Stern, Board Member Max Angel, Board Member Beverly Knight, Board Member Patricia Pembroke, and Board Member Dennis Sheridan. Members Absent: Vice Chair Joseph Yucht (excused) and Board Member Paul Resnick (excused). Also Attending: Town Attorney Tom Sliney, Deputy Town Clerk Valerie E. Oakes and members of the public. CALL TO ORDER: Chair Stern called the Regular Meeting to order at 9:30 AM. Roll call was taken by Deputy Town Clerk Oakes. The Pledge of Allegiance followed. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA: • Chair Stern asked that items six and seven be eliminated from the agenda. MOTION: Member Sheridan moved to approve the agenda with changes. Member Angel seconded the motion, which passed unanimously. PUBLIC COMMENTS AND REQUESTS: None. PRESENTATIONS: No presentations. APPROVAL OF MINUTES: MOTION: Member Angel moved to approve the minutes from the November 12, 2009, Regular Meeting. Board Member Pembroke seconded the motion, which passed unanimously. OLD BUSINESS: • None. Planning Board Regular Meeting 12/9/09 Page 1 of 3 • NEW BUSINESS: A. 2540 S. Ocean Blvd., Brian Prince Per the Town Attorney's review of the historical files of boatlifts, public Hearings are required for boatlifts installed on the canal, but there are no regulations for those installed on the Intracoastal Waterway. According to the Building Official, the plans do meet the Town of Highland Beach Zoning Code. Jerry Whitten of Broward Pili~ - Installing a 20,000 lb beamless boatlift that could fit a 30-foot long boat. Chairman Stern called for a motion that the Planning Board, since they do not have the authority to approve the application because the Town does not have regulation over the Intracoastal Waterway, sends the application back to the Building Department for finalization. MOTION: Member Sheridan moved to send the application back to the Building Department for finalization. Member Angel seconded the motion, which passed unanimously. B. Election of Officers: 1. Chairman • 2. Vice Chairman MOTION: Member Pembroke moved to delay the election of officers until there is a full compliment of board members in attendance. Member Knight seconded the motion, which passed unanimously. MOTION: Member Angel moved to have Lou Stern serve as Chairman until Apri12010. Member Sheridan seconded the motion, which passed unanimously. C. PUBLIC HEARING: Public Hearing opened at 9:44 a.m. There was no one from the public to comment on the zoning code text amendments. MOTION: Member Pembroke moved that the Planning Board of Highland Beach accept the potential zoning code changes and forward to the Town Commission. Member Sheridan seconded the motion, which passed unanimously. Chair Stern asked that the Deputy Town Clerk draft a letter for the Chairman's signature to transmit the documents to the Town Commission. MOTION: Member Sheridan moved to close the Public Hearing at 9:45 a.m. Board Member Anael seconded the motion, which passed unanimously. Curtains shall be monitored at low tide to ensure that no resource impacts occur as a result of use. 5. Manatee Conditions: The Permittee shall comply with the "Standard Manatee Conditions for In-Water Work - July 2005", attached to this permit. 6. Sea Turtle and Smalltooth Sawfish Conditions: The Permittee shall comply with .National Marine Fisheries Service's "Sea Turtle and Smalltooth Sawfish Construction Conditions" dated March 23, 2006, attached to this permit. 7. Consent to Easement: A portion of the proposed work is located within the Federal right-of-way for the Intracoastal Waterway and requires a Department of the Army Consent to Easement. Ocean Blvd, Highland Beach, Palm Beach County, Florida The survey was conducted via snorkel and SCUBA by swimming transacts parallel to the existing wood dock at diflPerent depths. Bentluc organisms were to be observed and noted with special emphasis tieing placed on ate. A wood dock exists at the property which consists of a terminal end approximately 20' long.by 7' wide and the marginal end approximately 30' long by 7' wide. Transacts began on the east side of tt~ marginal dock adjacent to the sloping rip rap wall on the property's edge. The substrate in this area consisted of loox sand with tmattached algae. Water depth was approximately 3.5 feet. No seagrass was observed in this area. Transacts continued on the west side of the marginal dock including the north and south ends of the property where there is no dock. Water depth at the west edge of the dock was 4.5' and increased to 6' at the mooring piles. Scattered but consistent mixed patches . of Halophila decipiens and K johnsorrii were observed on the west side of the marginal dock extending west to the mooring piles for approximately 20'. Overall cover of the seagrass patches ranged from 30'/o to 50% and extended to the north and sourth ends of the property with the same coverage. Thick patches of algae, Drasy~cla-dus vermicularis, were interspersed with the seagrass in this area giving a cover of 50%. Seagrass, H. decipiens, continued west of the mooring piles for approximately 6' on the south end of the piles and increasing to approximately 20' from the piles on the north end.
