CODE ENFORCEMENT BOARD
WORKSHOP - MINUTES
Wednesday, February 17, 1993 9:30 A.M.
Chairman Victor P. Hadeed called the Workshop Meeting to order in Com-
mission Chambers at 9:30 A.M.
Deputy Town Clerk Doris Trinley called the roll. Present were the
Chairman, Vice Chairman Ellen B. Gerber and Members Merton Rubin,
Horace Leng, Arthur Hamerman, David Augenstein and Joseph A. Sarubbi.
Town Attorney Carol Sullivan and Building Official/Code Enforcement
Officer Lee Leffingwell were also in attendance, along with members of
the general public.
OLD BUSINESS
Citation 2338-92. Ken Sharp/Highland Beach Dr. Assoc. re 1119 and 1123
H g an Beac Dr. Chap. 13, Sec. 1 and 3; Chap. 25, Sec. 1;
Chap 17, Sec. 3
Ms. Leffingwell advised Mr. Sharp had come into partial compliance in
• that he had trimmed trees over the road and made arrangements with a
unit owner, Lisa Wagner, to keep the pool in good condition. He had
not removed tree limbs from roofs or repaired roofs where necessary.
Citation 2339-92. Richard Mendelson re 1124 Highland Beach Dr ., Block
2, Lo 8, Be Lido. Chap. 17-2 and 6-30(b) [Nuisances & Buildings &
Structuresl.
It was noted that action on this Citation had been deferred at the
December meeting until this time. Ms. Leffingwell reported that Mr.
Mendelson had not gone before the Planning and Community Appearance
Boards during January, as he had indicated he would, but had recently
picked up a permit application.
Citation 2340-92. Royal Cove Joint Venture, Narvey McClintock, Managing
Partner, c/o Southern Const. & Maint. re All Vacant Lots on Royal Cove
Dr. except Lot 15. Chap. 13, Sec/ 1 thru 3A, 4,5,6 [Land Clearance].
Attorney Sullivan said she had tried to locate the owner of record
through a title search; however, she was unable to do so because the
legal description of the parcel is in metes and bounds and it was ex-
tremely difficult to determine exactly what lots were owned by Royal
Cove Joint Venture.
When asked if it would be possible for the Town's Maintenance Depart-
ment to clean up the parcel, Attorney Sullivan said permission from the

owner would be necessary and that only in the case of emergency could
the Town take action in this way.
Ms. Leffingwell reported that Notices of Violation had been sent out
regarding the North Marina, which is part of Royal Cove Joint Venture.
She said it had been discovered that it was built without a permit and
is, therefore, illegal.
For the record, Chairman Hadeed noted that Member Arthur Hamerman had
signed a Voter Conflict form and would not take part in any vote
regarding Royal Cove Joint Venture that might come about at the Regular
Meeting today.
It was requested of Attorney Sullivan that she check to see who pays
the taxes on these parcels and when they were last paid.

Citation 2340-B-92. Royal Cove Joint Venture, Tony Magri, Managing
ar ner an Presi ent of First Development Carp, of Esplanada re Lot
2A N, Dev. Lots 5 & 16 (1005 & 1016 Royal Cove Dr .) . Chap. 13, Sec.
3A,4,5,6 [Land Clearance].
• Discussion centered on the fact that Boca Bank was in the process of
foreclosing on these properties and the time element involved in the
process. Notation was made of a letter received from First Development
of Esplanada which stated that the corporation had resigned as a
Managing Partner of Royal Cove Joint Venture in th fall of 1991.
Citation 2340-C-92. Stephen Williams, 4748 S. Ocean Blvd., #11-B re Lot
15, Roya Cove Dr ., Chap. 13, Sec. 1 thru 3A,4,5,6 [Land Clearance].
Ms. Leffingwell said Mr. Williams had been most cooperative and would
address the members during the Regular Meeting to explain what his
plans were for Lot 15.
Citation 2342-93. Michael Walsh, President, Ocean Properties re
Holiday Inn Lots 114 & 115 West. Chap. 6, Sec. 130 [Maintenance of
Seawall.
Ms. Leffingwell explained that the seawall on the Intracoastal side, of
the Holiday Inn property is in a deteriorated condition, which has
created problems in the parking lot. She said there has been no re-
sponse to the Citation at this time.
There being no further business to come before the Board at this time,
the meeting was adjourned upon MOTION by MR. AUGENSTEIN/MR. HAMERMAN
at 9:55 A.M.
