1990.04.26_CAB_Minutes_Regular • TOWN OF HIGHLAND BEACH COMMUNITY APPEARANCE BOARD REGULAR MEETING - MINUTES Thursday, April 26, 1990 9: 30 A.M. The Regular Meeting of the Community Appearance Board was called to or- der by Co-Chairman Guy Galizia in Commission Chambers at 9: 30 A.M. Deputy Town Clerk Doris Trinley called the roll . Present were Co- Chairman Galizia, Co-Chairman Frank Savino, Regular Members John W. Littlejohn and Paul Heetmann and Alternate Members Doris Perrone and Yvonne Petritz . Also present were Building Official Harry Heithaus and members of the general public . Upon MOTION by Mr . Savino/Mr . Heetmann , the minutes of the Regular Meeting of January 22, 1990 and the Special Meeting of March 12, 1990 were approved unanimously. NEW BUSINESS 0 FINAL REVIEW FOR SINGLE FAMILY RESIDENCE AT 4301 S. OCEAN BLVD. , LOT 30E, SUBMITTED BY ALLAN LANDSMAN/OWNER (BOCA BEACH HOMES) Along with project architect Don Zimmer , Bernard Turner of Mangus Nur- series joined the members at the table to review the plans. Starting his presentation, Mr . Turner told the members that re-location of nine (9) coconut palms would take place and a tenth would be added . If con- struction interferes with the palms as they are now situated , Mr . Turner advised that they will be moved to a nursery until ready for re- planting . In reply to Mr . Savino' s question , Mr . Turner said that if any of the palms do not survive should they have to be moved to a nursery, then they will be replaced. However , he added that if this does happen, smaller trees might have to be utilized , as the palms in question are mature and to duplicate their size would probably not be possible. Further discussion ensued regarding the various plantings to be used , which will include, among others, green and silver buttonwood and sabal palm. Seagrapes will also be used to tie into dune plantings. Mrs. Perrone asked if in fact the Board today was reviewing only the landscaping west of the CCCL and Mr . Turner replied affirmatively, saying that the DNR would have to approve everything east of the CCCL. Building Official Harry Heithaus added that unless the project was given approval by the CAB, then the DNR would not consider approval . The members then reviewed the irrigation system and found it to be in compliance. However , the exterior lighting plan generated a discussion as to whether the kind of lighting proposed met Code requirements. Community Appearance Board 911, Regular Meeting - Minutes April 26, 1990 Page 2 of 4 Mr . Turner stated that the lighting would employ glare guards and would be low voltage . Mr . Savino expressed concern that it would allow tree canopies to be too brightly lighted and create what Mr . Galizia re- ferred to as a commercial effect. The members also questioned that portion of lighting which would affect the dune area . Mr . Turner re- plied that he was aware this would have to have DNR approval also . He added that a separate switch would be installed for this portion to accommodate turtle season (May 1 through October 31) . After some further discussion, a MOTION was made by Mr . Savino/ Mr . Heetmann to approve the landscaping for a single family residence to be built at 4301 S. Ocean Blvd . , Lot 30E, Job. No . T90-0309 dated 3/9/90, Sheets 1 and 3. Sheet 2 of the plans is not approved until on- site inspections regarding lighting of similar recently built resi- dences are made by Mr . Savino, since Mr . Turner advised that this pro- ject will employ the same approach to outdoor lighting . A roll call vote resulted as follows : Mr . Heetmann AYE Mr . Littlejohn AYE Mr . Galizia AYE Mr . Savino AYE FINAL REVIEW FOR POOL FENCE AT 3009 S. OCEAN BLVD. , LOT 107 (OCEAN PINES CONDOMINIUM) SUBMITTED BY A & A FENCE CO. Ken Andrews, Ocean Pines Manager , joined the members to review plans for the pool fence, which is required by their insurance carrier , and advised the members that no representative of A & A Fence Co . would be attending this review. Mr . Savino said that he would prefer a repre- sentative to be present so that pertinent questions as to type of hard- ware, spacing between uprights, etc . , could be answered . Mr . Andrews replied that he planned to work closely with the installers and had re- quested that the fence be anchored in 36" of concrete and have stain- less steel hardware, as well as only 4" between uprights. At this point, the Building Official presented the members with a sample of the fence, which had been furnished by A & A Fence Co. Dis- cussion continued and Mr . Andrews informed the members that the pro- posed installation would be 48" high and made of bronze extruded alumi- num A MOTION was then made by Mr . Littlejohn/Mr . Savino to approve plans for a pool fence for property located at 3009 S. Heetmann AYE Mr . Littlejohn AYE Mr . Galizia AYE Mr . Savino AYE OLD BUSINESS: Mr . Galizia directed the members attention to the use of "Private Property" signs on beach properties and during discussion the members agreed that trespassing on these properties is sometimes difficult to control . Mr . Galizia informed the Board that he had been advised by the Police Department that a citation to trespassers can only be issued if a "No Trespassing" designation is included with a "Private Property" sign . Regarding the Special Meeting which was held on January 15, 1990 where- in Gary Gordon received a Certificate of Occupancy for property located at 1125 Bel Air Drive, with the proviso that the property would be re- inspected in 60 days, Mr . Savino advised that re-inspection had been done with Mrs. Gordon present . He said that the landscaping was found to be in compliance and , therefore , the Building Official had been re- quested in writing to return Mr . Gordon' s $900 escrow check. A short discussion took place regarding the Regular Member vacancy that exists on the Board due to Reginald Towner ' s resignation . Although recognizing that the Town Commission will make this appointment, Alternate Member Doris Perrone met with favorable support among the members. GREENING COMMITTEE Mr . Savino asked Alternate Yvonne Petritz if she would take over the responsibility of sending formal letters of appreciation to those who make tree donations and she replied affirmatively. Mr . Galizia asked if the tree which was destroyed in front of Wiltshire House at 2909 S. Ocean Boulevard , and for which insurance monies were received , had been replaced. Mr . Savino replied that it had not, but some trees were expected shortly and replacement would be made . OTHER The members next discussed Section 9-12. 1 of Town Code (Satellite Tele- vision Antenna Systems) . Savino/ Mr . Heetmann as follows : " (7) All satellite dishes installed in the Town of Highland Beach must be screened from pub- lic view along A-1-A." A roll call vote resulted as follows : Mr . Heetmann AYE Mr . Littlejohn AYE Mr . Galizia AYE Mr . Savino AYE It was then announced that the next meeting is scheduled for May 31 at 9: 30 A.M. , with the agenda closing on May 16. Mr . Heetmann was named inspector for the month of May. There being no further business to come before the Board at this time, the meeting was adjourned upon MOTION by Mr . Littlejohn/Mr .
