BOARD OF ADJUSTMENT
PUBLIC HEARING - MINUTES
Friday, August 21, 1992 1:30 P.M.
Chairman Harold B. Cohen called this Public Hearing to order in Commis-
sion Chambers at 1:30 P.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman David Augenstein and Members Jane Rayner,
Daniel C. Stump and Richard C. Seguso. Members Robert F. Selby and
Benjamin Cohen were absent.
Also present were Town Attorney Carol Sullivan and members of the
general public.
Petition 7-92-46. Submitted by Trottco Enterprises, Inc. Seeking
Relief for Extension of Existing Second Story Bedroom over Existing
Coastal Construction Control Line at 3921 South Ocean Boulevard, Lot
55E. Town Code Chapter 30, Section 6.5A (Non -Conforming Structure).
Chairman Cohen advised the members and Town Attorneys (Thomas E. Sliney
and Carol Sullivan) had inspected the site during the August 4 Workshop
meeting. It was determined that the legal ads required for today's
Public Hearing had been properly published; however the certified
mailings required a statement from Michael Trotto, who was present as
representative of the project. He was sworn in and told the members
that the certified receipts for mailings to neighbors within 300' were
not in the file folder he had brought to the meeting and a call to his
office did not turn them up; also the secretary who did the mailings
did not report to work until 2:00 PM, so there was no way to question
the matter further at this time. After some discussion, the members
agreed that if anyone who received a notice objected to the project,
they would be present at this hearing; therefore, on advice from Ms.
Sullivan that they could do so, it was their consensus to proceed with
the hearing.
Mr. Trotto repeated the reasons the variance was requested, i.e., to
expand an existing bedroom into an exercise room on advice from the
owner's physician; it was the only room in the house suitable for such
a renovation. He also referred to correspondence from the Department
of Natural Resources which waived permitting on any work done within an
existing footprint, which this would be.
Discussion followed, including the fact that this structure was non-
conforming only because of the imposition of the CCCL by the State of
Florida, but according to our ordinance could not be expanded or
altered because it was non -conforming.
Discussion concluded with the consensus of the members being that
granting the variance would not invade the intent and purpose of the
Town's ordinance, and upon MOTION by Mr. Stump/Mrs. Rayner it was
