CODE ENFORCEMENT BOARD
REGULAR MEETING - MINUTES
Wednesday, A ril 19, 1989 10:00 A.M.
The Regular Meeting of the Code Enforcement Board was called to order
by Chairman William E. Paul at 10:01 A.M. on Wednesday, April 19, 1989,
in the Town Commission Chambers at Town Hall.
The Deputy Town Clerk, Redawna Bavender, called the roll. Present were
Chairman William Paul, Vice Chairman Pamela Perona, Theodore Boepple,
Edward Pearlstein, Joseph Sieff and Lowell Blum.
Also present for this meeting were Town Attorney David Friedman,
Building Official/Code Enforcement Officer Harry Heithaus and members
of the general public.
A MOTION was made by Mr. Pearlstein/Mr. Sieff to approve the March 15,
1989 Workshop Meeting minutes as submitted. The MOTION carried
unanimously.
A MOTION was made by Mr. Pearlstein/Mr. Boepple to approve the March
15, 1989 Regular Meeting Minutes as submitted. The MOTION carried
unanimously.
Chairman Paul informed the members that on April 4, 1989, the Town

Commission appointed Mr. Horace G. Leng, Jr ., to the Code Enforcement
Board to fill the current vacancy.

NEW BUSINESS:
CITATION N0. 2290 - Mr. Robert Ressler - No record of a permit on file
for the wood deck - Town Code, Chapter 30, Section 8.1.
Under oath, Mr. Harry Heithaus, Code Enforcement Officer/Building
Official, stated this matter was brought to his attention by Mr. Red
Taylor of the Department of Natural Resources (DNR). Mr. Taylor
advised Mr. Heithaus that the DNR did not have a permit on file for the
wood deck. Mr. Heithaus further stated he inspected the property on
February 15, 1989, and after research he found the Town did not have
such permit on file and a Notice of Violation was issued.
Under oath, Mr. Robert Ressler advised the members that this situation
was created some time ago when a seawall was added by B. K. Marine
Construction, on his property and on the neighboring houses to the
north and south of his property. A copy of the bill from B. K. Marine
was presented to the Board. At the time the work was being done to
the seawall, Mr. Ressler was not occupying his property so cranes and

and south of his property.
Mr. Ressler also presented a survey of his lot, which indicated that a
portion of the wood deck is on the CCCL.
After further discussion, a Findings of Facts MOTION was made by Mr.
Boepple/Ms. Perona that the Code Enforcement Board has found that a
structure does exist and it has not been properly permitted by the Town
under Chapter 30, Section 8.1 of the Highland Beach Town Code. The
MOTION carried unanimously.
Further discussion took place regarding the amount of time Mr. Ressler
• should have to apply for a permit. A MOTION was made by Ms. Perona/
Mr. Boepple, with the direction of the Town Attorney, that Mr. Ressler
will have two (2) weeks to submit an application to the DNR on a form
approved by DNR. If the application is approved, he will have two (2)
weeks to apply for an application for a building permit from the Town
of Highland Beach. In the event that DNR does not approve the
application, Mr. Ressler will be required to take down, within eight
(8) weeks and obtain any necessary permits to do so, that portion of
the wood deck that requires DNR approval and will have two (2) weeks
from DNR's decision to obtain a building permit from the Town of
Highland Beach for that portion of the deck that is westward of the
Coastal Construction Control Line. In the event this order is not
complied with in a timely manner, the Code Enforcement Board may levy a
fine. The MOTION carried unanimously.
The next meeting was scheduled for May 17, 1989. The Workshop Meeting
will be held at 9:45 A.M. and the Regular Meeting will be held at 10:00
A.M.
There being no further business to come before the Code Enforcement
Board at this time, a MOTION was made at 10:35 A.M by Mr. Boepple/Mr.
