2007.08.22_PB_Minutes_Special,;~ TOWN OF HIGHLAND BEACH PLANNING BOARD SPECIAL MEETING MINUTES Wednesday, August 22, 2007 9.30 a m Vice Chairman Louis Stern called the Regular Meeting to order in Commission Chambers at 9:30 a.m. Present were Vice Chair Louis Stern, Ken Tapman, Joe Yucht and Marie Marchesani. Chairman Townsend, Patricia Pembroke and Kurt Kalberer were absent. Also present was Town Attorney Tom Sliney, Building Official Bob Dawson and members of the general public. NEW BUSINESS DEMOLITION OF BOXWOOD TERRACE, 4215 S. OCEAN BLVD. CONSTRUCTION OF TWO NEW THREE UNIT BUILDINGS. NEW NAME TO BE OCEAN PLACE VILLAS. APPLICANT/OWNER: BOXWOOD CONDO -NORM HANSEN, PRESIDENT. Attorney Sliney noted that the Planning Board acts in an advisory capacity to the Town Commission who will make the final decision. Recording Secretary sworn in all who would be testifying. • AI Giachetti, developer and one of the new owners, gave a presentation to the Board on the project. He noted that he has received Departmental of Environmental Protection (DEP) permits, and the final order that he may proceed with plans. The dune will be raised to 19 1/2 feet which is the same height as the South neighbor's dune. The North neighbor's dune is 21 feet of which his property at that side is already at that height. Mr. Giachetti passed out photos of the dunes and other properties in town reflecting stairs built on the dune. Each unit will be 5,000 sq.ft. of air conditioned space, 5,800 sq.ft. including the garage. The pools will be splash pools (12x12) and will be constructed on pilings. He passed out photos of other modern homes in Highland Beach. Mr. Jay Salaski (sp), one of the owners of the property, currently lives in Miami plans on moving into one of the residences, as does Mr. Giachetti and two of the other property owners. The remaining other two units will be placed for outside sales. Beverly Knight, representing Jean Ellis, the property to the North, expressed Mrs. Ellis' concerns on the architecture of the buildings, as does Mr. Patek, owner to the South. Their concerns were the modern design of the house with other homes in the area being Mediterranean style; the placement of the front entrance ways on the two end units, and concern of the dunes being able to support six pools; and the driveway parking arrangement. Resident Rick Jones, 4307 S. Ocean supports the project, noting it will be a major improvement over what is there now. He also noted that the pools will not extend any further than the old Boxwood buildings, therefore will not damage the dunes. After further discussion, the following MOTION was made by MR. YUCHT/MS. As the owner of 4201 South 8/20/200'7 Page 2 of 3 Ocean Boulevard, I have grave concems regarding the future development of Boxwood, not only structurally, but also environmentally. My property is fortunate that it has shoreline limestone rock which protects the dune, • however Mother Nature redirects the waves of high tide around these rocks and backlashes it up onto Boxwood's property, taking with it sand, and dune dirt, season after season. Thirty years ago, the Boxwood dune was completely washed out exposing the remains of a wooden sea-wall. Following this, there have been three attempts to rebuild the dune. With the first, sand was "pumped" into massive large black woven, plasto-like fiber bags; remains of the bags are still visible today on the beach. For the following two attempts, sand that resembles dirt, was "trucked in". Sea oats were planted on this dirt-sand, and was also a failure. These attempts were not ony unsuccessful, but have also affected our endangered sea turtles. (See pictures attached) I can't even imagine 6 individual swimming pooh way out on the dune, one for each of the proposed 6 units. And that is beyond (eastward) of where the existing structures are now. For more than eleven years I was a volunteer for the Highland Beach turtle patrol, keeping records of nestngs, hatchings, etc. for a section of the beach, these recoMs went on to Tallahassee. The beach at 4215 is already too narrow for nesting; the nests laid on the man-made "dirt" dune do not hatch, and after Wilma, the dune was too steep for turtles to climb. Many times, turtles dig and hit the hard black bags remaining from years ago. I no longer live on the beach as I have grown too crippled to patrol. And I miss it. My home is currenty for sale and the design of the proposed multi-family buildings have directly affected my resale value, which in turn affect the surrounding properties. I will have Beverly Knight give you a copy of my "Petition For Mediation" with the State. This Petition expresses my concerns with the State regarding the proposed Buildings at 4215 S. Ocean Blvd. and reiterates my concerns stated in this letter. I am in agreement with Mr. Bob Patek, my neighbor to the south of Boxwood, that other concerns are the style of the buildings, the overall height, and the structures proposed to be buiR in the side lat setback: • 1. I do no believe that Boxwood's dune can support the six proposed swimming pools, one for each of the 6 units eastward of where the existing structures are now. 2. The 1950's "South Beach" deco/modern style square-box buildings are non-conformins~ to our "new" construction here, and violates the standards and quality of construction that best exemplifies the Boca/Palm Beach/Mizner flare with sloped file roofs and stately details that represent our beautiful Town of Highland Beach. 3. The height of the buildings with the increased building and dune elevations may end up exceeding the height of the new houses to the north and south with the consideration of the flat roof patos verses the sloped tle roof. 4. There should be no side "main entries" or entry stairs in side 12-foot setbacks or window eyebrows extending or built in the setback, directly facing the properties to the north & south. Currently, the dune is stable at its current elevation, which is slightly lower than my property for approximately 25 feet west of the top of the dune. At approximately 25 feet the two properties are at the same elevation and at that elevation i have all my pool equipment along with one air conditioning compressor and electric subpanel for the equipment. My concern is water run off onto my property and the trapping of water in my lower equipment area, which is bordered on three sides by walls and the forth side by Boxwood. Also, the current privacy wall between the properties at the street elevation, which by easement 1 must maintain, was not designed to be a retaining wall for the raised elevation that is planned. Currently, Boxwood and my property are at the same elevation on both sides of the privacy wall and slightly above street level. 2. 1 do not like the idea of an entry facing my house and motor court. The plans show entrance stairs and entrance deck along with concrete eyebrows over windows built in the 12 foot side lot setback. If they proceed with the south entrance i would like to see the building moved north the width of the stairs, deck and/or eyebrows bo maintain the side lot setback at 12 feet. 3. The dune behind both Boxwood and my two houses is extremely fragile and we lose most of it during a severe storm and have to replace it on a regular basis. The dune at its current height and distance from the control line is typically cut back to a shear cliff of sand. The State has permitted the placement of swimming pools to within feet of the dune cliff, after a storm, and allowing for sand flII some 60 feet out on the beach, which would allow Boxwood to dump sand into the ocean. Any addition, extension, and/or landscaping of the dune past the present distance from the control line and the current slope will go away during the next tropical storm or in the November high tides and/or could cause more then • normal erosion and dune loss to my property by diverting the waves and tide. STATEMENT OF RULES: The rule of common sense. STATEMENT OF RELIEF: 1. The elevations must blend with the adjacent properties and not cause any hardship or problems to the existing patios, landscaping, equipment and structures. 2. The buildings must be built to the current code and zoning with no variances allowed. 3. The dune should not be extended any further east. There shall be no variances permitted. There are only single family homes to the north aid south of Boxwood and it is my wish that the Villas do not stand out as multi-family. My biggest concern is the dune, and that whatever is built will not increase the ehance of additional dune loses and the undermining of my pool aed home. Boxwood Terrace's 200' and the 300' to the soh ~ extremely anique to the rest of Iighland Beach's ocean front property in that the reef iti front of the properties ceases these properties great harm requiring the property owners to heal in sand and rebind the done after any major storm or an an average of every two years. Houses to the north and south of these properties do not have the same problem and several of them have seawalls. As I write this letter the waves are capping at my done and within 20' of my back door. To protect these properties and aiy new constriction a seawall should be built.
