COMMUNITY APPEARANCE BOARD
REGULAR MEETING - MINUTES
Thursday, February 27, 1992 9: 30 A.M.
Chairman Guy Galizia called the Regular Meeting to order in Commission
Chambers at 9: 30 A.M.
Deputy Town Clerk Doris Trinley called the roll . Present were the
Chairman, Vice Chairman Elvine Gordon and Members John W. Littlejohn ,
Paul Heetmann , Doris Perrone, Frank Arenella and Yvonne Marie Young .
Also present were Building Official Harry Heithaus and members of the
general public .
Upon MOTION by Mr . Arenella/Mr . Heetmann , the minutes of the Regular
Meeting of January 30 and Special Meeting of February 5 were unani-
mously approved .
NEW BUSINESS
Final Review for Privacy Wall at 3519 S. Ocean Blvd . , Lot 82E. Sub-
mitted by Mrs. Lawrence Germain; Lawrence Reina, Contractor .

Mr . Reina represented Mrs . Germain and explained the wall would be
5 ' high, run east to west and be placed on the north and south sides of
the property . He said the color matched that of the residence and no
shrubbery was planned to be planted against it . Mr . Heithaus illus-
trated the design on the chalkboard and advised that Town Code had no
planting restrictions for this type of wall . He did point out that the
first 5 ' of the wall from the front property line must be reduced to
30" so as not to impair visibility. Mr . Reina agreed to initial the
drawing in this regard and did so . It was also noted that the fence
would not extend east of the CCCL.
After further review and discussion , the following MOTION was made by
Mrs. Gordon/Mrs . Young :
THE BOARD GIVES FINAL APPROVAL TO PLANS FOR A PRIVACY
WALL AT 3519 S . OCEAN BLVD. , LOT 82E, AS DRAWN ON THE
BOUNDARY SURVEY AND INITIALLED BY THE CONTRACTOR; SUB-
MITTED BY MR. LAWRENCE GERMAIN.
Roll call met with unanimous favorable vote .

Amended Site Plan Review for Addition to Single Family Resident at
4216 Tranquility Dr . , Block 5, Lot 6, Bel Lido . Submitted by Donald T.
Smith, Architect, for Susskind (Owner) .
Mr . Smith represented the owner and explained changes and deletions,
saying the changes were made to ensure safety for the family' s
children . Deletions included a playhouse and exterior storage closet
on the garage side, which Mr . Smith noted on the plans at this time .
After Mr . Heithaus illustrated the changes on the chalkboard , the mem-
bers convened to the table for review and discussion . Concluding same,
the following MOTION was made by Mr. Arenella/Mrs. Perrone:

FOR ADDITION TO SINGLE FAMILY RESIDENCE AT 4216 TRANQUILITY
DRIVE, BLOCK 5, LOT 6, BEL LIDO; SUBMITTED BY DONALD T. SMITH,
ARCHITECT, JOB 5191, DATED 7/3/91, SHEETS 1, 3 AND 10.
Roll call resulted in unanimous favorable vote.
Preliminary Review for Sales Trailer at 2348 S. Ocean Blvd . , Lot 136W.
Submitted by Peter Ince for Ince & Hertel (Owner) .
elaN' After Mr . Ince explained his request for placement of the trailer on
this lot, Mrs. Gordon noted that Mr . Ince did not have a building per-
mit for the lot and read into the record Section 5. 6 of Chapter 30,
which states that a building permit must be issued before a sales
trailer can be placed .
Lengthy discussion then took place among Mr . Ince, the Building Offi-
cial and the members regarding the background of the entire property
of which Lot 136W is a part. It was noted the property is known as the
"old Fredericks property" and the Town Commission had been involved in
certain decisions regarding it in the past. Mr . Heithaus said that in
view of the history of the property, including redrawn lot lines, Mr .
Ince might "technically" have a building permit in place on the lot; he
suggested the panel submit their decision today contingent on the de-
cision of the Planning Board at their Regular Meeting on March 11. He
also said that should the Board decide to do this, then a final ap-
proval could be considered , noting that if the Planning Board did not
approve the trailer , then the CAB 's approval would be moot in any case.
After some further discussion, Mr . Arenella/Mrs. Young made the fol-
lowing MOTION:

Roll call met with unanimous favorable vote .
CERTIFICATE OF OCCUPANCY
The Board made Certificate of Occupancy recommendations for the fol-
lowing by unanimous vote:
Single Family Residence at 2359 S. Ocean Blvd. , Lot 136E;
requested by Ince & Hertel for LaHage (Owner) .
Inspectors : Mr . Galizia/Mr . Heetmann
Motion : Mr . Arenella/Mr . Heetmann
Before proceeding to the next item, a side discussion took place among
Mr . Ince, Chairman Galizia and the members, relative to three (3)
existing tabebuia trees located on the swale of Lot 129E, which Frank
Lahage, owner and developer of the property, wanted moved . Mr . Ince
stated that Mr . LaHage was willing to have the trees moved anywhere in
Town and to guarantee they would be replaced if they did not survive.
John Lang of Lang Landscape Design also addressed the members, saying
the Department of Transportation advised they would not approve land-
scaping plans until the trees were moved since they were planted in the
DOT ' s 14 ' recovery zone . Mr . Lang also told the Board of a new spade
that could easily move the trees without disturbing the root zone .
The Chairman referred Mr . Ince and the members to Town Code, Chapter
28-1/2. 31 which designates certain trees, including tabebuia , as
specimen trees and spells out the ways in which they are to be pre-
served and protected (copy attached to and made part of these minutes) .
He read the section into the record and noted the trees in question are
owned by the Town and fall into this Code category.
At this time Chairman Galizia ended discussion , noting the Board ' s
responsibility to uphold Town Code, as well as the fact that Lot 129E
was not an agenda item today.
Returning to the next item, a Certificate of Occupancy was recommended
for the following :
Single Family Residence at 2 Ocean Place, Lot 28E; requested
by Boca Contracting Corp. for Highland Ocean Associates (Owner) .
Inspectors : Mrs . Gordon/Mrs . Perrone
Motion : Mrs . Gordon/Mrs . Perrone
. . NOTE: a problem regarding displaced pavers, which was caused by incor-
rect removal of excess water from the swimming pool , and which was men-
tioned by the Inspectors in their report , had been corrected and was so

noted for the record . The Project Manager assured the members that
proper steps had been taken to preclude the problem from re-occurring .
OTHER
Building Official Heithaus explained that Southern Standard Building
Code now requires 4 ' fencing around all residential pools , as well as
alarms on all doors of the residence that enter into the pool area .
He asked if the panel would move on adopting this SSBC code and MOTION
to adopt same was made by Mrs. Gordon/Mrs. Young with unanimous
approval . It was noted that application of the Code was for new con-
struction only.
GREENING COMMITTEE
The members were given copies of the new form to be signed by condo-
minium managers and/or property owners regarding care of newly planted
donated trees . There was no objection to content .
The planting of asparagus fern around any newly planted tree was dis-
cussed as a measure to protect the tree from landscaping equipment .
Mr . Galizia read a letter received from Amelie Leng into the record ,
/'1 which asked the Board to do all in its power to preserve the existing
three (3 ) tabebuia trees discussed earlier in this meeting .
Mrs . Gordon reported she is still working on computerizing information
regarding placement of existing trees .
Mrs. Young told the members she found it necessary to resign from the
Greening Committee, as well as the Board , due to her recent marriage,
which called for quite extensive travel plans .
Mr . Galizia named John Littlejohn as Inspector for March. He also
noted the next meeting to be March 26 with the agenda closing on March
12.
There being no further business to come before the Board , the meeting
was adjourned at 11 : 10 AM upon MOTION by Mr . Heetmann/Mrs . Young .

§ 281-30 TREES, SHRUBS AND VEGETATION § 281/2-3l
lethal yellowing of coconut disease shall be considered such
an emergency type of tree infection or disease. (Ord. No. 193,
§ 1, 14-5-72)

Sec. 281/2-31. Designation of specimen and historic trees.
(a) Any person may by written request to the town man-
ager recommend from time to time the establishment by offi-
cial designation certain trees located within the Town of
Highland Beach as specimen or historic trees. Upon receipt
of such a written recommendation, the town commission shall
review same and add thereto their own comments and recom-
mendations. The town commission shall consider the report
of any person and shall either accept, modify or deny same
and shall designate by ordinance those trees it deems appro-
priate as specimen or historic trees.
(b) The Town of Highland Beach hereby designates the
following trees as specimen trees, and as such, they are to be
.-, properly preserved and protected:
(1) Ficus, spp. - Lot 106, West of AlA, Town of High-
land Beach.
(2) Those certain trees planted pursuant to the Highland Beach
Greening of A-1-A program, including, but not limited to,
the following species:
a. Buttonwood.
b. Seaside mahoe.
c. Calophyllum.
d. Black olive.
e. Norohonia.
f. Royal palm.
g. Tabebuia.
h. Pigeon plum.
(c) In order to properly preserve and protect the above
specimen trees, no clearing or construction equipment or ac-
tivity should be allowed within the confines of the drip line of
the trees. This includes any area under the foliage. The pur-
pose of this consideration is the protection of the subterra-
nean life support systems.
