2009.04.15_CEB_Minutes_RegularTOWN OF HIGHLAND BEACH CODE ENFORCEMENT REGULAR MEETING MINUTES Wednesday April 15 2009 9:30 am. Members Present: Chair Paul Resnick; Vice Chair Lori Wolin; Secretary Frank Colarullo; Board Member Eugene Diliberto and Board Member Jack Halpern. Also Attending: Town Attorney Larry Corman; Acting Building Official Tom Forbes; Building Official Geoffrey Vanore; Deputy Town Clerk Valerie E. Oakes and members of the general public. 1. CALL TO ORDER Chair Resnick called the Regular Meeting to order at 9:30 a.m. Roll call was taken by Deputy Town Clerk Oakes. The Pledge of Allegiance followed. 2. There were no addition or deletions made to the 3. PUBLIC COMMENTS AND REOUESTS: No one from the general public had comments or requests. 4. There were no presentations made at the meeting. 5. APPROVAL OF MINUTES: MOTION: Board Member Halpern moved to approve the minutes of February 18, 2009. Secretary Colarullo seconded the motion, which passed unanimously. MOTION: Board Member Halpern moved to approve the minutes of March 18, 2009. Vice Chair Wolin seconded the motion, which passed unanimously. 6. PUBLIC HEARING Case No. 2008-08 Villa Costa Condominium Association 3210 South Ocean Boulevard, Penthouse #5 Highland Beach, FL 33487 Violation Florida Existing Building Code Chapter 6 Article 3 Section 603.2.1 — The vertical ventilation shaft passing through all floors is required to be fully enclosed per the Florida Fire Prevention Code. The portion of said shaft passing through the master bedroom area of penthouse #5 is not fully enclosed on the side exposed to said bath interior. Code Enforcement Board Wednesday April 15 2009 Page 2 of 3 Tom Forbes, Acting Building Official for the Town of Highland Beach through contract bases, with Independent Inspections, Ltd. was sworn in by the Deputy Town Clerk. Acting Building Official Tom Forbes reported that the on the 2e day of January, 2009 Dan Divan, Code Enforcement Officer of the Town of Highland Beach, Florida personally examined the property and found the property to be in compliance with Section 603.2.1 Florida Building Code. MOTION: Board Member Halpern moved to dismiss the case against Villa Costa. Secretary Colarullo seconded the motion, which passed unanimously. Case No. 2009-01 4521 South Ocean Blvd., LLC 4521 South Ocean Blvd. Highland Beach, FL 33487 Violation Chapter 17, Section 17-3 and 17-4; Nuisance Acting Building Official Tom Forbes presented the case and evidence. The property is a nuisance from yard debris, roof leakage, grounds unmaintained and the list goes on. MOTION: Board Member Halpern moved to impose the maximum fine of $250.00 per day effective upon receipt of the notice by 4521 South Ocean Blvd., LLC and in addition commence as soon as possible for the Town to implement boarding up the facility. The Findings of Fact of the property as depicted in the photo constitutes a nuisance as defined by the Town's Code. Secretary Colarullo seconded the motion, which passed unanimously. OLD BUSINESS: There were no items. NEW BUSINESS: Town Attorney Larry Corman mentioned the notice on the bulletin board regarding the ordinance to have the obstructions on AIA removed. The Town Attorney recommended that the board should look at the notice since they are recommendations they had made to the Town Commission, which passed. ADJOURNMENT: MOTION: Board Member Halpern moved to adjourn the meeting at 10:15 a.m. Board Member Diliberto seconded the motion, which passed unanimously.
