are archaic in the language . It was suggested Members read the Charter and look at the Municipal Code Corporation comments regarding the Charter in order to get a flavor of what is in the Town Charter. In discussing a meeting schedule, it was suggested one meeting per month as the Members will have much homework between sessions as this is a technical committee (with additional meetings set as needed) . It was the consensus of the Board to schedule a Meeting for Tuesday, October 22, 1991 at 10:00 A.K. at Town Hall. Town Attorney Sliney informed the Members that, if they wish to review the Florida Statues , they may do so at Town Hall as the Town Manager has the Florida Statutes (without comments ) . Should they desire to review the Florida Statues with comments ( cases and interpretations) , they can arrange to visit the Town Attorney' s Office where such volumes are available . It was suggested by Commissioner Voress that perhaps the Members of the Charter Review Board might wish to contact the Commissioner responsible for their appointment to determine if there is some- thing specific that Commissioner may want addressed with regard to the Town Charter. In response to a question from a Member, the Town Attorney advised he does not think we have any controversial issues in the Charter. It was noted the Code of Ordinance is like by-laws of a corporation; the Charter gives you specific laws and your Code of Ordinance amplifies them.
