1991.03.28_CAB_Minutes_Regular i TOWN OF HIGHLAND BEACH 01, COMMUNITY APPEARANCE BOARD REGULAR MEETING - MINUTES Thursday, March 28, 1991 9: 30 A.M. Co-Chairman Frank Savino called the Regular Meeting to order in Commis- sion Chambers at 9 : 30 A.M. Deputy Town Clerk Doris Trinley called the roll . Present were the Co- Chairman, Regular Members John W. Littlejohn and Paul Heetmann and Al- ternate Members Yvonne Marie Petritz and Frank Arenella . Co-Chairman Guy Galizia and Regular Member Doris Perrone were absent . In the ab- sence of Mr . Galizia and Ms . Perrone , Mr . Savino announced that Ms . Petritz and Mr . Arenella would sit as Regular Members for this meeting . Also present were Building Official/Code Enforcement Officer Harry Heithaus and members of the general public . The Co-Chairman advised that the agenda today would be amended to de- lete Preliminary Review for a single family residence at 4200 Tran- quility Drive, Block 5, Lot 10, Bel Lido , submitted by Victor Frankel (owner) , as Mr . Frankel had chosen not to submit plans for review at this time . Upon MOTION by Mr . Arenella/Mr . Littlejohn , the minutes of the Regular Meeting of February 28 were unanimously approved . NEW BUSINESS Final Review for Roof over Existing Patio . 1105 Russell Dr . , Lot 18 . Submitted by Drago for Spadafina (owner) . Mr . Spadafina appeared on his own behalf and joined the members at the table for plan review. He explained that what he proposed to do was simply add a roof over an existing patio and screen the area , not en- close it . Discussion of the project included the type of roofing to be used (vinyl because of the pitch) and the fact that the patio itself was built on pilings and was approximately 23. 5 x 10. 7 in size . Mr . Heithaus assured the members that the project met all Code require- ments. It was necessary for Mr . Spadafina to appear before the Board , he said , to comply with Ordinance 574, which states in part that any change to a roof-line on an original building requires CAB approval . Community Appearance Board Regular Meeting - Minutes n March 28, 1991 Page 2 of 3 After some further discussion and review, the following MOTION was made by Ms. Petritz/Mr . Heetmann: THE COMMUNITY APPEARANCE BOARD APPROVES THE PROPOSED PLANS, DATED 10/31/90, FOR THE ADDITION OF A ROOF OVER AN EXISTING PATIO AT 1105 RUSSELL DRIVE, LOT 18, AS SUBMITTED BY DRAGO FOR SPADAFINA (OWNER) . Roll call met with unanimous favorable vote. OTHER Mr . Heithaus informed the members that there were some residences in Town which were not being properly maintained (other than groundskeep- ing) , but about which, according to present Code, he could do nothing to bring into compliance. He asked if the Community Appearance Board might consider a recommendation whereby the Code could be amended to have situations such as this, where a property was not maintained with- in community standards, could be put under their jurisdiction. Then, Mr . Heithaus continued , he would be able to act under Code Enforcement guidelines. Substantial discussion took place among the members and it was their CONSENSUS that since this would require an ordinance to amend the Code, legal counsel would have to be sought to see if it would be lawful. The members took no action at this time. Regarding planned improvements to the bike path, discussion took place regarding those sections that had trees with horizontal root systems planted close enough to cause damage to the path. It was the CONSENSUS of the members to transmit a recommendation to the Town Manager that all trees of this sort be removed during the project and not be re- placed. GREENING COMMITTEE Mr . Savino advised that he had received replacement plaques, as well as plaques for trees recently donated , and was in the process of having them placed. He also showed the members some pictures taken in another community that showed arrangements of flowers between trees and asked for their opinions as to whether it might be a good idea to take this approach in Town . Mr . Savino said that instead of flowers, xeriscape-approved plantings could be used , and the arrangements could be offered in the same way the trees are ( including a plaque) . Savino then announced the next meeting date would be April 25. There being no further business to come before the Board at this time, the meeting was adjourned on MOTION by Mr . Heetmann/Ms .
