1986.08.28_CAB_Minutes_Regular TOWN OF HIGHLAND BEACH, FLORIDA COMMUNITY APPEARANCE BOARD REGULAR MEETING - Minutes n Thursday, August 28, 1986 9: 30 A.M. Chairman Frank Savino called the Regular Meeting of the Community Appearance Board to order at 9: 30 a .m. at Town Hall . The Recording Secretary called the roll . Present were Chairman Frank Savino, Vice Chairman Guy Galizia, Secretary Louise Johnson, Helene Harris, Arthur Keller , and Martha J. Dempsey (Alternate Member) . Absent was H. C. Arnold (Alternate Member) . Also present was Deputy Town Clerk/Recording Secretary Elizabeth L. Kolek . MOTION was made by Louise Johnson , seconded by Helene Harris, to approve the minutes of the July 31, 1986 Regular Meeting as submitted. All voted AYE. MOTION was made by Guy Galizia , seconded by Helene Harris, to approve the minutes of the August 4, 1986 Special Meeting as submitted. All voted AYE. OLD BUSINESS Chairman Savino announced that the permanent sign review re Villa Magna boat dock was canceled from today' s agenda and will possibly be on the • October Regular Meeting Agenda , if the C.A.B. is notified by a Villa Magna representative. The reason for today' s cancellation was because a principal involved who was not available for this meeting and would not be available until October . Chairman Savino announced that he had received a Memo from Building Official Bruce Sutherland which stated that Casuarina' s representative requested an inspection of their landscaping. Chairman Savino and Arthur Keller visited the site on Thursday, August 21 and found that a number of trees had been replaced but 11 more trees were determined to be in need of replacing , in addition to those in need of pruning and shaping . George Gwiazdowski , Casuarina' s representative, will notify Chairman Savino when the work is completed . The $3, 000. 00 performance bond will be held by the Town until all work is completed to the C.A.B. ' s satisfaction. Chairman Savino read his Memorandum dated 8/25/86 to Tony Abbate, Code Enforcement Officer , re "2355 South Ocean Boulevard, Highland Beach" in which the C.A.B. ' s opinion was given, at Mr . Abbates' s request, as to what can be done regarding the present vegetation on Town Lots 133 to 137 (the Frederick Property) because 5 homes may be built. (Copy attached) Chairman Savino read his Memorandum dated 8/25/86 to the Town Commission re "Performance Bond Policy." (Copy attached) Much discussion ensued regarding the "Performance Bond Policy. " The C.A.B. has not received a reply from the Town Attorney regarding the question of 0 if a fine and the amount of a fine can be charged a developer in a performance bond and the size of the bond . Until an answer is received from the Town Attorney, the members felt their work is at a standstill A COMMUNITY APPEARANCE BOARD Regular Meeting - Minutes August 28, 1986 Page 2 of 2 9.0 regarding performance bonds Vice Chairman Galizia stated that the C.A.B. should wait for an official ruling from the Town Attorney. The members felt that the amount of a performance bond should be large enough to get the work done as the C.A.B. requests it and large enough to encourage the developer to do the work within a named time limit, not forfeiting the bond money too easily, which would be the case if the bond money was not high enough. Further discussion determined that the Code Enforcement Board does cooperate in enforcement and that Code Enforcement Officer Tony Abbate does give citations, when warranted , for dead trees, etc . The Inspecting Officer for September will be Louise Johnson (to 9/26/86) . A. Keller is Inspecting Officer for Oct. Guy Galizia will be the Inspecting Officer from 9/26 to 9/30/86. Chairman Savino announced that the next meeting will be held on September 25, 1986 at 9: 30 a .m. The Agenda closes on September 10, 1986. MOTION was made by Helene Harris, seconded by Guy Galizia, to adjourn the Regular Meeting of the Community Appearance Board. All members voted AYE. Abbate FROM: Community Appearance Board DATE: August 25, 1986 RE: 2355 South Ocean Boulevard Highland Beach, Florida. As per your request, an inspection was made on the above mentioned property (Lots 133 thru 137) by Arthur Keller and Frank Savino, members of the Community Appearance Board. Our observation and recommendation are that the old Palm Trees on the site should be saved and relocated on the property. Seagrape at dune vegetation line should be preserved; it requires pruning and trimming to create opening. This should be done by experts in the field of pruning. Australian Pines could be removed if in way of construction. i Frank Savino, Chairman FS/amk S et TO: MAYOR EDWARD SULLIVAN AND THE TOWN COMMISSION FROM: THE COMMUNITY APPEARANCE BOARD DATE: AUGUST 25, 1986 RE: PERFORMANCE BOND POLICY Attached is copy of Policy which the Community Appearance Board wishes to adopt and enforce. The Community Appear- ance Board would like an opinion from Town Attorney Sliney regarding the aspect of such Policy. The Community Appearance Board concluded such Policy is necessary, due to the following: EDGEWATER TOWNHOUSES - A bond of $200. was requested by the C.A.B. subject to our recom- mendation of a c/o pending work to satisfy compliance to plan. Compliance was never met. RESSLER'S TRIPLEX - A bond of $500. was re- quested by C.A.B. for replacement of three dead Palm Trees subject to a recommendation of a c/o. Compliance was never met. CASUARINA - A bond of $3,000. was requested by the C.A.B. subject to recommendation of a c/o at a Special Meeting requested by the developer with a stipulation to replace trees after sixty (60) days that are determined to be dead. After six (6) months, this matter is still pending. Frank Savino, Chairman FS/amk cc: Town Manager t '; fl MEMORANDUM TO: COMMUNITY APPEARANCE BOARD MEMBERS FROM: FRANK SAVINO, CHAIRMAN DATE: MAY 29, 1986 RE: PERFORMANCE BONDS When a bond is requested from a developer by the Community Appearance Board because in their judgement the landscape material planted on the site will not survive or material planted does not comply with plans, a time period of not more than sixty (60) days will be given to the developer to make the necessary corrections . Upon the expiration of the time period, the Community Appearance Board Members will make an on site inspection. If members find that the developer has complied, the bond will be returned. However, if the Community Appearance Board Members find there is no compliance, the bond will be forfeited. FS/amk cc: Town Manager n
