1991.01.31_CAB_Minutes_Regular TOWN OF HIGHLAND BEACH COMMUNITY APPEARANCE BOARD REGULAR MEETING - MINUTES Thursday, January 31, 1991 9: 30 A.M. Co-Chairman Guy Galizia called the Regular Meeting to order in Commis- sion Chambers at 9: 30 A.M. Deputy Town Clerk Doris Trinley called the roll . Present were Co- Chairman Galizia , Co-Chairman Frank Savino, Regular Members John W. Littlejohn , Paul Heetmann and Doris Perrone and Alternate Members Yvonne Marie Petritz and Frank Arenella . Also present were Building Official Harry Heithaus and members of the general public . Mr . Galizia noted that the agenda would be amended to include review of plans for a 4 ' chain link fence (dog run) for property at 1116 Highland Beach Drive , submitted by Biehl (owner) . The members had no objection . Upon MOTION by Mr . Savino/Mr . Heetmann, the following Minutes were ap- proved with unanimous vote: December 27 , 1990 (Regular) January 3, 1991 (Special) January 16, 1991 (Special) Final Review for Dune Walkover , Lot 56E. Submitted by Delray Marine Construction for Regency Highland (owner) , 3912 S. Ocean Blvd . Troy Ennis of Delray Marine Construction and Robert Barron , landscape architect , joined the members for plan review. Lengthy discussion took place regarding the project ; items of particu- lar concern to the members were as follows : - no ramp for wheelchair access : Mr . Ennis said a ramp would be in conflict with Department of Environmental Regulations Management (DERM) , since it would require cutting further into the slope of the land , as well as require removal of native vegetation . Both actions were restricted by DERM, he said . Regarding handicap access , Mr . Ennis advised that the walkway and stairway were widened to 6 ' to accommodate side-by-side help for anyone who would need it to access the observation deck. Mr . Heithaus noted he had checked with state and county officials and learned that any project approved before December of last year was not required to supply handicapped access; this project was in that cate- eTh gory. Ennis said posts would be sunk to 8 ' or rock bearing , noting that the lot includes large sections of rock outcropping- - water outlet - There is an existing water outlet , which will be incorporated into the project to accommodate re- moval of sand and tar upon leaving the beach, Mr . Ennis advised. He also said no other outlets would be added and there would be no electricity or lights of any kind . - landscaping - Mr . Barron answered questions in this area , saying that County requirements called for a natural pace of growth on dune restoration . He explained that this pro- ject not only concerned landscaping , but was considered a species and habitat restoration site and many of the plants to be used were somewhat rare in that they were only native to a coastal environment . Photographs of these rare species were presented to the members. Messrs. Ennis and Barron advised that when all exotic mater- ials were removed as per DERM requirements, which process also included the requirement to preserve native species, it was evident that more landscaping than planned for would be needed . Mr . Barron suggested silver buttonwood be used in these areas and explained size and placement to the members . Replying to the members ' concern that the proposed plantings would require lengthy growing time in order to shield the observation deck from AlA, Mr . Barron said the plants should double in size in a single growing season and repeated that the types of plantings were restricted by DERM regarding dune restoration . He also noted that in this Xeriscape setting , fewer nutrients would be available , which would also account for slower growth . Discussion regarding the lack of landscaping at ground level revealed that this section had never been included in the landscaping plans ; however , Mr . Ennis said if the Board felt it was necessary after inspecting the completed project , they would be willing to consider landscaping this area . Mr . Barron advised that only a temporary six-month irrigation system was allowed by DERM, then the lot would be supported by natural rainfall . When questioned about water run-off onto AlA, he replied this should not be a problem as the land was sloped to accommodate run-off into the swale. - areas under DOT jurisdiction : applications have been sub- mitted to DOT, Mr . Ennis advised . He said DOT only re- quires asphalt be used in driveway areas; the walkway area for this project would be textured to give the appearance of cobblestone . Heetmann was made as follows : THE COMMUNITY APPEARANCE BOARD APPROVES THE PLANS FOR A DUNE WALKOVER AND OBSERVATION DECK FOR LOT 56 EAST (REGENCY HIGH- LAND/OWNER) AS SUBMITTED BY DELRAY MARINE CONSTRUCTION, SHEET 1292-03 DATED JUNE 29, 1990. Roll call resulted in unanimous favorable vote . Review of 4 'Chain Link Fence (Dog Run) for property located at 1116 Highland Beach Drive. Submitted by Dr . Albert G. Biehl/Owner . Dr . Biehl and Mr . Heithaus joined the members for discussion and re- view. Mr . Heithaus explained that the dog run was existing and was subject to a Citation (No . 2322) in that it was erected without a per- mit . The members did look at the plans submitted by Dr . Biehl and heard from him a brief description of why he had so placed the run , i .e . , his working hours necessitated his two dogs to be in the run for long periods of time so he had placed it where they would have shade . Dr . Biehl ' s remarks triggered a another discussion, which included the fact that several of his neighbors had signed a petition alleging that the dogs were a nuisance. Copies of the petition had previously been distributed to the members and Mr . Savino read portions of it into the record . Dr . Biehl denied the allegations ; however , the members agreed that they would prefer to have the Code Enforcement Board rule on the nuisance factor before they gave approval to the fence so an after-the- fact permit could be issued to satisfy Citation 2322. Mr . Heithaus advised that a Notice of Violation had been previously written to Dr . Biehl regarding the violation of Town Code 5-6 (Animal Nuisance) , but it was undeliverable , either by certified mail or in person . Mr . Heithaus then asked Dr . Biehl ' s permission to issue a Citation to him at this time in order that the matter could go before the Code Enforcement Board at its next meeting on February 20. Dr . Bihel agreed to this approach and was issued Citation 2323 citing vio- lation of Town Code 5-6. Under these circumstances , it was the CONSENSUS of the members to table this item until the Code Enforcement Board had made a decision . GREENING COMMITTEE No Report. ea` OTHER BUSINESS For the record , Co-Chairman Galizia noted that Alternate Member Yvonne Marie Petritz' one-year tenure as an Alternate Member will be over in February and , on behalf of the members , supported her re-election by the Town Commission . He also thanked Ms . Petritz for the fine job she ►. As part of the efforts to keep newer members up-to-date regarding var- ious C.A.B. duties, Mr . Galizia and Mr . Savino recapped some incidents the Board had addressed regarding the sign ordinance, giving examples of what was and what was not allowed according to Town Code . It was noted that the ordinance is so designed to ensure that signage is low- key in keeping with the character of the Town . A brief review of the satellite dish ordinance also took place. John Littlejohn will be the inspector for February. There being no further business to come before the Board, and upon MOTION by Mr . Savino/Mr .
