2007.11.14_PB_Minutes_RegularTOWN OF HIGHLAND BEACH PLANNINGING BOARD REGULAR/PUBLIC HEARING MNIUTES November 14 2007 9:30 a.m. Chairman Louis P. Stern called the Planning Boazd to order in Commission Chambers at 9:30 a.m. In attendance were Chair Stern, Vice Chair Joseph Yucht and Members Patricia Pembroke, Ken Tapman, Mazie Mazchesani and Kurt Kalberer. Max Angel was absent. Town Attorney Thomas E. Sliney and Building Official Bob Dawson were also present, as well as members of the general public. Chair Stern asked to change the order of the agenda and place the marine committee discussion at the end of the meeting. Motion by Ms. Mazchesani/Mrs. Pembroke approved change in order of agenda. APPROVAL OF IYIINUTES Upon Motion by Mr. Yucht/1VIrs. Pembroke, the Minutes of the October 3 Regulaz Meeting were unanimously approved. NEW BUSINESS FINAL REVIEW FOR A NEW DRIVEWAY FOR PROPERTY LOCATED AT 2540 S. OCEAN • BLVD. OWNER: BEN YOMTOB. Mr. Peter Camarco, representative for the Owner, Mr. Yomtob, presented application to the Board. He noted that the home currently has a large single drive and wants to enlazge it to a two car driveway, made with liverock and pavers. He has already obtained the DOT permit. Mr. Camazco noted that the pavers will stop at the bike path. Mr. Dawson noted that the applicant said that the plans meet the Town requirements, pending other government approvals, of which have now been obtained with the DOT permit. With all questions answered, the following MOTION was made by MS. MARCHESANUMR. TAPMAN as follows: THE PLANNNG BOARD GRANTS FINAL APPROVAL FOR A NEW DRIVEWAY FOR PROPERTY LOCATED AT 2540 S. OCEAN BLVD. OWNER: BEN YOMTOB. MOTION carried unanimously. PUBLIC HEARING Consideration of the application of Boca Dock & Seawall for installation of a boat lift for property located at 1118 Bel Air Drive, Bel Lido. Owner: Triplex Investment, LLC. Applicant: Boca Dock & Seawall. Recording Secretary noted for the record that all advertisinglcertified mailing requirements had been met. • • Planning Boazd November 14 2007 Page 2 of 3 Ken Wells with Boca Dock & Sewall, representing Mr. Sacks, presented application to the Boazd. Noting that the lift will be parallel to, and attached to the existing dock. The 17,000 lb. lift can accommodate a vessel of 30-34 feet. When boat lifted, keel will be no more than one foot above seawall. Resident Joseph Cary, 1115 Russell Drive and owner of 1110 Russell Drive, expressed that he did not have a problem with the lift being installed. Kathleen Eibl von Rospeunt, 4502 S. Ocean Blvd., noted that she did not receive a notice of the hearing, and noted that she is against the installation (her correspondence is in the applicant's file). Mr. Graham Guthrie of 4500 S. Ocean Blvd. who lives immediately adjacent to the property is against the lift, as it is in direct view from his living room, blocking the view of the waterway (correspondence in applicant file.} JoAnn Rajski, 4420 S. Ocean Blvd. ,who was not at the hearing but sent correspondence, (correspondence included in file) is against installation of lift as a distraction to the beauty of the waterway. • There was also correspondence from resident Sadie Spadafina, 1105 Russell Drive, expressing objection to the boat lift installation (correspondence in applicant file). After further discussion the following MOTION was made by Mr. Tapman to approve installation of boat lift. There was no second to the motion. Mrs. Pembroke/Ms. Mazchesani made MOTION to deny installation of a boat lift at 1118 Bel Air Drive. The following roll call vote was taken to DENY application: Mr. Kalberer yes Ms. Mazchesani yes Mr. Tapman no Mrs. Pembroke yes Mr. Yucht yes Mr. Stern yes Motion passed 5/0. NEW BUSINESS (con't) PRESENTATION OF POTENTIAL CHANGES TO ZONING CODE RE MARINE ISSUES (Committee Ad Hoc report) Committee member George Bazlow, 1084 presented report to the Board (report attached.) He noted the committee member was: Ken Wells, Ron Gazell, Joe Bosco, Jerry Marshall and Lou Stern. C7 Planning Board ~ November 14, 2007 Page ~ It was noted that when "boats" are mentioned in the report, the wordage should also include "personal watercraft", to also include jet skis, canoes, etc. Also, floating dockage for watercraft generally extends past the minimum requirement of 5 feet out from dock. Committee members plan on having ongoing committee meetings, and were told to hold them at Town Hall, have the meetings posted and have a recording administrator present to take minutes.
