1994.08.25_CAB_Minutes_Regular TOWN OF HIGHLAND BEACH COMMUNITY APPEARANCE BOARD REGULAR MEETING - MINUTES Thursday, August 25, 1994 9 : 30 A.M. Chair Elvine Gordon called the Regular Meeting to order in Com- mission Chambers at 9 : 30 A.M. Deputy Town Clerk Doris Trinley called the roll . Mrs . Gordon, Vice Chair Eugene I . Behrman and Members John W. Littlejohn, Paul Heetmann, Frank Arenella, Miriam S . Zwick and Theresa M. Colarullo were present . Members of the general public were also in attendance, including Talent Bank Applicant Dee Rose . Building Official Lee Leffingwell was absent . MINUTES Upon MOTION by MR. LITTLEJOHN/VICE CHAIR BEHRMAN, the Minutes of the July 28 Regular Meeting were unanimously approved. NEW BUSINESS Review Plans for Additional Tennis Court and one (1) Additional Gazebo at 2912 , 2914 & 2916 S. Ocean Blvd. , Lot 109W. Submitted by Kenneth A. Treadwell for Trafalgar Condominium Association (Owner) . Mr . Treadwell represented the project , explaining that his client was unit owner Leonard Schwartz . He advised Mr. Schwartz was not interested in adding an additional tennis court and gazebo, but rather modifying the existing court, which he noted was actually a seldom used paddle ball court located on the west lot (Townhouses) of the Trafalgar property, into a regulation size tennis court and relocating the existing gazebo. Discussion and plan review followed, during which time it was noted that although Town Code calls for a 6 ' maximum height re fences, walls and hedges - and the proposed plans did show a 6 ' fence height - tennis courts were usually built with a surrounding 10' high fence to keep mis-hit balls within the confines of the court itself , as well as for the protection of people/traffic in the immediate area of the court . Of particular import to the members was the fact that, because of the confines of property space, the proposed court would be necessarily built in a east/west direction and, therefore, the east side of the court would be parallel to State Road AlA, the main thoroughfare of the Town, as well as parallel to the Town' s much used bike path. /a' .i . In conclusion, the following MOTION was made by MR. ARENELLA/MRS. ZWICK and met with unanimous favorable roll call vote : THE COMMUNITY APPEARANCE BOARD GIVES APPROVAL TO MODIFY EXISTING PADDLE BALL COURT INTO A REGULATION SIZE TENNIS COURT AT 2912, 2914& 2916 S. OCEAN BLVD. , LOT 109W, ON CONDITION THAT A 10' HIGH FENCE IS ERECTED ON THE EASTERN BORDER OF THE COURT WITH ADEQUATE LANDSCAPING TO SHIELD SAME. SUBMITTED BY KENNETH A. TREADWELL FOR TRAFALGAR CONDOMINIUM ASSOCIATION; DRAWING 5-443, DATED 6/1/94, REVISED 8/3, 8/4 & 8/5 1994, ABSOLUTE LAND SURVEY, INC. Mr. Treadwell then initialled the plans to reflect the 10' high fence on the east side. At this time, he also gave the Recording Clerk the original letter from Trafalgar Board of Directors, which gave Mr. Schwartz the authority to pursue this matter with the Town. (Note : Letter was subsequently transmitted to the Building Department . ) OLD BUSINESS Le Sanctuaire, 3425 S. Ocean Blvd. , Lot 90E The Chair read into the record a Memorandum to File, which detailed the findings of Messrs . Heetmann and Littlejohn on their re- inspection of the landscaping on this property as per the conditions set forth in the recommendation for a Certificate of Occupancy dated January 27, 1994 . Following brief discussion, and upon MOTION by MR. HEETMANN/MRS. COLARULLO, it was agreed that the Building Official be asked to contact the developer and request replacement of landscaping as noted in the memorandum. (A copy of the memorandum, recommendation for a Certificate of Occupancy and Highland Park Associates letter dated January 29, 1994 are attached hereto and made part of these Minutes. ) GREENING COMMITTEE Mr. Behrman advised that because the purchase price of trees had increased dramatically since Hurricane Andrew, the members might want to consider increasing the $300 donation for any new plantings . He noted that the current price of a 12' tree is approximately $225, which does not include cartage, planting, etc. The members agreed to discuss this matter further in the near future . s 4 Community Appearance Board F a Regular Meeting - Minutes August 25, 1994 Page 3 of 3 Mrs. Gordon then announced Mr. Behrman would be Inspector for the month of September. She noted the agenda closes September 15 and the next Regular Meeting is scheduled for September 29 . Upon MOTION by MR. LITTLEJOHN/MR. LOT 90 EAST In accordance with the conditions set forth in the CAB' s Recommendation for Certificate of Occupancy dated 1/27/94 , and a subsequent letter acknowledging same from Highland Park Associates dated 1/29/94 , this is to advise that on 8/15/94 , CAB Members Paul Heetmann and John Littlejohn re-inspected the property. Their report included that plantings inside the wall on the -south side of the property have been replaced with oleanders . Inside the wall on the forth side, two (2) bougainvilleas are dead and one (1) has been removed; all three (3) need to be replaced. Also, a small shrub just outside the entrance gate on the south side appears to be in need of replacement . cc : Building Official A.:3. Ocean Blvd. Dear Mrs. Gordon. This letter will confirm our agreement wherein Highland Park Associates, as the owner of the subject condominium, agrees to replace any and all dead and/or damaged vegetation located on or about the property stated above within six months from this date. As discussed, the landscape company, Top Branch Nursery & Landscaping has guaranteed the life of the vegetation and has represented that the existing condition is nothing more than wind burn and will not adversely effect the trees.
