1986.09.25_CAB_Minutes_Regular tie 1 TOWN OF HIGHLAND BEACH, FLORIDA 90 COMMUNITY APPEARANCE BOARD REGULAR MEETING - MINUTES SEPTEMBER 25, 1986 9: 30 A.M. Chairman F. Savino called the Regular Meeting of the Community Appearance Board, Town of Highland Beach, to order at 9: 35 A.M. in the Commission Chambers at Town Hall . The Recording Secretary called the roll . Present were Chairman F. Savino , Vice Chairman G. Galizia, L. Johnson, A. R. Keller , H. Harris and M. J. Dempsey (alt. ) . Also present were W. McGee of American Wood Fence, Inc . , Attorney M. Shumaker representing applicant J. Johnson (agent for property owner Dr . A. Q. Jarrett) , Recording Secretary A. M. Kowals and Highland Beach Residents H. Levy and S. Docktor . When Chairman Savino inquired if there were any corrections, additions or deletions to the August 28, 1986, Community Appearance Board Minutes, Vice Chairman Galizia stated a correction was in order on page 2 (delete "since Arthur Keller will be out of Town" - include "A. Keller is Inspecting Officer for October") . 5 Following a brief discussion , H. Harris made a MOTION, seconded by G. Galizia, to accept and approve the Minutes of the August 28, 1986 Regular Meeting of the Community Appearance Board as corrected. All members were in favor of the MOTION. NEW BUSINESS APPLICATION FOR FENCE PERMIT SUBMITTED BY AGENT J. JOHNSON (FOR OWNER DR. A. Q. JARRETT) , 1100 HIGHLAND BEACH DRIVE (LOT 15, BLOCK 2, BEL LIDO) . REPRESENTING APPLICANT WERE ATTORNEY M. SHUMAKER AND W. McGEE OF AMERICAN WOOD FENCE, INC. Chairman Savino advised the first item on the agenda is an application for fence review submitted by Agent J. Johnson for Owner Dr . A. Q. Jarrett, 1100 Highland Beach Drive. Addressing the board, H. Levy and S . Docktor stated they reside at 1102 Highland Beach Drive (adjacent to Dr . Jarrett' s property) and they object to the construction of the fence. Mr . McGee explained the proposed 6 ' wooden stockade fence extends to the side property and runs to the seawall along the South lot line. The last post will be planted on the grass area with the fence extending over the seawall . S 6. AA COMMUNITY APPEARANCE BOARD 144. Regular Meeting t September 25, 1986 Page 2 of 4 The fence, continued Mr . McGee, will be erected North of the existing hedge; it will provide more privacy. When Chairman Savino stated the hedge is 6 ' high , Mr . McGee said it was that high at one time; but, it was cut down by a neighbor when the Johnsons were away. During the discussion regarding maintenance of the existing hedge, members were informed by Mr . McGee that Mr . Johnson will take care of the hedge. Mr . Levy stated that due to the animosity between the property owners (the Wunderlichs and the Johnsons) it would be impossible for the Johnsons to maintain the hedge without trespassing on the neighbor ' s property. Mr . Keller said the Community Appearance Board represents the Town ; and , if there is conflict between neighbors, it is of no concern to the Board; the members want to make certain the Town rules are observed . Attorney Shumaker advised the Board that the Johnson ' s are constructing the fence for safety, security and privacy at the pool located in the rear yard . Maintenance of the fence is non-existent, said Attorney Shumaker , as the fence will be constructed of cypress wood. eTh Mr . McGee added the natural cypress wood has a life span of 8/14 years and requires no stain or paint; the posts have a 25 year life span . The finished side of the fence will face the Johnson property, continued Mr . McGee, with all work being done on the applicant ' s property. When Vice Chairman Galizia , after mentioning the hedge is lower at a point closest to the Intracoastal , asked if the fence could be lowered at that point , Attorney Shumaker replied that would be difficult due to the problem with the neighbor . Mr . Levy stated the drawing indicated the fence is to be constructed on the property line which would prohibit maintenance without trespassing . The fence , continued Mr . Levy, should be moved further North. Mr . Keller said the Board will define the problem and come up with an answer . The 6 ' fence may be constructed on the property with access to maintain same on both sides . Upon questioning , Mr . McGee informed the members that he can install the fence next to the existing Palm Trees without any difficulty. If the fence is not properly maintained , said Mr . Keller , neighbors should complain to the proper authority. Following much discussion , members requested Mr . McGee change the drawing ImN, to indicate the fence will be moved inward to allow room for maintenance; an 18" space between the property line and fence will provide the necessary access for cutting the hedge and maintaining the proposed construction . Attorney Shumaker stated his client will have no problem with the Community Appearance Board ' s request. Mr . Keller made the following MOTION: The Community Appearance Board , in the case of the fence pro- posed by Dr . A. Q. Jarrett on application dated 9-4-86, moves that the wooden fence as described on Drawing No . C-1 and Sketch No. X-2 be approved with following changes: 1. No construction whatsoever be permitted on the seawall proper . 2. The wooden fence to be located a minimum of 18" North of the property line to permit fence maintenance on both sides, plus hedge maintenance. Mrs. Johnson seconded the MOTION. A roll call vote resulted as follows: Mr . Galizia aye ' Mrs. Harris aye' Mrs. Johnson ' aye' Mr . Keller ' aye' Mr . Savino 'aye' The MOTION carried unanimously. Chairman Savino informed the members that the "Performance Bond" issue was discussed at the Town Commission Workshop Meeting on September 23, 1986. A policy will be drafted by the Town Attorney and Town Manager . Mrs. Johnson reported the speed limit and Fire Department signs on the East side of A-1-A are obstructed from view by overgrown trees. These signs are positioned just a little South of Town Hall . The Town signs at the North and South end of Highland Beach, said Mrs. Johnson, are in need of better floral display and maintenance. Chairman Savino said the Town Manager will be advised of Mrs. Johnson' s comments. Vice Chairman Galizia stated Commissioner Stewart has proposed Highland Beach make the Greening of A-1-A historic to prevent destruction of the trees. NEW BUSINESS 0 The next Regular Meeting of the Community Appearance Board was set for October 30, 1986 at 9: 30 A.M. , with the agenda for this meeting closing on October 15, 1986, at noon . Chairman Savino said the members should entertain the idea of a new chairman. The members briefly discussed the newspaper racks in the Town of Highland Beach. Chairman Savino said newspapers are available at the Holiday Inn . As there were no further items for discussion, H. Harris made a MOTION, seconded by A. Keller, to adjourn the meeting .
