REGULAR MEETING - MINUTES

Thursday, July 30, 1987 9: 30 A. M.
A Regular Meeting of the Community Appearance Board was called to order
by Chairman Helene Harris at 9: 30 a. m. in the Town Commission Chambers
at Town Hall .
The Recording Secretary called the roll . Present were Chairman Helene
Harris, Vice Chairman Guy J. Galizia, Frank Savino, Arthur Keller , and
Martha J. Dempsey (Alternate Member) , sitting as a Regular Member in
the absence of Regular Member Louise Johnson. Alternate Member H. C.
Arnold was absent.
Also present was Deputy Town Clerk/Recording Secretary Elizabeth Kolek.
MOTION was made by Mr . Keller/Mr . Savino to approve the minutes of the
June 25, 1987 Regular Meeting , as submitted . The MOTION carried
unanimously with favorable votes.
MOTION was made by Mr . Keller/Mr . Savino to approve the minutes of the
July 1, 1987 Special Meeting that deals specifically with St. Lucy' s
Church, as submitted . The MOTION carried unanimously with favorable
votes.
f l OLD BUSINESS
Vice Chairman Guy Galizia proceeded to clairify the last paragraph in
the June 25 Minutes, due to the absence of Chairman Harris and Alt.
Member Martha Dempsey, in that he felt the last sentence was ambiguous
and not necessary, but after discussion, the Board felt the sentence
was necessary. Chairman Harris read excerpts form the CAB Memo to and
from Building Official Sutherland, relating to the issuance of a C/O
for St. Lucy' s Church, which Chairman Harris felt the Building Official
had intended to issue the C/O, with or without the recommendation from
the C.A.B. The Board Members felt that the Building Official ' s action ,
in granting the C/O for the St. Lucy' s Church property, usurped any
power or influence that the C.A.B. had , as an advisory board to the
Town Commission. Extensive discussion ensued and it was the consensus
of the members that a Memorandum be sent to Building Official
Sutherland (with a copy to the Mayor and Town Manager) , in order that
it be "on record" , that the Community Appearance Board ' s opininion is
that the Board feels his issuance of a C/O for St. Lucy' s Church
project is contrary to the Town' s Building Code in that the project did
not conform to the Code because the hedge does not screen the parking
lot and felt that the Building Official disregarded the Town Code by
which he is governed . (Town Zoning Code, Chapter 30, Section 5.8 (b) ) .

It was again discussed that the C.A.B. could not make an on-site
inspection at St. Lucy' s project because there never were any approved

plans for Phase II . Chairman Harris cited a similar situation
involving landscaping at St. Lucy' s in 1975 and felt this was a
continuation of the same disregard for the Town Code.
Mr . Savino stated that he met with Developer Bob Roepnick' s
representative for an on-site inspection of the landscaping at the
Casuarina Condominium during the week of July 20 and is now satisfied
that the landscaping is in good order .
MOTION was made by Frank Savino, seconded by Guy Galizia, to return the
Bond Money ($3,000. 00) held in escrow to the Casuarina Developer . The
MOTION carried unanimously with a roll call vote of 5-0.
The repainting and landscaping at Lift Station No . 1 , in the North end
of Town, was discussed and Mangus Nursery, per Mr . Turner , was
commended by the C.A.B. members on a beautiful job of landscaping ,
which the neighbors were also pleased with. The painting was completed
by the Town Utility Department staff, using a soft shade of green for
the building , as recommended by the C.A.B.
Xeriscape landscaping , a new concept in landscaping which uses minimal
water , was discussed. Examples of xeriscape is presently in the
Florida Keys and at Burdines (Town Center Mall) . The consensus of the
OMS C.A.B. was that since it conserves water , maintenance, and is very nice
and effective where it is presently used , though the initial plantings
may not be inexpensive (estimated close to $25,000) to landscape around
the Town Hall , the Town should proceed as an example for the rest of
the Town.
Frank Savino gave a report on the request for an outside contractor to
prune some of the overgrown trees planted by the Greening of A-1-A
Committee along South Ocean Boulevard. He successfully met with one of
four companies that do pruning because the three others contacted
showed no interest (Ryan Tree Service, Mike Zimmerman, and Top Notch
Tree Service) . The quote of $650. 00 was received from Bill Malkames of
Sun Service for one days work, with 3 men and machinery. After
discussion , it was the consensus of the C.A.B. members that Mr . Savino
would write a Memorandum to the Town Manager to request a Purchase
Order for $650 for the pruning of the Town' s trees along A-1-A, to come
from the balance (approximately $900) still in the Greening Committee' s
budget for the current fiscal year .
NEW BUSINESS
Vice Chairman Galizia and the members discussed commending property
owners in Town who do outstanding landscaping, i .e. , Edgewater
Townhouses, Villa Magna (West Side) , and the Coronado . It was the
consensus of the members that Chairman Harris will compose a form
letter which can be used for this purpose, upon approval by the Town
Commission .

The new Sign Ordinance was discussed (Section 23-7, H (1) , in that the
size of the pendant attached to temporary signs was incorrectly
specified as three square feet, when in reality it should have stated
the allowable size as the width of the sign and no more than six inches
in height, as specified in other sections of the ordinance. The Board
Members felt that it' s allowable size (same as the pendant for a
permanent sign) should be specified in this Ordinance. The members
also felt that house numbers, their size and safety factor requirement,
should be included in the sign ordinance. Mr . Savino feels a
requirement should be made by the C.A.B. that all dwellings must have a
readily visible (from a distance) address number sign and felt it was
very important to address this issue, including enforcement. Chairman
Harris stated that all dwellings should be in conformance and none
should be "grand-fathered" in and be allowed to ignore the ordinance .
Chairman Harris stated that the next Regular Meeting will be held on
Thursday, August 27, 1987 at 9: 30 a .m. , with the Agenda closing on
August 12.
The inspector for the month of August is Arthur Keller .
There being no further business to discuss, MOTION was made by Frank
Savino, seconded by Guy Galizia, to adjourn the meeting at 10: 45 a .m.
All members voted Aye.

TO: BRUCE SUTHERLAND, BUILDING OFFICIAL

SUBJECT: C/0 - ST. LUCY 'S CHURCH
The Community Appearance Board would like to go on record
regarding the issuance of the Certificate of Occupancy for the
St . Lucy Church Project by Building Official Bruce Sutherland that
this C/O was issued without any approval by the C.A.B. and feels
it is contrary to the Town ' s Building Code in that the project did
not conform to the Code because the hedge does not adequately
screen the parking lot. The Board Members feel that the Building
Official disregarded the Town Code by which he is governed . (Town
Zoning Code, Chapoter 30, Section 5. 8 (b) )
