1993.02.19_CAB_Minutes_Special TOWN OF HIGHLAND BEACH e•—'` COMMUNITY APPEARANCE BOARD SPECIAL MEETING - MINUTES Friday , February 19 , 1993 9 : 30 A .M. Chairman Guy Galizia called this Special Meeting to order in Commission Chambers at 9 : 30 , noting its purpose was : REVIEW REQUEST FOR FENCE AT 4201 TRANQUILITY DR . , BLOCK 5 , LOT 11 , BEL LIDO . SUBMITTED BY JOSE ANDREU , OWNER . Deputy Town Clerk Doris Trinley called the role . In addition to the Chairman , Vice Chair Elvine Gordon was present , as were Members Paul Heetmann , John W. Littlejohn , Doris Perrone . Frank Arenella and Eugene I . Behrman . Also present were Building Official Lee Leffingwell and members of the general public . Owner Jose Andreu addressed the members , saying the fence would not cover the entire southern length of the property to the street , rather it would be 75 ' in length , extending to the rear of the property in order to ensure privacy , particularly for the pool area . Since there rt.% was no Code requirements to the contrary , Mr . Andreu was proposing to place the fence 1 " from the property line . Andre Martinovic of 4203 Tranquility Drive , Mr . Andreu ' s neighbor to the south , next addressed the members , saying he opposed the type of fence proposed ; he purported this kind of fence was used mainly to separate properties from a main thoroughfare . He was also concerned that the 1 " placement would interfere with ficus hedging he had planted on th property line , with , he said , Mr . Andreu ' agreement . During the course of ensuing dicussion , it was made known that there had been animosity between Messrs . Andreu and Martinovic regarding the placement of Mr . Andreu ' s pool deck . It was also disclosed that the Board of Adjustment had recently denied Mr . Andreu ' s petition to allow the deck to remain 1 ' from the property line instead of the required 4 ' . Regarding the type of fencing Mr . Andreu had selected , Building Official Leffingwell advised it met all Code requirements . The members and Ms . Leffingwell encouraged a conciliatory stance on the part of the neighbors , suggesting that each allow for some leeway to the other . In conclusion , Mr . Andreu agreed to place his fence ( face of post) 3 " from the property line and Mr . Martinovic agreed to relocate his ficus hedging 3" from the property line . GORDON , with roll call resulting in unanimous favorable vote : THE COMMUNITY APPEARANCE BOARD APPROVES PLANS FOR A FENCE AT 4201 TRANQUILITY DR . , BLOCK 5 , LOT 11 , BEL LIDO , SUB- MITTED BY JOSE ANDREU ( OWNER) , WITH CHANGES AS AGREED TO BY MESSRS . ANDREU AND MARTINOVIC , I . E . , MR . ANDREU WILL PLACE THE FENCE 3" FROM THE PROPERTY LINE ; MR . MARTINOVIC WILL RELOCATE FICUS HEDGING FROM PROPERTY LINE TO 3" FROM PROPERTY LINE . Ms . Leffingwell then noted the changes on all sets of plans and both parties initialled thereto . There being no further business to come before the Board , the meeting was adjourned at 10 : 10 A.
