REGULAR MEETING MINUTES
Wednesday, November 8 2006 9:30 a.m.
Chairman Leonard O. Townsend called the Regular Meeting to order in Commission
Chambers at 9:30 a.m. Present were Chair Townsend, Ken Tapman, Louis Stern, Victor
Hadeed, Leonard Bell, Marie Marchesani and Patricia Pembroke. Also present was
Town Attorney Larry Corman and Building Official Bob Dawson.
APPROVAL OF MINUTES

Chairman Townsend noted several "housekeeping items".
1. Discussed with Mr. Dawson of a submission to tighten up on the deadline dates for
submission of applications to the Planning Board. Chair is also requesting that 11x17
plans be submitted if possible, but 8.5x1.1 is fine if legible.
2. Appointment of a vice Chair -Nomination made by Mr. Stern to appoint Mr. Tapman
for the December meeting only.
NEW/OLD BUSINESS
FINAL REVIEW FOR NEW SINGLE FAMILY RESIDENCE FOR PROPERTY LOCATED
AT 2545 S. OCEAN BLVD., LOT 15 & 15A. OWNER: CAROL S. PARKS;
APPLICANT: JOHN CONWAY.
Chairman Townsend read into the record the particulars for the two properties obtained
from the Property Appraisers office. He noted that the two lots are across the street
from one another. Lot 15 is on the East side of A1A of which the applicant wishes to
construct a house, and 15A is on the West side of A1A of which applicant wishes. to
construct a gazebo and deck which is an accessory structure. A Unity of title is needed
for the properties if the gazebo. is built, therefore the project can be approved, but a
building permit cannot be issued until a unity of title is obtained.
Mr. Conway asked to go for approval for the residence and table the vacant lot across
the street. Anything on 15A is purely advisory - Mr. Corman stated that the applicant
can withdraw 15A and the Board can approve the house on 15, but be aware when
applicant comes back for 15A there will be a recommendation from this Board that there
will have to be a unity of title and must be approved by the Commission. 15A is zoned
RS (residential single family). Theoretically the applicant could build on or sell the lot
to a third party which eliminates the accessory use and the whole unity of title
disappears. Applicant will withdraw 15A.

ELIMINATED FOR THE BOARD'S CONSIDERATION AT THIS DATE. A
SET OF PLANS PREPARED UNDER THE DIRECTION OF JOHN D.
CONWAY, INC. (SHEETS L01, LOZ, etc.). WITH PROPOSED
AMENDMENT.
MOTION carried unanimously.
FINAL REVIEW FOR NEW SINGLE FAMILY RESIDENCE FOR PROPERTY LOCATED
AT 3901 S. OCEAN BLVD., LOT 0150. OWNER: 3901 DEVELOPMENT, LLC.;
APPLICANT: SEADAR BUILDERS.
Chairman Townsend read the particulars of this property into the record. He noted that
the house across the street was approved by this board several months ago. What-was
approved on this location at that time, was a construction trailer for the house across the
street. This new house is for a three story built on piles. Plans meet Town of Highland
• Beach zoning requirements, yet approvals are pending with other governmental
agencies. The roof deck at 2500 sq.ft exceeds the allowed 250 sq.ft. and can't be
covered, yet the deck is below 35 feet. The question is, can this. be allowed as it is
below the 35 feet.
After further lengthy discussion, the following MOTION was made by MR.
BELL/MR. HADEED to TABLE application pending .receipt of advisory opinions
from Mr. Dawson and Town Attorney Sliney or Corman as to what the code
requires. The question is, can an approx 2500 sq.ft of observation deck including
portions covered by a roof, may be installed below the max height restriction of
35 feet.
Motion carried unanimously.
PRELIMINARY REVIEW FOR 12,000 LB., FOUR POST BOAT LIFT FOR PROPERTY
LOCATED AT 1107 RUSSELL DRIVE #A, LOT 17. OWNER: JOSEPH P. CORY.
APPLICANT: BOCA DOCK & SEAWALL.
Applicant is requesting pilings be placed perpendicular (75 degree angle) from dock,
extending out approximately 29 feet. Except for the homes at the end of the canal, all
are parallel to dock. Homeowners are trying to obtain more space as it is difficult to
maneuver boats for parallel dock parking. Attorney Corman noted that according to
Town code, the Town Commission will ultimately make the final decision. During

discussion, question arose as to whether this is a navigational hazard, will this set a
precedence for other perpendicular docking requests. Board felt that anything 45
degrees or less is considered parallel docking, 45 degrees and above is perpendicular.
Applicant was asked to obtain an expert opinion as to whether this is considered
perpendicular docking at 75 degrees, or not. After further lengthy discussion, the
following MOTION was made by MR. TOWNSEND/MRS. PEMBROKE:

APPLICANT: HARBORSIDE BUILDERS.
Chairman noted that this application came before the Board at the October Regular
meeting, but was not approved, as it appeared the space was more than the 1,000 sq.
ft. allowed by code for habitual space. Architect revised the plans to 1,000 sq. ft.
for the 2nd floor living area. After some further discussion, the following MOTION
was made by MRS. PEMBROKE/MR. STERN:
