CODE ENFORCEMENT BOARD
REGULAR MEETING - MINUTES
Wednesda , Januar 18, 1989 10:00 A.M.
The Regular Meeting of the Code Enforcement Board was called to order
by Chairman William E. Paul at 10:00 A.M. on Wednesday, January 18,
1989, in the Town Commission Chambers at Town Hall.
The Deputy Town Clerk called the roll. Present were: Chairman Paul,
Vice Chairman Joseph Boulay, Lowell Blum, Theodore Boepple, Edward
Pearlstein and Pamela Perona. Mr. Joseph Sieff was absent.
Also present were: Town Attorney David K. Friedman, Building Official/
Code Enforcement Officer Ed Hardy, Deputy Town Clerk Redawna Bavender
and members of the general public.,
The minutes of the July 20, 1988 Workshop and Regular Meeting were read
and approved as submitted without objection.
OLD BUSINESS:
Mr. Boulay questioned if work was still in progress at Hidden Harbor.
Mr. Friedman stated the attorney representing Hidden Harbor had
• submitted a report to the Town, but had no further information on the
subject.
NEW BUSINESS:
CITATION NO. 2286 - Mr. Frank Scofield - Remove illegal portable
carport - Southern Standard Code, Section 103, 1988 Edition.
Chairman Paul stepped down as Chairman for this portion of the meeting
due to a personal involvement with both Town Attorney Friedman and the
Attorney representing Mr. Scofield.
Mr. Steven Utrecht, Attorney for Mr. Scofield, was present and advised
the members of the Board that Mr. Scofield hired an awning company
which failed to obtain a permit. Mr. Scofield has since that time
applied for a variance through the Board of Adjustment. Mr. Utrecht
asked the Code Enforcement Board to table this Citation, pending the
outcome of the Board of Adjustment's decision regarding the variance.
Mr. Boulay stated he felt the Code Enforcement Board could not levy a
fine or penalty against Mr. Scofield until after he has exhausted his
appeal to the Board of Adjustment.
After discussion, the following MOTION was made by Ms. Perona/Mr.
Pearlstein:
"The Code Enforcement Board is imposing a fine that is contingent
upon the pending Petition for Variance, of $25.00 per day to be
given 10 working days after such denial of the Board of
Adjustment."

The MOTION carried unanimously as all members voted AYE.
ELECTION OF OFFICERS:
Mr. Pearlstein/Mr. Boulay made a MOTION to reelect Chairman William
Paul for another term. As there were no other nominations, all
members voted AYE to such MOTION.
Mr. Boulay then announced he plans on running for Mayor in the upcoming
Town elections, and questioned if he will be required to resign from
the Code Enforcement Board prior to filing an application. Town
Attorney Friedman stated he should check with the Supervisor of
Elections office or check the State Statute.
Mr. Boepple/Mr. Pearlstein made a MOTION to reelect Joseph Boulay as
Vice-Chairman of the Code Enforcement Board. As there were no other
nominations, all members voted AYE to Mr. Boulay continuing as Vice-
Chairman.
The next meeting of the Code Enforcement Board was scheduled for
February 15, 1989, with the Workshop Meeting to begin at 9:30 A.M. and
the Regular Meeting to begin at 10:00 A.M.
A MOTION to adjourn the meeting was made by Mr. Boepple/Mr. Pearlstein
at 10:20 A.M.
