• CODE ENFORCEMENT BOARD
REGULAR MEETING - MINUTES
Tuesday, January 20, 1993 10:00 A.M.
Chairman Victor P. Hadeed called the Regular Meeting to order in Com-
mission Chambers at 10:00 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Ellen B. Gerber and Members Merton Rubin,
Horace Leng, Arthur Hamerman, David Augenstein and Joseph A. Sarubbi.
Also present were Building Official/Code Enforcement Officer Lee
Leffingwell, Town Attorney Carol Sullivan and members of the general
public.
Chairman Hadeed again welcomed new Member Joseph A. Sarubbi and
Attorney Carol Sullivan; he also thanked Ted Boepple for his service to
the Board, noting that Mr. Boepple had declined reappointment.
Upon MOTION by MR. LENG/MR. HAMERMAN, the Minutes of the Workshop and
Regular Meetings of December 16, 1992 were unanimously approved.

There was no one to speak to either Citation in the audience and upon
MOTION by MR. AUGENSTEIN/MR. SARUBBI, it was the unanimous vote of the
members to defer any action until such time as the owner of record
could be determined.
Citation 2340-92. Harvey McClintock, c/o Southern Const. & Maint. re
1005 and 1016 Royal Cove Dr. and 19 Vacant Lots on Royal Cove Dr.,
Chapter 13, Sec. 1 through 3A, 4, 5, 6.
and
Citation No. 2340-A-92. Christine Beams, Real Estate Dept., Boca Bank
re 1005 and 1016 Royal Cove Dr ., Lot 2A N, Dev. Lots 5 and 16. Chapter
13, Sec. 1 through 3A 4, 5, 6.
Harvey McClintock and Ms, Leffingwell were sworn in and Mr. McClintock
addressed the members regarding the empty lots, noting the complicated
circumstances involved. He said a loan was arranged through Bell
Savings and Loan in November 1989 and shortly thereafter a deal was
entered into with First Development Corporation of Esplanada, who

subsequently defaulted. He further noted that Bell Savings & Loan had
been taken over by the RTC and their dealings with the RTC regarding
the property had rapidly deteriorated. He said he was not sure if
the RTC had taken title to the property, but noted he was still
interested in taking over the project and was trying to find the RTC
asset manager in charge in hopes of extending or re-doing the loan;
since the local RTC contacts he had previously dealt with had moved
from the area, his attempts to deal with the RTC had. been futile.
In response to questioning, Mr. McClintock said that technically, at
this time, the property owner(s) of 18 vacant lots, out of 21 original
lots, was Royal Cove Joint Venture, of which he was a Managing Partner.
He said he supposed the other two (2) lots where existing homes were
constructed were technically owned, although he noted he was not sure
in what legal order, by Boca Bank (who gave construction loans), with
RTC in second position because they gave a $800,000 subordination, and
finally First Development Corporation of Esplanada technically holding
title but they are in default. Mr. McClintock also noted a third lot
(No. 15} owned by Steven Williams.
Christine Beams of Boca Bank's Real Estate Department was then sworn in
and addressed. the Board. She said their loan was to First Development
of Esplanada and the bank was in the process of foreclosing. She fur-
. ther stated that all dealings had been through First Development's at-
torneys, whose names had been previously furnished to the Town. As
regards a local address for First Esplanada, she stated she was only
aware of a Post Office box number.
Concluding presentations, and based on testimonies given re owner(s) of
record, MR. AUGENSTEIN/MR. HAMERMAN made the following MOTION, which
met with unanimous favorable vote:
THE CODE ENFORCEMENT BOARD WILL ISSUE NEW CITATIONS
TO THE OWNERS OF RECORD RE CITATIONS 2340-92 AND
2340-A-92 AS FOLLOWS:
(1) ROYAL COVE JOINT VENTURE (18 EMPTY LOTS)
(Z) FIRST DEVELOPMENT CORPORATION OF ESPLANADA
TWO (2) LOTS WITH EXISTING HOUSES
(3) STEVEN WILLIAMS (LOT 15)
At this time, Ken Sharp (Citation 2338-92) had arrived at the meeting
and asked to be heard. Being sworn in, he said within two (2) weeks
the violations would be corrected because he now had the finances to do
so. In light of this testimony and upon MOTION by MR. HAMMERMANJMR.
RUBIN, it was again unanimously voted to defer any action until the
February meeting.

Sharp further stated there is a
general partner of the limited

Mr. Sharp noted that Highland Beach
(5) units, which are subject to FDIC

There being no further business to come before the Board at this time,
the meeting was adjourned upon MOTION by MR. LENG/MR. RUBIN at 10:32
