1989.08.31_CAB_Minutes_Regular • TOWN OF HIGHLAND BEACH n COMMUNITY APPEARANCE BOARD REGULAR MEETING - MINUTES Thursday, August 31 , 1989 9: 30 A.M. Co-Chairman Guy Galizia called to order the Regular Meeting of the Community Appearance Board of the Town of Highland Beach , Florida , at 9: 30 A.M. in the Commission Chambers at Town Hall . The Deputy Town Clerk called the roll . Present were Co-Chairman Guy Galizia and Frank Savino , Regular Members Reginald Towner and Paul Heetman , and Alternate Member Merton Rubin . Regular Member John Littlejohn was absent . Also present were Building Official Harry Heithaus, Deputy Town Clerk Doris Trinley and members of the general public . A MOTION was made by Mr . Towner/Mr . Savino to approve the minutes of the Regular Meeting of July 27 , 1989 as amended , to be ready for signa- ture at the next Regular Meeting . All members voted AYE. NEW BUSINESS : Final Review for Awnings, 2 ' Planter Wall , 4 ' Aluminum Rail . 2342 South Ocean Boulevard , Lot 137 West-2. Ince & Hertel (Owner/Builder) . In addressing the Board , Peter Ince stated that the plans to be reviewed had to do with the "Old Fredericks House," which is being remodeled . Mr . Galizia questioned a landscaping plan that had been included and a discussion ensued as to why same had been presented at today' s meeting . Mr . Ince replied that not requesting landscaping approval be put on today' s agenda had been an oversight on his part and asked if the Board could consider those plans at this time, since landscaping had been limited to "moving" and "re-planting" only. However , it was the CONSENSUS of the Board that only those items set for review at today' s meeting could be considered for approval ; therefore , landscaping plans would have to be submitted for consideration at a future meeting . Mr . Ince then presented a sample of the 4 ' railing to be installed , noting that while the existing railing is bronze, it would be painted white to match the sample . Mr . Savino asked about the structure of the railing and Mr . Ince replied that it was the welded type, with only the cap being removable for repairs . Mr . Galizia asked if any of the work being done on this house might require Planning Board approval . Building Official Harry Heithaus answered that everything on site had been approved by the Town Commission as part of a settlement agreement . Mr . Savino asked Mr . Ince about Lot 137 West-1 , where a structure had been demolished . Mr . Ince said that there are no plans for the lot at this time , except for a wall that had previously been approved by the Board members . After further discussion , a MOTION was made by Mr . Towner/Mr . Savino to approve awnings, 2 ' planter wall and 4 ' aluminum rail as shown on drawing dated 7/25/89 , Sheet 1 of 1 at 2342 South Ocean Boulevard , Lot 137 West-2, submitted by Ince & Hertel (Owner/Builder) . A Roll Call voted resulted as follows : Mr . Savino AYE Mr . Galizia AYE Mr . Towner AYE Mr . Heetman AYE Mr . Rubin AYE Final Review for Permanent Sign , 3101 South Ocean Boulevard , Lots 104- 105 E, Penthouse Towers , Submitted by Delray Signs. Mark Gregory of Delray Signs addressed the Board , explaining that the height of the proposed sign was 4 '6" and the sign itself measured /1 20" x 6 ' . Mr . Galizia suggested that these measurements would seem to be out of proportion . Mr . Gregory replied that "Penthouse Towers" is a rather lengthy name for purposes of signage and that the design was chosen because of its "low profile" appeal . He added that this type of design will also lend itself itself to full and lush landscaping . Mr . Heetman questioned if the measurements were in keeping with Town Code and , upon checking the Code , the Building Official confirmed that the measurements were within limits . After further discussion , a MOTION was made by Mr . Savino/Mr . Towner to approve the plans dated 8/3/89 as submitted by Delray Signs for a permanent sign to be constructed by Delray Signs at 3101 South Ocean Boulevard , Penthouse Towers, Lots 104-105 E. A Roll Call vote resulted as follows : Mr . Galizia AYE Mr . Savino AYE Mr . Towner AYE Mr . Heetman AYE Mr . Rubin AYE At this time the Board members recognized Ms . Yvonne Petritz, who stated that she was interested in serving on the CAB. It was ascer- tained that her application was on file . When asked by Mr . Savino rabout her qualifications , Ms . Petritz said she had served on this type Town of Highland Beach flCommunity Appearance Board Regular Meeting - Minutes Page 3 of 4 of board when she lived in Chicago , as well as currently in a similar capacity at the Regency Highland , which is her residence . The members thanked her for her interest and Mr . Savino explained that the Town commission appoints board members . OLD BUSINESS: The members discussed the status of an insurance claim regarding a tree that was knocked down and destroyed by a motorist on July 11, 1989 at 2909 South Ocean Boulevard (Wiltshire House) . Mr . Galizia noted that the motorist was insured and that the Town Manager had written a letter to the motorist' s insurance company requesting monies to replace the tree, but no word had been received to date. Mr . Savino suggested that either the Town Manager or Police Department follow up on this matter and Mr . Towner said he would write to the Town Manager requesting this be done . Regarding this matter and other trees that had been destroyed , Mr . Heetman asked if there was an ordinance mandating the replacement of same by the responsible party (s) . The Building Official replied that the Town has an ordinance which states only that if a tree dies, it must be removed . C) GREENING COMMITTEE: Mr . Savino advised that all trees planted by the Greening Committee will be classified as historical and there will be a ruling forthcoming from the Town Commission as to who can trim these trees. Further , Mr . Savino noted that all plaques had been removed from donated trees and the new system of identifying them (PVC pipe with plaque attached) was in place. He said that he has received good feed- back regarding this new method from many Town residents. GENERAL: Mr . Galizia questioned Mr . Heithaus if a permit was required for the repairs being done on the waterfall in front of Villa Nova (3505 South Ocean Boulevard) and the Building Official advised that no permit is required if the cost of maintenance or general upkeep of a property is less than $5, 000 . Since no permit had been applied for , Mr . Heithaus felt this was the case. Next, the members discussed Mr . Towner' s suggestion of standardized For Sale/For Rent signs. Mr . Rubin offered that while Mr . Towner ' s idea was a good one theoretically, he agreed with Mr . Heetman that it would be a difficult situation to control . Mr . Galizia noted that at present, Town Code deals with the size of signs only. Mr . Savino reminded the members that the application was unsuccessfully tried with nnewspaper machines . The Building Official suggested that the Town Attorney be asked about the legality of such an approach. Town of Highland Beach fpCommunity Appearance Board Regular Meeting - Minutes Page 4 of 4 Mr . Galizia asked the Building Official about the construction going on at 2908 South Ocean Boulevard , Lots 110-111 West (DiRenzo property) , stating he had had several inquiries as to whether one or two buildings are under construction . Mr . Heithaus assured that the "second" struc- ture, which is attached to the main house via covered walkway, is for maid' s quarters only (changed from a gazebo) and that a permit had been given for same . He further stated that the builder had gone before all necessary boards and that this construction is classified as single- family. Mr . Galizia noted that John Littlejohn would be inspector for the month of September , 1989 and that the next regular CAB meeting would be held on Thursday, September 28 , 1989. There being no further business to come before the Board , the meeting was adjourned by Mr . Savino/Mr .
