In addition to a revised proposed project description, new local approval, and the permit fee, CCCL permit staff will require the submittal of a revised exterior lighting plan for Department staff review. The lighting plan should include all exterior lighting in the "electrical site plan" previously stamped approved by CCCL permit staff on September 7, 2012; since the approved lighting plan does not address any exterior lighting above the ground floor, the revised exterior lighting plan should include all other exterior lighting installed seaward of the CCCL on the subject property. This would include all exterior lighting above the ground floor on the seaward side of the newly constructed dwelling, all exterior lighting on the north, south, and landward sides of the newly constructed dwelling, and the lighting fixtures inside the swimming pool and spa structure. In addition, in regard to the ground floor recessed can lights, the proposed and approved lighting plan included the installation of aluminum 4-inch long shade screens on all exterior installations on the seaward side of the dwelling. If not already conducted, the shade screens must be installed as soon as possible as specified in the approved lighting plan. While the 2°a floor porch recessed can lights will need to be requested in the after -the -fact modification request and depicted in the revised exterior lighting plan to be submitted, those fixtures will also require the installation of the 4-inch long shade screens. The Astro-Turf type "sod" placed seaward of the paver deck does not appear to have been authorized by either CCCL permit PB-1041 or PB-1041 M1. Based upon a review of historical aerial photography of the subject property, it appears that the current "sodded" area contained beach/dune vegetation in 2009, and photography from 2011-2014 suggests that there was a smaller cleared area, possibly not as large as currently existing (see photos on pages 9 and 10 of this report). The after -the -fact modification must also request authorization for the sodded area, and a revised landscaping plan will need to be submitted reflecting the area between seaward of the paver deck and landward of the existing dune vegetation. The submittal should also address or document whether any additional native dune vegetation was removed during the construction process or in order to install the sod area. By e-mail dated May 23, 2016, Division of Water Resource Management ("DWRM") staff provided SE District field staff and the permittee's agent (contractor) with specific comments regarding the installed exterior lighting and the sodded area seaward of the paver deck and what would be needed to resolve this issue. As of this date, there has been no further communication with the contractor. It is requested that the after -the -fact permit modification request (M2), the revised exterior lighting plan, and revised landscaping plan be submitted to the Department within 30 days. The modification request and requested additional information should be e-mailed to the CCCL permitting program's shared mailbox at CCCL(d,dep.state.fl.us with a copy being sent to the undersigned. All current corrective measures related to the existing ground floor lighting fixtures (installation of the 4-inch long aluminum shade screens) should be conducted as soon as possible. CONCLUSIONS OF LAW: After considering the merits of the proposal and any written objections from affected persons, the Department finds that upon compliance with the permit conditions, the activities indicated in the project description of this permit are of such a nature that they will result in no significant adverse impacts to the beach/dune areas or to adjacent properties; that the work is not expected to adversely impact nesting sea turtles, their hatchlings, or their habitat; that the work is expendable in nature and/or is appropriately designed in accordance with the applicable provisions of Section 62B-33.005, Florida Administrative Code; and that it is an activity or type of construction which the designee of the Chief of the Bureau of Beaches and Coastal Systems has authority to approve or deny pursuant to Delegation of Authority, DEP Directive 137, effective May 14, 2001. The direct and cumulative impacts to the beach and dune system that will be caused by the seaward location and shore -parallel width of the proposed construction represent the maximum such impacts that are acceptable to the Department. Therefore, future construction on the site seaward of the coastal construction control line shall not extend further seaward of, or increase the shore -parallel coverage occupied by, the proposed structures approved pursuant to this permit. GHLAND BEACH (-+FPARTMENT File No. PB-1041 V / OGC Case No.: 12-0926 FINAL ORDER GRANTING PETITION FOR WAIVER OR VARIANCE On March 16, 2012, AMGAD and NERMEEN GIRGIS (Petitioners), filed a petition with the Florida Department of Environmental Protection (Department) for a waiver or variance under Section 120.542, Florida Statutes (F.S.), from certain requirements in chapter 6213-33, Florida Administrative Code (F.A.C.). The petition requested a waiver or variance from subsection 62B-33.005(8), F.A.C., which requires that major structures be located a sufficient distance landward of the beach and frontal dune to permit natural shoreline fluctuation. AMGAD and NERMEEN GIRGIS petitioned for the waiver or variance of those rules in order to obtain approval for the construction of a single-family dwelling, swimming pool and accompanying structures pursuant to chapter 6213-33, F.A.C. The single-family dwelling as proposed would be located on top of the frontal dune. The property address is 4121 South Ocean toulevard, Highland Beach, Florida. Page 1 of 9 The Department ' did not receive any BACKGROUND AND APPLICABLE REGULATORY CRITERIA 1. Pursuant to section 161.053(4), F.S., those undertaking construction located seaward of an established coastal construction control line (CCCL) must obtain a permit from the Department. 2. Permits for construction seaward of the CCCL may be granted by the Department upon consideration of adequate engineering data, design features of the proposed structure, and potential effects of the location of the. structures or activities, including potential cumulative -effects of proposed structures or activities upon the beach -dune system. 3. On February 3, 2012, the Petitioners submitted a permit application to the Department under section 161.053, F.S. and chapter 62B-33, F.A.C., to authorize the construction of a single-family dwelling, swimming pool and accompanying structures. The application was assigned DEP File No. PB-1041. 4. Upon review of the proposed site plans, Department staff determined that the structures to be built are located on the frontal dune. The frontal dune makes up the entire property on which the proposed structures are to be located. SECTION 120.542, F.S., VARIANCE AND WAIVER PROVISION 5. Section 120.542, F.S., provides in pertinent part: (1) Strict application of uniformly applicable rule requirements can lead to unreasonable, unfair, and unintended results in particular instances... Agencies are authorized to grant variances and waivers to requirements of their rules consistent with this section and with rules adopted under the authority of this section. (2) Variances and waivers shall be granted when the person subject to the rule demonstrates that the purpose of the underlying statute will be or has been achieved by other means by the person and when application of a rule would create a substantial hardship or would violate principles of fairness. For purposes ' Page 2 of 9 of this section, "substantial hardship" means a demonstrated economic, technological, legal, or other type of hardship to the person requesting the variance or waiver. For purposes of this section, "principles of fairness" are violated when the literal application of a rule affects a particular person in a manner significantly different from the way it affects other similarly situated persons who are subject to the rule. Section 120.52(21), F.S. defines variance to mean: (21) "Variance" means a decision by an agency to grant a modification to all or part of the literal requirements of an agency rule to a person who is subject to the rule. Any variance shall conform to the standards for variances outlined in this chapter and in the uniform rules adopted pursuant to s. 120.54(5). Section 120.52(22), F.S. defines waiver to mean: (22) "Waiver" means a decision by an agency not to apply all or part of a rule to a person who is subject to the rule. SUBSTANTIAL HARDSHIP TO THE PETITIONER AND VIOLATIONS OF PRINCIPLES OF FAIRNESS 6. Petitioners request a variance or waiver of the strict application of paragraph 62B- 33.005(8), F.A.C., because applying the rules to the permit application would be unreasonable, unfair, and would create an unintended result, a substantial hardship, and would violate the principles of fairness. 7. The Petitioners argued that there is no scientific definition of frontal dune. Therefore, it is impossible to locate the landward limit of a frontal dune and adhere to the rule that requires location of major structures landward of the frontal dune. The Petitioners did recognize that the Florida Legislature has defined frontal dune in section 161.053, F.S. 8. As stated by the Petitioners, the southern two thirds of Highland Beach has only one dune or ridge that extends vertically above the beach and then continuously decreases in elevation to the intersection with South Ocean Boulevard (AIA). The Petitioners alleges that the Department permitted several major structures on the frontal dune within the same area including Page 3 of 9 on the -properties immediately adjacent to the proposed structures. Thus, a precedent of permitting similar structures on the frontal dune has been established in this area. 9. The Petitioners further state that strict application of the rule would prohibit the construction of a major structure on the property. This, the Petitioners state, would be an unfair result considering the permitting of similar structures on the dune in the area. 10. Lastly, the Petitioners alleges that he cannot move the proposed major structure any further landward because the municipality of Highland Beach requires a twenty-five foot setback from the road. The major structure as proposed is sited up to the setback and cannot be moved any further landward. Further, the Petitioners argue that the pool designed seaward of the house has been substantially minimized and any further reduction or movement of the pool would compromise the pool's functionality and its ability to be maintained as an independent structure apart from the house. THE VARIANCE OR WAIVER WILL MEET THE UNDERLYING PURPOSE OF THE STATUTE 11. The Legislature established the CCCL program to protect Florida's beaches and dunes while assuring reasonable use of private property lying seaward of the CCCL. One purpose of the program is to protect the coastal system from improperly sited and designed structures which can destabilize the beach and dune system, accelerate erosion, endanger adjacent properties, or interfere with public beach access. Construction activities that take place seaward of the CCCL require Department approval. In the instant case, the proposed single- family home, swimming pool and other structures are located seaward of the CCCL. 12. The Department rules as set forth in chapter 6213-33, F.A.C., were adopted to further define the proper balance between the need to protect the beach -dune system while still recognizing the need to permit construction on private property. Page 4 of 9 1.3. The Petitioners allege that Highland Beach has experienced great stability over a significant period of time. As noted by the Petitioners, the dune face is covered by mature salt tolerant vegetation. The Petitioners claim that this stability is due to the exposed Anastasia rock formation located seaward of the property in the intertidal zone. This rock formation has assured little shoreline fluctuation in the area by limiting wave action on the sandy beach berm. 14. The Petitioners further alleged that the mean high water line in this area has remained stable. The Petitioners substantiated this claimed by providing survey data showing the stability of the shoreline. 15. The Department assessment of the shoreline change rate revealed minor erosion of the shoreline. The Department assessment further revealed that the proposed project otherwise will be sited and designed to meet the criteria of Chapter 62B-33, FAC. Conclusion 16. Section 120.542, F.S., requires the agency to consider the Petitioners' "substantial hardship", both economic and otherwise, when considering whether a variance or waiver to the rule(s) should be granted. The section also directs the Department to consider and balance whether the "principles of fairness" are violated when the literal application of the rule(s) affect a particular person in a manner significantly different than other similarly situated persons who are subject to the rule(s). 17. Petitioners have demonstrated an actual substantial legal and technical hardship that will be suffered if the Department strictly adhered to the rule. Further, these Petitioners are uniquely — which may be considered as unfairly — affected by literal application of the rules the Petitioners seek relief from. Page 5 of 9 18. The Petitioners also adequately demonstrated that granting the variance will meet the underlying purpose of the statute by showing that the dune system in this location has been and will likely remain to be stable due to the presence of the Anastasia rock formation found in the intertidal zone. THEREFORE, IT IS ORDERED: 19. Based on the foregoing reasons, the Petitioners have demonstrated that they have met the requirements for a waiver or variance of subsection 62B-33.005(8), F.A.C., regarding construction on the frontal dune. After receipt of the permit, the Petitioners will be authorized to construct the proposed single-family dwelling, swimming pool and accompanying structures on the frontal dune. This variance will remain in effect permanently after date of execution. Notice of Rights The Department's proposed agency action will become final unless a timely petition for an administrative hearing is filed under sections 120.569 and 120.57 of the Florida Statutes before the deadline for filing a petition. The procedures for petitioning for a hearing are set forth below._ A person whose substantial interests are affected by the Department's Order may petition for an administrative proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes. The petition must contain the information set forth below and must be filed (received) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000. Petitions filed by the Petitioner or any of the parties listed below must be filed within twenty-one days of receipt of this written notice. Under rule 62-110.106(4), Florida Administrative Code, a person whose substantial interests are affected by the Department's action may request an extension of time to file a Page 6 of 9 petition -for an administrative hearing. Requests for extension of time must be filed (received by the clerk) with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee,' Florida 32399-3000, before the end of the time period for filing a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon. Petitions filed by any persons other than those entitled to written notice under section 120.60(3), Florida Statutes must be filed within twenty-one days of publication of the notice or within twenty-one days of receipt of the written notice, whichever occurs first. Under section 120.60(3), Florida Statutes, however, any person who asked the Department for notice of agency action may file a petition within twenty-one days of receipt of such notice, regardless of the date of publication. The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that person's right to request an administrative determination (hearing) under sections 120.569 and 120.57 of the Florida Statutes, or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will only be at the discretion of the presiding officer upon the filing of a motion in compliance with rule 28-106.205 of the Florida Administrative Code. A petition that disputes the material facts on which the Department's action is based must contain the following information: (a) The name and address of each agency affected and each agency's file or identification number, if known; Page 7 of 9 (b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner's representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner's substantial interests are or will be affected by the agency determination; (c) A statement of when and how the petitioner received notice of the agency decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts that the petitioner contends warrant reversal or modification of the Department action; (f) A statement of the specific rules or statutes that the petitioner contends require reversal or modification of the agency's proposed action; and (g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency's proposed action. A petition that does not dispute the material facts on which the Department's action is based shall state that no such facts are in dispute and otherwise contain the same information as set forth above, as required by rule 28-106.301. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Department final action may be different from the position taken by it in this notice. Persons whose substantial interests will be affected by any such final decision of the. Department have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above. Mediation is not available for this proceeding. Once this permitting decision becomes final, any party to the final agency action has the right to seek judicial review of it under section 120.68 of the Florida Statutes, by filing a notice Page 8 of 9 J , of appeal under rule 9.110 of the Florida Rules of Appellate Procedure with the clerk of the Department in the Office of General Counsel, Mail Station 35, 3900 Commonwealth Boulevard, Tallahassee, Florida 32399-3000, and by filing a copy of the notice of appeal accompanied by the applicable filing fees with the appropriate district court of appeal.
