CALL TO ORDER: Deputy Town Clerk Cuebas called the Regular Meeting to order at 2:00 PM. Roll call was taken, followed by the Pledge of Allegiance. PRESENT UPON ROLL CALL: Board Member Jack Halpern Board Member Myles Schlam Board Member James "Jim" Karabec Board Member Jane Perlow Vice Chairperson Thomas "Tim" Burnich Town Attorney Leonard Rubin Deputy Town Clerk Terisha Cuebas MEMBERS ABSENT: Chairperson Paul Resnick 2. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA: MOTION: Member Karabec moved to accept the agenda as presented. Member Halvem seconded the motion, which passed unanimously. 3. PUBLIC COMMENTS AND REOUESTS: There were no public comments. Code Enforcement Board Regular Meeting Minutes Tuesday October 23 2018 Paee 2 of 4 4. PRESENTATIONS: A. None. 5. APPROVAL OF MINUTES: A. September 26, 2018 — Organizational Meeting MOTION: Member Halpern moved to accept the minutes of September 26, 2018 as presented. Member Perlow seconded the motion, which passed unanimously. 6. OLD BUSINESS: A. None. 7. NEW BUSINESS: A. Review and Discussion Regarding Beach Raking Proposed Ordinances: 1. Manual Beach Raking 2. Mechanical Beach Raking Town Attorney Rubin presented this item, providing background information into how the item came before the board. He outlined the Town's, Department of Environmental Protection (DEP) and the Florida Fish and Wildlife Conservation Commission (FWC) current codes and requirements with regard to beach raking. The Board was presented with two proposed ordinances; one that allows hand raking only and one allowing mechanical raking which would require a permit and contains more comprehensive regulations. Member Halpern provided comments with regard to the discussion at the Natural Resources Preservation Advisory Board and that the Board recommended mechanical beach raking as opposed to hand raking. He mentioned that the Town has no public beach access and hand raking could be a potential issue regarding the removal of debris from the beach. Discussion ensued with regard to beach access, the financial responsibility of beach raking, protection of the sea -turtles during nesting season, the process of special assessments, and the possibility of surveying the residents for their opinions. Vice Mayor Nila provided comments with regard to the lack of language regarding beach raking in the Town's Code of Ordinances, current practices of beach rakers and the regulations imposed by the Florida Department of Environmental Protection (DEP). Code Enforcement Board Regular Meeting Minutes Tuesday October 23 2018 Page 3 of 4 Board members provided comments and recommendations to include language in the Town's Code of Ordinances that mirrors the Florida DEP. Town Attorney Rubin advised that the Town would still require its own separate permitting process. MOTION: Member Perlow moved that the Town should comply with the Florida Department of Environmental Protection (DEP) regulations with regard to beach raking, establish a Town of Highland Beach permit and provide proper insurance and allow mechanical raking. Member Halpern seconded the motion. UPON ROLL CALL: Member Perlow -Yes Member Halpern -Yes Member Schlam -Yes Member Karabec -Yes Vice Chairperson Burnich -Yes Motion passed on a 5-0 vote. 8. ANNOUNCEMENTS: A. Deputy Town Clerk Cuebas advised there is a vacancy on the Code Enforcement Board for a full three-year term. The Board also came to a consensus to have Code Enforcement Board regular meetings on Tuesdays at 2:00 PM, as the designated day of the month. Vice Chairperson Bumich requested a list of the upcoming meetings for the next year. Deputy Town Clerk Cuebas advised a list of proposed/tentative meetings will be provided with the next agenda packet. Town Attorney Rubin advised the Board that once the code citation ordinance is drafted it will come back before the Code Enforcement Board for recommendation to the Town Commission. 9. ADJOURNMENT: There being no further business, Vice Chairperson Bumich called for a motion to adjourn the meeting at 2:34 PM. MOTION: Member Halpern moved to adjourn the meeting at 2:34 PM. Member Schlam seconded the motion, which passed unanimously.
