REGULAR MEETING - MINUTES
WEDNESDAY, JULY 19, 1989 10:05 AM
The Regular Meeting of the Code Enforcement Board was called to
order by Chairman William E. Paul in Commission Chambers, Town
Hall, at 10:05 AM on Wednesday, July 19, 1989.
Deputy Town Clerk Doris Trinley called the roll. Present were
Chairman Paul, Vice Chairman Pamela Perona, Theodore Boepple,
Edward Pearlstein, Lowell Blum and Horace Leng. Joseph Sieff was
absent.
Also present were Building Official/Code Enforcement Officer Harry
Heithaus and Town Attorney David Friedman.
OLD BUSINESS:
CITATION N0. 2288 - James Barry - No record of permit on file for
gazebo - 4015 S. Ocean Blvd.. - Town Code., Section 8.1
After some discussion, Chairman Paul suggested that based on
information forthcoming at the Workshop Meeting (this date), it
would appear a motion is in order to again extend the time
permitted to come into compliance. A MOTION was made by
Mr. Pearlstein/Mr. Boepple that the Order dated May 17, 1989,
issued to James Barry, be extended an additional 60 days in orde
to come into compliance with the Town Code. The MOTION carried
unanimously.
CITATION 2290 - Robert Ressler - No record of permit on file for
wood deck - 4811 S. Ocean Blvd. - Town Code, Section 8,1

Building Official/Code Enforcement Officer Harry Heithaus recapped
the information he had presented to the Board during the Workshop
Meeting, saying DNR informed him that .thus far they have received
no application for permit.
At this time, Dr. Ressler was sworn in and addressed the Board,
stating that he had indeed been in communication with DNR
requesting necessary permits. He further stated that their
response had been that two different surveys would have to be made
regarding discrepancy in setback. The surveys are being done now,
he said. Dr. Ressler further stated that he would be happy to
provide copies of his correspondence with DNR to the Board and the
Building Official, and expressed the opinion that there seems to
be a communication problem within DNR. At this point, Dr.
Ressler left the meeting to get the correspondence in question.

Vice Chairman Perona then observed that it would seem the Board
must give Dr. Ressler time to complete the process since
originally the Board had given him two weeks to make application
to DNR and then another two weeks after DNR approval to make
application to the Building Department. With the stipulation that
he supply copies of DNR correspondence to the Board and the
Building Official/Code Enforcement Officer, Ms. Perona stated that
the CEB order should stand.

CITATION N0. 2293 - .Edward Bianchini - No record of permit for
screened porch - 1021 Boca Cove Lane - Town Code, Section 8.1
Chairman Paul requested that Attorney Cantor summarize the
information he had given the Board at the Workshop Meeting. He
stated that his client closed on the townhouse sometimee around the
