COMMUNITY APPEARANCE BOARD
REGULAR MEETING - MINUTES
Thursday, September 29, 1994 9 : 30 A.M.
Chair Elvine Gordon called the Regular Meeting to order in Com-
mission Chambers at 9 : 30 A.M.
Deputy Town Clerk Doris Trinley called the roll . Others present
were Vice Chair Eugene I . Behrman and Members John W. Littlejohn,
Paul Heetmann, Frank Arenella and Miriam Zwick . Theresa M.
Colarullo was absent .
Building Official Lee Leffingwell and members of the general public
were also in attendance .
MINUTES
Upon MOTION by MR. BEHRMAN/MR. LITTLEJOHN, the Minutes of the
August 25 Regular Meeting were unanimously approved.
OLD BUSINESS
Correct Final Approval of Plans for Replacement of Existing Court
with One (1) Regulation-Size Tennis Court, and Relocation of
Existing Gazebo, at 2912, 2914 & 2916 S . Ocean Blvd. , Lot 109W.
Submitted by Kenneth A. Treadwell for Trafalgar Condominium
Association (Owner) .
In response to the Chair' s request, Building Official Leffingwell
initiated discussion on why the August 25 Motion to approve these
plans, which included the condition that the court fence be 10'
high on its east (A1A) side, needed to be rescinded. Apologizing
for her absence at the August meeting due to a scheduling problem,
Ms . Leffingwell explained that while their action was taken in good
faith and motivated by safety concerns, the Board did not have the
authority to make the 10' fence a condition of approval since Town
Code Chapter 30 [Section 5 . 1 (a) ] fixed a maximum height of 6 ' for
all fences, walls and hedges, and nowhere within the Code were
tennis court fences addressed as a separate issue . However, Ms .
Leffingwell advised that in researching approvals for the existing
10' fence around the existing paddle ball court, she had located a
copy of the initial application for permit, as well as a copy of
the permit itself (No. 4908 issued 2/2/81 ; signed by then Town
Manager Elaine Roberts) . Therefore, she further advised that the
existing 10' fence was "legal" and the members could refer to an
"extension of the existing 10' fence" in their new Motion. Ms .
Leffingwell noted she had conferred with Town Manager Mary Ann
'4., Mariano and it was agreed this approach would be a viable solution
to giving the project approval .

Correspondence between the Building Official, Trafalgar' s attorney
and the Trafalgar Association' s manager was referred to during
discussion, with it being noted that the Association preferred to
have a 10' fence around the proposed tennis court .
Brief discussion regarding relocation of the existing gazebo also
took place, and it was noted that concealment of the fence by
landscaping on the east (A1A) side had been previously addressed.
Of particular concern was the fact that no dimensions or
measurements were shown on the drawings. However, Ms . Leffingwell
assured that correct data, including allowable setbacks, etc. ,
would have to be presented to her before any permits were issued.
Concluding discussion, the following MOTIONS were made by MR.
ARENELLA/MR. BERRMAN:

Both MOTIONS met with unanimous favorable roll call vote.
NOTE: COPIES OF CORRESPONDENCE REFERRED TO HEREIN, AS WELL AS A
COPY OF THE PERMIT APPLICATION AND THE PERMIT ITSELF, ARE
ATTACHED TO AND MADE PART OF THESE MINUTES.

Mrs . Gordon then advised she had researched Palm Beach County Code
with regard to allowable height of tennis court fences and found
that such provision was indeed incorporated into that Code . In
light of the confusion encountered with the proposed Trafalgar
project, and following discussion of Mrs . Gordon' s suggestion that
the CAB recommend to the Town Commission that a tennis court height
provision be incorporated into Town Code, it was the consensus of
the Board that a memorandum to this effect be transmitted to the
Commission as soon as possible . (A copy of the pertinent County
code is attached to and made part of these Minutes . )
OLD BUSINESS
LeSanctuaire
The Chair read into the record a letter received from Highland Park
Associates re LeSanctuaire, 3425 S. Ocean Blvd. , Lot 90E, which
assured that appropriate action would be taken re landscaping items
that needed to be replaced. (See Minutes of August 25, 1994 . )
"Signs and Advertising" Ordinance
Mrs . Gordon advised the Board had been asked by the Town Commission
to further review the proposed "Signs and Advertising" ordinance
(Chapter 23) , which had been previously transmitted to them with
the Board' s recommendations, as well as receive input from the
Realtor Association of South Palm Beach County, Inc . She noted a
representative of this association had appeared at the September 27
Town Commission Workshop Meeting to express concern over the
recommended size and color of temporary real estate signs .
Substantial discussion took place, during which the members agreed
to the Building Official' s suggestion that a representative from
the realtors' association be invited to the next CAB meeting.
Ms . Leffingwell assured that this action would in no way indicate
that the Board should alter any of its previous recommendations;
rather it would be a courteous gesture which would accommodate an
exchange of dialogue . Ms . Leffingwell also advised that she was
checking with the local Department of Professional Regulation
agency in an effort to secure definitive information on state
requirements re temporary real estate signs, which she hoped to
have available in time for the next meeting (October 27) .
GREENING COMMITTEE
Chairman Behrman advised the Committee had absorbed the $300 . 00
cost of replacing two (2) trees at the Bel Lido Island entrance,
which were originally planted by the Committee

OTHER
Mrs. Gordon announced Mrs. Zwick would be Inspector for October;
the next meeting would be October 27, with the agenda closing on
October 13 .
There being no further business to come before the Board at this
time, the meeting was adjourned upon MOTION by MR. ARENELLA/ MR.
BEHRMAN at 10 : 30 A.M.

Dear Ms . Leffingwell :
I have received a copy of your letter to Ken and have forwarded
copies to the Board Members of the Trafalgar Condominium. The
reason for this letter is a question raised by a Board Member.
Reference paragraph ' s 3 - 4 - 5 :
( 3 ) The existing fence is at least ten ( 10) feet high and
the Absolute drawing, which you and the Community Appearance
Board have received copies reflects this . Ken has already
added to the drawings the following language:
"accepted 10 foot fence hight condition on eastern
fence with adequate landscaping to shield"
This ten ( 10 ) foot hight is acceptable to the Board and
does not need to be reduced to six ( 6) feet .
( 4 ) The drawings submitted show only that we will remove
the existing gazebo and re-built it in location shown
on drawing.
( 5) As we will not have anyone attending this corrective action
meeting of the Community Appearance Board on September 29,
we wanted you to have the above to refer to.

I am sorry that I could not join you at the recent Community Appearance
Board meeting of August 25 , 1994 , because of a scheduling problem.
In my absence , the Community Appearance Board members, in trying to
address their legitimate concerns with safety in regard to the height of
the fence surrounding the tennis court , made a condition of approval to
increase the height of the tennis fencing to ten (10) feet , inadvertently
--overstepping their authority.
The height of the tennis fence is to remain, as submitted, at six (6)
feet and is approved at that height. Please leave the existing hedge
height.
The proposed gazebo is approved as submitted by , either 1 . moving the
existing gazebo to the location shown on your plans, or 2 . leaving the
existing gazebo at its present location and adding an additional one , as
shown on your submitted plans .
The Community Appearance Board will take corrective action for the record
at its next meeting on September 29 , 1994 at 9 : 30 a.m. You may wish to
attend this meeting .
I sincerely hope this will address all parties concerns and questions.
The Community Appearance Board is made up of local residents who volunteer
their time and efforts to help beautify the community they live in, and are
a valuable resource for our Town. They consistently do a wonderful job.
Please accept our apologies for any confusion that may have transpired.

RE: TRAFALGAR OF HIGHLAND BEACH
After reviewing your proposed drawings for tennis courts and
gazebo, I am enclosing a copy of code Sec. 5 . Supplementary
district regulations , which says the fence shall be 10 feet
from property line in the front , with a hedge material at
least 5 feet from the front property line.
Your drawing reflects 10 . 3 on the north corner of front and
8 . 6 on south corner of front, which would have to be moved
back. The side and rear of chain link fence shown as pro-
posed, are within the codes , but do not show height; which
can be 6 feet measured from lowest elevation.
For the gazebo , one story , see enclosed code Sec . 13 . 12 Gazebo,
the side setbacks need to be 12 feet, not shown on proposed
drawing.
I hope this information is helpful to you and your clients.

horizontal dimension may be erected or constructed in
connection with the erection of a wall or fence, said gateposts

d. Commercial and planned development restrictions. When fences or walls are
located along side intenor or street side property linea. the fence or wall shall
be located along the intenor side of the required landscape buffer strip.
(1) Tennis co rts. Tennis courts enclosed by fences exceeding six (6) feet
in height shall be permitted, provided they shall be constructed of
material allowing for fifty (50) percent light and fifty (50) percent air
circulation, shall not be roofed, and shall be subject to the following
minimum setbacks:

(2) Golf courses. Fences of up to eight(8) feet in height shall be permitted
within required setbacks of residential districts for golf courses.
e. Commercial restrictions. Where fences, walls, or hedges are required, they
shall have a minimum height of six (6) feet.
f. Dangerous materials. Walls, fences or similar structures erected in any
residential district shall not contain any substance such as broken glass, spikes,
nails, barbed wire. or similar materials designed to inflict pain or injury to any
person or animal. Barbed wire fences surrounding commercial radio towers shall
be allowed in all districts.
3. Outdoor storage. Outdoor storage of merchandise in all commercial, industrial and
nonresidential districts shall be subject to the following standards, unless the use is
specifically regulated in another district or section.
a. Outdoor storage of merchandise shall be permitted only when incidental to the
use located on the premises.
h. The storage area shall not he located in any of the required setbacks or yards.
