MINUTES OF TOWN COMMISSION MEETING
WORKSHOP MEETING
Tuesday, February 23, 2010 1:30 PM
Mayor Jim Newill, CPA called the Workshop Meeting to order in Commission Chambers at 1:30
PM.
CALL TO ORDER:
Roil Call: Members present: Mayor Jim Newill, CPA; Vice Mayor Miriam S. Zwick;
Commissioner Doris M, Trinley; Commissioner John J. Sorrelli; and Commissioner John J.
Pagliaro. Also present: Town Attorney Tom Sliney; Town Manager Dale S. Sugerman; Town
Clerk Beverly M. Brown; and members of the public.
Pledge of Allegiance: The Pledge of Allegiance was given, followed by a minute of silence in
honor of members of the military, both living and deceased.
Civility Pledge: The Civility Pledge was recited by the'Town Clerk.
1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
Mayor Newill asked for any additions or deletions. Receiving none, the agenda was accepted
as presented.
2. PUBLIC COMMENTS AND REQUESTS
Greg Boan - 1101 Russell Drive
At last month's meeting, the Commission approved a modification in the street sign ordinance
allowing "open house" sign on AlA for Bel Lido Isle only. I am asking the Commission to
consider amending the modification to include all the other cross streets. Mayor Newill -The
modification was very explicit -one black and white sign on a trial basis. Within the first
month someone put up a red and white sign and it was removed. Mr. Boan -This had to be
abused by someone from out of the area. Previously the open house signs had been abused, but
they are no different than the multi-colored political signs. There are 365 homes for sale in
Highland Beach with 27 in pre-foreclosure. Requesting that the Commission include the other
cross streets in the temporary modification. Mayor Newill - We cannot make a motion at this
meeting, but maybe one of the Commissioners will make a motion to temporary allow these
signs during the March 2nd regular meeting.

Joe Yucht -Boca Highlands
I noticed on the agenda, one of the items is an increase for the Manager. If you are going to
increase his salary; why not also increase all of the boards? Want to thank the Commission
for the traffic problems they have created at Boca Highlands. One of the paddles is down, and
all that is left is a piece of metal in the road. Want a report on Milani Park, and requesting a
copy of the complaint filed against the Town by Palm Beach County. Would like to negotiate
a settlement.
Mayor Newill -Town Attorney can you enlighten the public on Milani Park?
Town Attorney Sliney - In regards to the county park, Palm Beach County filed two
complaints. One in which the court ruled in favor of the Town and the second was a
companion lawsuit with the same allegations. The actual complaints themselves are public
records and anyone is entitled to a copy.
3. PRESENTATIONS
Introduction of Richard Wentz, new patrol officer
Chief Hartmann introduced Richard Wentz who was sworn in as a patrol officer last
week, and is currently in our training program. He has a Bachelor Degree from Barry
University and recently retired from the Delray Beach Police Department after 20 years
of service. In Delray he was their Field Training Officer and specialized in DUI and
traffic accident reconstruction.
Mayor Newill on behalf of the Town Commission welcomed Officer Wentz.

5. PROPOSED ORDINANCES AND RESOLUTIONS
A) ORDINANCE NO. 10-001 O
(Public Hearing and Second Reading -March 2nd Meeting)
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA
REPEALING ORDINANCE NUMBER 08-001-0 ENTITLED AN ORDINANCE
OF THE TOWN OF HIGHLAND BEACH, FLORIDA ADDING TO THE TOWN
CODE, CHAPTER 29 ENTITLED "WATER SYSTEM," SECTION 29-25 THRU
SECTION 29-31 ENTITLED "CROSS CONNECTION CONTROL PROGRAM,"
AND PROVIDING FOR AN EFFECTIVE DATE.
Town Clerk Brown read the title of the ordinance into the record.
Mayor Newill -Receiving no additional comments from the Commission, the ordinance
will be scheduled for the second reading and public hearing at the March 2, 2010,
regular meeting.
B) RESOLUTION NO. 10-002 R
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF
HIGHLAND BEACH IlvIPLEMENTING SECTION 14 OF SENATE BILL 360, AS
ADOPTED BY THE 2009 FLORIDA LEGISLATURE AND SIGNED INTO LAW,
PERTAINING TO EXTENDING CERTAIN "DEVELOPMENT ORDERS";
PROVIDING FOR THE EXTENSION OF THE VARIANCE AND
DEVELOPMENT ORDER OF THE HIGHLAND BEACH RENAISSANCE
PREVIOUSLY RECEIVED FROM THE TOWN OF HIGHLAND BEACH UNTIL
NOVEMBER 20, 2011
Town Clerk Brown read the title of the resolution into the record.
Town Mana eg r Su eg_rman -Stated that the Town Attorney has reviewed the "Hold
Harmless Agreement" submitted by the developer. This agreement is a condition of
the Resolution.
Resolution to be included on the March 2, 2010, Consent Agenda.
C) RESOLUTION NO. 10-003 R
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND
BEACH, AUTHORIZING A SALARY ADJUSTMENT FOR THE TOWN
MANAGER.
Town Clerk Brown read the title of the resolution into the record.
Mayor Newill -Once the evaluation is completed, the Commission, at the regular
meeting on March 2nd, will determine if there will be a salary adjustment for the Town
Manager.

D) RESOLUTION NO. 10-004 R
A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
DECLARING THE ELECTION FOR ONE (1) COMMISSION SEAT TO HAVE
BEEN HELD ON THE 9~ DAY OF MARCH, 2010 TO BE UNNECESSARY
SINCE THE ONLY CANDIDATE WHO QUALIFIED WAS UNOPPOSED.
Town Clerk Brown read the title of the resolution into the record.
Mayor Newill and the Commission congratulated Commissioner Trinley on her
re-election.
Resolution to be included on the March 2, 2010, Consent Agenda.
6. NEW BUSINESS
A) Annual Performance Evaluation of the Town Manager
Town Manager Su eg rman - On February 5`i', my office sent to each member of the Town
Commission the standard Managerial Employee performance evaluation form, along with a list
of activities and accomplishments from the past year. The purpose of this agenda item is to
allow discussion of the Town Manager's performance over the past year. If there is to be any
adjustment in compensation, that a~enda item will be covered within Resolution No. 10-003 R
which will appear on the March 2n Regular Commission meeting agenda. Any input from the
Commission is welcomed. By contract, this evaluation is done in a public setting and I
encourage any public feedback.
Mayor Newill -Does any Commissioner wish to make a comment? During the regular
meeting in March, someone will have to make a motion to Resolution No. 10-003 R if there is
to be a change in compensation.
Vice Mayor Zwick -Five different opinions, but how close they are.
Mayor Newill -Appreciate the form, it brings out all the qualities that need to be addressed.

8. REPORTS -TOWN CONIlVIISSION
Commissioner John Pa lg iaro -None
Commissioner John Sorrelli -Can we have an update on the water line construction? Town
Mana eg r Su eg rman -The contractor is presently working on the 2700 block and is in the
process of moving his equipment to begin the 2800 block. They ran into a lot of unmarked
utilities at the beginning of the project that put them behind, and I believe they are still a little
behind. After the construction meeting tomorrow morning, I will have an update for the
Friday's weekly report. Comm. Sorrelli -Have there been many change orders? Manager
Su erman -There have been 7 change directives that have resulted in a savings of $68,000.00.
Comm. Sorrelli - We have to do something about parking on the Town Hall grounds, residents
are driving all over the place looking for parking. Would it be possible to purchase the lot
across the street? Mana er Superman - About three years ago I did a report on parking, but
none of the alternatives were acceptable to the Commission. I can resurrect the report and
bring it back to the Commission.
Commissioner Trinlev -Any progress being made on the part time police officers. Town
Mana er Su eg_rman - We are going to ask for amid-year budget adjustment along with a
revision of the organizational chart. Comm. Trinlev -Has the position been advertised?
Mana er Su eg rman - No, not as of yet, because it has not been approved by the Commission.

10. REPORTS -TOWN MANAGER
A) Responding to a Request for the Approval of Additional In-Street Pedestrian Crosswalk
Signage at the Holiday Inn
Town Mana eg r Su eg rman -The Holiday Inn has now requested that the Town Commission
authorize the placement of in-street pedestrian Signage at their crosswalk. This item is being
introduced for purposes of discussion only. If it is the desire of the Town Commission to
authorize the additional signage, the approval of this request could be moved over to the
Consent Agenda.
Consensus was to move it to Item #7 -Miscellaneous -Items Left Over.

B) Approving Use of the Town's BBQ Grille on April 11~' by the St. Lucy's Men's Club
Town Manager Superman -The St. Lucy's Men's Club has asked permission to use the
Town's portable gas grille for an event that they are holding on April 11~`. It would be
appropriate for such a request to be approved by the Town Commission.
Mater Newill - I was approached by the St. Lucy's Men's Club about using the gas grille for a
function at the Church. St. Lucy's parish has always been there to assist the Town, whether it
be parking or use of their facility for the election. This is a special circumstance, and I would
like for the Commission to authorize the use as a way of saying thank you for their past
generosities.
Vice Mater Zwick -They have shown us many kindnesses over the years.
Commissioner Trinley - I agree with letting the Men's Club use the grille, but can't our staff
deliver it and pick it up?

C) Special Attorney-Client Closed Door Meeting
Town Mana eg r Superman -Last Friday, Town Attorney Sliney, Special Town Counsel Baird
and I met to discuss Milani Park. We are ready to meet with the Town Commission to discuss
a settlement. This will be a closed door meeting, and the Town Attorney will bring it up at
next week's regular meeting. I would like to discuss a date in order to advise the Special
Counsel.
Agreed upon date was March 17, 2010 at 10:30 AM.
