Chairman Boscove called the meeting to order at 7:35 p.m., advising this was a workshop meeting of the Planning Commission to discuss revisions to the Zoning Ordinance, #336. The Agenda is Attachment "A". The recording secretary called the roll. Present: C. B. Blankenship, N. M. Johnson, J. A. Boscove, W. Bonny, F. Hamzik (Building Official). Absent: R. B. Myers, J. M. Farrin, L. O. Edlund Mr. Blankenship noted he had addressed the Town Council at a recent meeting regarding the interpretation of the Zoning Code, specifically Sec. 13.2, Attachment "B". Mr. Blankenship indicated he had referred this section to the Town Commission, in connection with the application for approval of plans made by Park Tower Development Corp. for Lots #92, 93 and 94. At Chairman Boscove's request, the recording secretary read the letter dated May 22, 1979, from Town Manager E. W.Roberts, to J. A. Boscove, Chairman of the Planning Commission, Attachment "C", and the letter to the Planning Commission, from E. W. Roberts, dated May 30, 1979, Attach- ment "D". Mr. Blankenship noted the section referred to should read "Para. 16 of Sec. 4.4.".(e) Chairman Boscove read from Sec. 4.4 (10),"Maximum building height. One hundred ten (110) feet. Building height may be increased to one hundred twenty (120) feet where one story parking structure is located throughout the area beneath the principal building or to one hundred thirty (130) feet where two (2) stories of parking are provided as above;" Mr. Hamzik illustrated possible variations in the location of that portion of the parking area which is required to be 'under the principal building'. Mr. Hamzik indicated if the foundation slab for main structure and for parking area is contiguous, the parking area should be considered to be under the principal structure. Mr. M. Dent, in audience, noted that Sec. 13.2 of Ord. #336, reads "Where a structure is attached by a wall or walls to the principal building, it shall be considered a part thereof, and not an accessory building." Following a discussion of Sec. 13.2, Chairman Boscove recommended this section be changed to read "attached by a wall, walls or foundations". Members present agreed following examination of Sec. 4.4.(e) (16) that the line reading "All other requirements must be met." should be deleted and the paragraph included in both RMM and RML2 Districts. Recommendation was made to remove the word "pool" preceding "decks" in Sec. 5.3 (c) (Accessory Uses and Structures).
