MINUTES OF TOWN COMMISSION MEETING
SPECIAL MEETING PRECEDING ATTORNEY-CLIENT PRIVATE SESSION
Tuesday, January 2, 2007 12:00 Noon
Mayor Harold Hagelmann called the Special Meeting, preceding the Attorney-Client
Private Session, to order in Commission Chambers at 12:00 Noon.
Town Clerk Doris Trinley Called the roll. The Mayor, Vice Mayor Joseph J. Asselta, and
Commissioners Rachael Scala-Pistone, Miriam S. Zwick and Jim Newill, CPA, were
present.
Town Attorney Thomas E. Sliney, Attorney Larry Corman, Insurance Attorney George
P. Roberts, ad Town Manager Dale S. Sugerman were also present.
Attorney Sliney advised that per F.S. 286.011(8), the Attorney Client Private Session to
follow was for strategy and negotiation purposes only; no action would be taken. Mr.
Sliney further advised that the required legal ad for the Session, Robert Devito v. Town
of Highland Beach, was published on December 26, 2006 (copy attached to and made
• part of these Minutes). Attorney Sliney estimated that the Session would last
approximately one and one-half hours, and named those who would be in attendance:

Mayor Hagel,riann then recessed the Special Meeting at 12:10 P.M., and the Town Clerk
was excused.
At the. conclusicr of the Attorney-Client Private Session at 1:15 P.M., the Town Clerk
returred to Vhambers. Mayor Hagelmann reconvened the Special Meeting and
immediately ,~ adjourned same, upon .MOTION by COMMISSIONER

THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA WILL MEET IN
AN ATTORNEY-CLIENT PRIVATE SESSION IN ACCORDANCE WITH SECTION 286.011(8),
FLORIDA STATUTES, ON TUESDAY, JANUARY 2, 2007 AT 12:00 P.M., IN TOWN COMMISSION
CHAMBERS, 3614 S.OCEAN BOULEVARD, HIGHLAND BEACH, FLORIDA 33487.
THE PURPOSE OF THE PRIVATE SESSION IS FOR THE TOWN COMMISSION AND COUNSEL
TO DISCUSS SETTLEMENT NEGOTIATIONS OR STRATEGY RELATED TO THE LITIGATION
EXPENSES IN THE CASE OF ROBERT DEVITO V. TOWN OF HIGHLAND BEACH, CASE NO.
502006CA009946XXXXM6, AND NOTICE OF CLAIMS DATED SEPTEMBER 21, 2006. THE
ENTIRE SESSION WILL BE RECORDED BY A CERTIFIED COURT REPORTER.
THE FOLLOWING PERSONS WILL ATTEND THE ATTORNEY-CLIENT PRIVATE SESSION:
