The Workshop Meeting of the Code Enforcement Board was called to order by Chairman William E. Paul at 9:30 A.M. on Wednesday, April 19, 1989, in the Town Commission Chambers at Town Hall. The Deputy Town Clerk, Redawna Bavender, called the roll. Present were Chairman William Paul, Vice Chairman Pam Perona, Theodore Boepple, Edward Pearlstein, Lowell Blum and Joseph Sieff. Also present for this meeting was Building Official/Code Enforcement Officer Harry Heithaus and Town Attorney David Friedman. OLD BUSINESS: CITATION NO. 2289 - Mr. James Barry - No record of a permit on file for the gazebo - Town Code, Section 8.1. Mr. Heithaus informed the members that Mr. Barry has applied for a permit with the Department of Natural Resources (DNR) as the survey showed the gazebo to be entirely east of the Coastal Construction • Control Line (CCCL). He noted he has received numerous letters from Mr. Allen Davis and Mr. Barry and that Mr. Barry is still working within the 60 day time limit imposed upon him by this board. Mr. Harry Heithaus stated this residence is located at 4011 South Ocean Blvd. Mr. Ressler has constructed a wood deck without obtaining a building permit from the Town. Mr. Heithaus noted this violation was turned in by Mr. Red Taylor of the DNR. Mr. Heithaus noted that DNR has not issued a citation to Mr. Ressler, however, it is his understanding that the deck is situated on the CCCL. Mr. Heithaus stated that Mr. Ressler will need to get a survey and file for a permit with the DNR before the Town can issue a permit for the deck. The Regular Meeting of the Code Enforcement Board was called to order by Chairman William E. Paul at 10:00 A.M. on Wednesday, March 15, 1989, in the Town Commission Chambers at Town Hall. The Deputy Town Clerk, Redawna Bavender, called the roll. Present were Chairman William Paul, Theodore Boepple, Edward Pearlstein, Lowell Blum and Pamela Perona. Mr. Joseph Sieff was absent. Also present for this meeting were Town Manager Mary Ann Mariano, Town Attorney Tom Sliney, Building Official/Code Enforcement Officer Harry Heithaus and members of the general public. The minutes of the January 18, 1989 Workshop and Regular Meetings were read and approved as submitted without objection. OLD BUSINESS None NEW BUSINESS • CITATION NO. 2288 - Mr. James Barry - No record of a permit on file for the gazebo - Town Code Chapter 30, Section 8.1. Mr. Harry Heithaus, Code Enforcement Officer/Building Official, stated a complaint was received from Mr. Red Taylor regarding a gazebo installed on the dune line at 4015 South Ocean Blvd. Mr. Heithaus stated that after checking the Building Department's file and found a permit had not been issued for the gazebo, a Notice of Violation was issued. Mr. James Barry, property owner, was present. Mr. Barry stated he has been remodeling his home and did receive a seawall approval and a temporary deck approval from the Department of Natural Resources (DNR). Mr. Barry further stated the gazebo is a pre-fabricated gazebo and believes the gazebo is placed on his property, not the dune line. His architect, Allen Davis, was also present for this meeting and noted plans will be submitted showing the exact location of the gazebo. Attorney Sliney noted the correspondence from DNR to Mr. Barry calls this "an apparent violation" of the gazebo being on the Coastal Construction Control Line (CCCL). After the is east of the CCCL, bo back or file a permit After further discussion regarding the time frame to come into compliance with the Town Code, and after guidance from the Town Manager and Town Attorney, a MOTION was made by Mr. Blum/Mr. Pearlstein to give Mr. James Barry a period of 60 days to come into compliance with Town Code. All members voted AYE. Chairman Paul read Mr. Boulay's letter of resignation from the Code Enforcement Board as Mr. Boulay has been elected Mayor of Highland Beach. Mr. Paul wished him well and thanked him for the years of service on the Code Enforcement Board. Chairman Paul stated he would take nominations for a new Vice-Chairman at this time. Mr. Pearlstein nominated Mr. Ted Boepple, however, Mr. Boepple declined the nomination. Mr. Boepple, in turn, nominated Pam Perona for Vice-Chairman. Mr. Pearlstein seconded the nomination. The nomination carried unanimously. The next meeting was scheduled for April 19, 1989. The Workshop will be held at 9:30 A.M. and the Regular Meeting will be held at 10:00 A.M. There being no further business to come before the Code Enforcement Board at this time, the meeting was adjourned at 10:30 A.M.
