1986.10.30_CAB_Minutes_Regular • TOWN OF HIGHLAND BEACH, FLORIDA T1 COMMUNITY APPEARANCE BOARD REGULAR MEETING - MINUTES OCTOBER 30 , 1986 9: 30 A.M. Chairman F. Savino called the Regular Meeting of the Community Appearance Board , Town of Highland Beach, Florida , to order at 9: 30 A.M. in the Commission Chambers at Town Hall . The Recording Secretary called the roll . Present were Chairman F. Savino , Vice Chairman G. Galizia, L. Johnson, A. R. Keller , H. Harris, H. C. Arnold (alt . ) and M. J . Dempsey (alt. ) . Also present were Town Clerk M. A. Mariano and Recording Secretary A. M. Kowals. Following a brief discussion, H. Harris made a MOTION, seconded by G . Galizia to accept and approve the Minutes of the September 25, 1986, Regular Meeting of the Community Appearance Board . All members were in favor of the MOTION. The first agenda item, said Chairman Savino, is a discussion regarding construction trailers. eConstruction trailers were discussed at the Town Commission Workshop Meeting on October 23, stated Chairman Savino . Code Enforcement Officer A. Abbate , said Chairman Savino , issued a warning to Highlands Place because their construction trailer , placed on the West side of A-1-A was in violation of the Town Ordinance. Chairman Savino explained the initial construction trailer at the Highlands Place project (East side of A-1-A) was set on the West side of the construction fence which caused it to be visible from A-1-A. At the re- quest of the Community Appearance Board , said trailer was placed behind the construction fence , said Chairman Savino . In discussing the matter with Building Official Sutherland , members were advised that a construction trailer is necessary at a construction site and a permit for such trailer must be obtained from the Building Department . The fee for said permit is $100. for a period of no more than six months. A construction trailer can not stand for more than two years unless approval is granted by the Town Commission. The Community Appearance Board Members received a copy of Chapter 30, Section 5. 6 (page 30-19) "Temporary Structures" which states Community Appearance Board approval is required for construction trailers . Chairman Savino said Highlands Place never came before the Board for approval of the construction trailer that was set on the West side of f1-1-A ; but, they did request and receive Community Appearance Board approval for the construction trailer that was placed at the project site on the East side of A-1-A . Harris said the Boca Hi Sales Office is a temporary structure which falls under the perimeter of Chapter 30, Section 5. 6 and should not be sitting at that site. When Mr . Arnold asked what happened to the Code Enforcement Board , Chairman Savino said when a violation is called to the attention of Code Enforcement Officer Abbate, he does what is necessary (he issues a warning or a citation) . The Town , said Mr . Keller , is handling the matter . When Mr . Keller inquired of Mrs. Harris if the Town approved the structure at the Boca Hi site, Mrs . Harris stated the temporary structure is being used by the Center Board for meetings and Mr . Delaney and his secretary are still in the building; it has been up for more than two years and the Town should put a stop to that. Town Clerk Mariano informed the members there is no permit for that structure; the Town Manager and Town Commission feel it should not be there and they are trying to eliminate it . This matter was discussed at the Town Commission Workshop Meeting and it will be an agenda item for their Regular Meeting on November 5, 1986, continued Mrs. Mariano . When members questioned if there is a fine for violation of this ordinance , the Town Clerk said the Code Enforcement Officer issues a violation notice hich is then handled by the Code Enforcement Board . A violation notice , continued Town Clerk Mariano, is like a summons. The Code Enforcement Board holds a hearing and may levy a fine for non-compliance. Vice Chairman Galizia said the copy of the ordinance distributed to the members covers what the Community Appearance Board is concerned with--a site plan review and Community Appearance Board approval are required for construction trailers. Town Clerk Mariano advised the members that the Agenda Action Report is prepared the morning after the Town Commission Meetings and lists what the Commission is working on so all Boards know what is going on in Town . Members discussed at length the printed matter distributed by Commissioner Stewart concerning the proper way to prune trees. They also discussed the need to replace any destroyed and damaged trees in Highland Beach. It was agreed the Board should have some policy regarding pruning for all to follow. Tree pruning which is altering branches of a tree requires an expert who knows what he is doing , stated Chairman Savino . Mr . Keller mentioned the Towns of Hollywood and Fort Lauderdale require that all tree maintenance adhere to the National Arborists Association Standards which emphasizes that tree removal is to be undertaken by a person who adheres to these standards. rTh COMMUNITY APPEARANCE BOARD (!) � Regular Meeting l ' October 30, 1986 Page 3 of 4 Town Clerk Mariano informed the Board that contractors (companies) working in Highland Beach are required to obtain an Occupational License from the Building Department . The Community Appearance Board can make a provision regarding adherence to the National Arborists Association Standards so when a license is issued , the parties are put on notice that they have to follow the National Arborists Association rules. Chairman Savino said the members should make some policy for the Community Appearance Board that would require pruning be done according to the National Arborists Association rules . This should be looked into at the next meeting , stated Mr . Savino. In a discussion regarding trees on a new development site, Chairman Savino said all trees should be protected or relocated so as not to be destroyed . During construction , often times machinery will damage trees to the point of destruction . Chairman Savino said there should be an agreement between the Town and the developer to assure that a similar tree of same value will be planted at that particular project . If a tree is in the way of construction, stated Chairman Savino , it should be transplanted elsewhere. Perhaps, a perform- ance bond might be in order , continued the Chairman . sR Members discussed the Town Manager ' s memorandum relating to the Town lAttorney' s draft of the "AGREEMENT REGARDING PAYMENT AND PERFORMANCE SECURITY". It was agreed by all the members the draft should be amended to read as follows : The undersigned expressly understands, agrees, and covenants that as a condition precedent to the issuance of a Certificate of Occupancy by the Building Department of the Town of Highland Beach, the developer of a project in the Town shall cause to have issued a cashier ' s or certified check drawn on and issued by a banking insti- tution located in Palm Beach County. Said check shall be in an amount not less than two hundred percent (200%) of the total antici- pated cost of any remaining work to be performed on the proposed development as specified by the Community Appearance Board . This check shall be made payable to the Town of Highland Beach and de- posited in a designated account by the Town of Highland Beach. Developer shall have sixty (60) days after the Town of Highland Beach Community Appearance Board has recommended approval of the development ' s Certificate of Occupancy to complete all aforemen- tioned remaining work. In the event that the developer has not properly performed the remaining work , the Community Appearance Board shall recommend that the Town Manager shall cause the subject work to be performed using the proceeds of the security funds. The remainder of the proceeds shall be forfeited by the developer . • COMMUNITY APPEARANCE BOARD Regular Meeting r% October 30, 1986 Page 4 of 4 Upon the determination of the Community Appearance Board that the work has been properly performed by the developer , the Town shall relinquish any claim of ownership to the security funds. IN WITNESS WHEREOF, the undersigned has executed this Agreement on , 19 APPROVED: Developer Town of Highland Beach Members discussed the Enclaves of Boca Cove . Chairman Savino said a performance bond of $3, 000. was posted by the Enclaves of Boca Cove . The Community Appearance Board granted them a thirty (30) day time-frame for compliance. Members will have to make an inspection to determine if the work was completed in compliance with the approved plans, continued Chair- man Savino. The members briefly discussed the need for covering of newspaper and !magazine racks. Town Clerk Mariano advised the Board that a ' News Rack Ordinance' is before the Town Commission; they are working on it. Chairman Savino said members should undertake the election of new officers at the November Meeting . This will be an agenda item for that meeting. Mrs. Harris, at this time, said she wanted to commend the Planning Board for their time and efforts regarding the lowering of density in the Town of Highland Beach. Chairman Savino scheduled the next Regular Meeting of the Community Appear- ance Board on Thursday, November 20, 1986, at 9: 30 A.M. with the agenda closing on Wednesday, November 5, 1986, at noon . The inspecting member for the month of November is Chairman Savino . Mr . Keller made a MOTION, seconded by Mrs . Johnson, to adjourn the meeting.
