REGULAR MEETING - MINUTES
Thursday , January 27 , 1994 9 : 30 A. M .
Vice Chair Elvine Gordon called the Regular Meeting to order in Com-
mission Chambers at 9 : 30 A. M .
Deputy Town Clerk Doris Trinley called the roll . Others present were
Regular Members John W. Littlejohn , Paul Heetmann , Frank Arenella and
Eugene I . Behrman . Regular Member Doris Perrone was absent . Chairman
Guy Galizia arrived late in the meeting .
Also in attendance were Building Official Lee Leffingwell and members
of the general public .
MINUTES
The Minutes of the December 30 , 1993 Regular Meeting were unanimously
approved upon MOTION by MR . LITTLEJOHN/MR . BEHRMAN .
OLD BUSINESS
Clearing , Filling & Landscaping of Lots 9 & 10W . Lucia Milani , Owner .
[Community Appearance Board Action at December 17 , 1992 Regular
Meeting .
Ms . Leffingwell advised that this project had come into compliance
with what the CAB had approved in December 1992 , noting the only
variation was that Mrs . Milani had counted two existing trees on the
property as part of the 18 called for ; she also eliminated one tree to
allow for future access without having to remove a tree . This com-
pliance , it was advised , cancelled the Citation served to Mrs . Milani
regarding code enforcement procedures under the " Exceptions for Bet-
terment Plans" section of Town Code (20- 140 ) . [A copy of Ms . Milani ' s
letter to Ms . Leffingwell is attached to and made part of these
Minutes ; also , for further explanation see Minutes of December 30 ,
1993 . ]
Answering a question raised regarding irrigation of the lot ,
Ms . Leffingwell explained that Mrs . Milani had in her possession an
irrigation permit application , but wanted time to think it over
because of the expense involved .

NEW BUSINESS
Final Review for Deck at 4229 Intracoastal Dr . , Block 4 , Lot 32 , Bel
Lido . Submitted by Aldo Ruscito (Owner) .
Ms . Leffingwell confirmed the plans were in compliance with Code
and noted that several other decks in the area were of similar design
in that they were built over the seawall itself .
Concluding discussion and review , the following MOTION was made by
MR. ARENELLA/MR. BEHRMAN :
THE COMMUNITY APPEARANCE BOARD GIVES FINAL APPROVAL TO
PLANS FOR INSTALLATION OF A DECK AT 4229 INTRACOASTAL DR . ,
BLOCK 4 , LOT 32 , BEL LIDO ; SUBMITTED BY ALDO RUSCITO
( OWNER) .
Roll Call met with unanimous favorable vote .
Final Review for Pool Fence at 2711 S. Ocean Blvd . , Lot 118E (Jamaica
Manor) . Submitted by A. E . Nicholson , President , Jamaica Manor , Inc .
Mr . Nicholson represented the project and gave the members particu-
lars regarding the pool fence . It was noted that insurance
requirements necessitated the installation . Mr . Nichols answered the
members ' questions to their satifaction , advising that each walkway
will have its own gate , which will employ concealed fiberglass hinges
and latches ; the fence will be placed 6" into the edge of the patio .
Ms . Leffingwell noted that all Code requirements had been met ;
however , she did advise Mr . Nicholson that specs will have to be
submitted for the fiberglass hinges and latches .
After further discussion and review , MR. BEHRMAN/MR. HEETMANN made the
following MOTION , which met with unanimous roll call vote :

Recommendation for Certificate of Occupancy for 4-Unit Condominium
( LeSanctuaire ) at 3425 S . Ocean Blvd . , Lot 90E . Submitted by Highland
Park Associates (Owner) .
Mrs . Gordon advised that upon inspection it was noted some trees and
!' other smaller plantings had not survived the harsh winds that are

experienced off the ocean this time of year . Representing the owner ,
Peter Ince agreed that some areas of the landscaping had not fared
well because of a " wind tunnel " effect on certain parts of the
property . However , Mr . Ince assured the members that any plantings
which did not survive during the upcoming 6-month period would be
replaced , and he would submit a letter to this effect .
After some further discussion , during which it was noted that although
some landscaping did not meet plans it had been upgraded and added to ,
the following MOTION was made by MR. BEHRMAN/MR . ARENELLA :
THE COMMUNITY APPEARANCE BOARD RECOMMENDS THAT A CERTIFICATE
OF OCCUPANCY BE ISSUED FOR A 4-UNIT CONDOMIUM ( LE SANCTUAIRE )
AT 3425 S . OCEAN BLVD . , LOT 90E . SUCH RECOMMENDATION IS MADE
ON CONDITION THAT ANY TREES AND/OR OTHER PLANTINGS WHICH
DO NOT SURVIVE OVER THE NEXT 6-MONTH PERIOD WILL BE REPLACED .

Roll call met with unanimous favorable vote .
GREENING COMMITTEE

Chairman Galizia , recently recuperating from illness , joined the
meeting at this time and was welcomed by his fellow members .
Mr Behrman spoke of the increased cost of trees , especially noronhia ,
and discussion followed regarding the possibility of increasing the
price charged to those who wish to purchase (donate) new trees , while
keeping the $300 donation price for existing trees . Regarding cost ,
the possibility of purchasing a number of trees to replace those now
destroyed or damaged , as well as have exisiting trees available
people to donate in the future at a better price to the Committee , was
also discussed .
OTHER
Mr . Arenella asked for clarification regarding the members visiting
agenda item sites and Certificate of Occupancy request properties . It
was suggested that perhaps the Town Manager could address this issue
at the next meeting .
ADJOURNMENT
Vice Chair Gordon announced the next meeting would be February 24 ,
with the agenda closing on February 10 .
Before adjournment upon MOTION by MR. ARENELLA/MR. LITTLEJOHN , Chair-
man Galizia extended thanks to all for their kindnesses and get well
wishes during his recent illness .

Dear Ms. Leffingwell:
1 am writing in response to our conversation of Wednesday, January 5, regarding my compliance
with the plan for clearing my property at Lots 9W and IOW, Highland Beach. As you know,
all the scavola hedge materials are in place as is the grass. We placed 15 Royal Palm Trees
pursuant_to the plan. However, during clearing we preserved one mature Banyan Tree and one -
mature Coconut Palm Tree which my consultants and I determined were worthy of saving'That
accounts for 17 trees.' The plan calls for 18 trees but I chose to leave one out at the front'of the'
property to allow access in the future without having to remove a large tree.
Please process the necessary modification to the plan if required. Call me if there is need for
further action on my part to assure compliance with the requirements of the Beautification r*.
