1991.01.03_CAB_Minutes_Special TOWN OF HIGHLAND BEACH COMMUNITY APPEARANCE BOARD SPECIAL MEETING - MINUTES Thursday, January 3, 1991 1: 30 P.M. Co-Chairman Guy Galizia called this Special Meeting of the Community Appearance Board to order in Commission Chambers at 1: 30 P.M. Deputy Town Clerk Doris Trinley called the roll . Present were Mr . Galizia, Co-Chairman Frank Savino and Regular Member Paul Heetmann . Regular Members Doris Perrone and John Littlejohn were absent. Also present were Building Official Harry Heithaus and Mark Rothenberg of Highland Park Development. Mr . Galizia stated this meeting was being held to consider a recommen- dation for a Certificate of Occupancy regarding a Sales Trailer located on property at 3425 South Ocean Boulevard , Lot 90E, owned by Highland Park Development . Mr . Savino then advised that he, Mr . Galizia and Mr . Heetmann had in- spected the project on January 2, 1991 and read their findings into the record, i .e. , the landscaping on the site was found to be satisfactory, with the exception of five (5) live oak trees which were in poor condi- tion . Mr . Savino said the landscaper had advised these trees were in shock from transplanting; however , if any or all of them did not sur- vive, the landscape company would replace with other live oaks. In this regard, Mr . Savino advised that the trees would be re-inspected in 30 days; if indeed any of them had not survived , they would have to be replaced . Also, Mr . Savino advised Mr . Rothenberg that it would be necessary for him to submit a $1, 000 check ($200 per tree) to be held in escrow until re-inspection had been completed. Mr . Rothenberg then identified himself and joined the members to dis- cuss this issue. Citing his landscape company' s (B&H Landscape & Sod) guarantee to replace any or all of the live oaks should it be necessary he said it was his feeling that this guarantee should suffice, contend- ing that the escrow money was unnecessary. Discussion followed, with the members advising that the escrow check was necessary for the Town ' s protection only and in no way was intended to offend either Mr . Rothenberg 's or B&H ' s integrity. Given this ex- planation, Mr . Rothenberg agreed to present said check before a Certif- icate of Occupancy was issued. Some discussion took place regarding the possibility of silver button- wood trees replacing any or all of the live oaks should they not sur- vive, since this species is known to be salt, wind and drought toler- ant. However , Mr . Rothenberg again referred to B&H' s guarantee and 94) said he would prefer to adhere to the original landscaping plans, which called for live oak, should replacement (s) be necessary. , . Heetmann was then made as follows : The Community Appearance Board recommends to the Building Department that a Certificate of Occupancy be issued to Highland Park Development for a sales trailer located on property at 3425 South Ocean Boulevard, Lot 90E. Mr . Mark Rothenberg , who is the owner/developer of said property, will issue a check in the amount of $1, 000 for the replacement of five (5) live oak trees if they should not survive within 30 days. Said check will be refunded when compliance is met. If the contractor replaces trees on his own, said check still will be refunded . Re-inspection will take place during the first week of February 1991. A roll call vote met with unanimous approval . There being no further business to come before the Board at this time, the meeting was adjourned upon MOTION by Mr . Galizia/Mr .
