1. CALL TO ORDER
Mayor Hillman called the meeting to order at 1.30 P.M.

The Town Commission led the Pledge of Allegiance.
4. APPROVAL OF THE AGENDA
Mayor Hillman added "Upcoming Educational Campaign Presentation" as Item 11.F.
under New Business.
Commissioner Gossett -Seidman added a "Discussion on Procedure of Meeting" as Item
11.G. under New Business.
MOTION: David/Moore - To approve the agenda as amended.
The motion passed unanimously on a 5 to 0 vote.

6. PUBLIC COMMENTS
Mayor Hillman called for public comments. Town Clerk Gaskins stated that there were no
public comments.
7. ANNOUNCEMENTS
Mayor Hillman read the announcements as follows:
Board Vacancies
Code Enforcement Board - One vacancy for a three-year term
Town Clerk Gaskins explained that the Town Clerk's Office had received one (1)
application for the Code Enforcement Board vacancy. She asked the Town Commission
how they would like the Town staff to proceed with this matter related to holding the one
(1) application until more applications are received. Mayor Hillman suggested moving
forward with the one (1) application.

8. ORDINANCES
A. Ordinance No. 2021-011
An Ordinance of the Town Commission of the Town of Highland Beach, Florida,
amending the administrative amendments to the 7th (2020) Edition of the Florida
Building Code to provide for reinspection and recertification of existing threshold
buildings; providing for the repeal of all ordinances in conflict; providing for
severability and codification; and providing for an effective date.
Mayor Hillman read the title of Ordinance No. 2021-011.
Town Clerk Gaskins mentioned that this was the second (final) reading.

Building Official Jeffrey Remas presented this item. Discussion followed about the
building reinspection and recertification process for the Town.
MOTION: David/Moore - To adopt Ordinance No. 2021-011.
Based upon roll call, Ordinance No. 2021-011 was adopted unanimously on a 5 to
0 vote.
Town Clerk Gaskins stated that this was a public hearing, and there were no public
comments for this item.
B. Ordinance No. 2021-016
An Ordinance of the Town Commission of the Town of Highland Beach, Florida,
calling for a referendum of the qualified electors of the Town of Highland Beach to
be held on March 08, 2022, as to whether Section 2.01(30) of the Town of Highland
Beach Charter shall be amended to revise the funding limits; providing for notice
and advertising of the referendum; providing for referendum canvassing; providing
for severability, the repeal of laws in conflict, codification, and an effective date.
Mayor Hillman read the title of Ordinance No. 2021-016 and introduced this item.
Discussions followed about changing the language in Section 2.01(30) to include the
words "total budget" and eliminating "cumulation of projects." Also, adding one more
Whereas clause to the ordinance that reads as follows: "The current limit was established
in 1991 and does not account for major changes in the Town's facilities and
responsibilities." There were additional conversations about modifying the ballot
summary. Consequently, the item was tabled, and discussion will continue after the New
Business section.
MOTION: David/Shoemaker - To TABLE this Ordinance No. 2021-016 until after the
New Business.
The motion passed unanimously on a 5 to 0 vote.
C. Ordinance No. 2021-017
An Ordinance of the Town Commission of the Town of Highland Beach, Florida,
calling for a referendum of the qualified electors of the Town of Highland Beach to
be held on March 08, 2022, as to whether Section 2.01(30) of the Town of Highland

vote.

11. NEW BUSINESS
A. Resolution No. 2021-037
A Resolution of the Town Commission of the Town of Highland Beach, Florida,
declaring the results of the Special Election held on November 02, 2021; providing
an effective date; and for other purposes.
Mayor Hillman read the title of Resolution No. 2021-037, and the official certified election
results.
MOTION: David/Gossett-Seidman - To approve Resolution No. 2021-037.
Resolution No. 2021-037 was approved unanimously on a 5 to 0 vote.
B. Discussion on the Town's future Elections and Canvassing Board Members.
Mayor Hillman read the title of Item 11.B.
Town Clerk Gaskins presented this item.
It was the consensus of the Town Commission to maintain the Highland Beach
Canvassing Board members as defined in the Town's Charter.
C. Approve and authorize the Mayor to execute the Municipal Election Voting
Processing Equipment Use and Elections Services Agreement with Palm Beach
County Supervisor of Elections Office for the March 08, 2022 Election.
Mayor Hillman read the title of Item 11.C.
MOTION: David/Moore - To approve Item 11.C.
Item 11.C. passed unanimously on a 5 to 0 vote.
D. Discussion on the use of the American Rescue dollars.

Mayor Hillman read the title of Item 11.D.
Discussion ensued about using the American Rescue Plan funds to finance the sanitary
sewer project without the need for a referendum.
E. Approval of Commission Meeting Minutes
October 26, 2021, Commission Special Meeting Minutes
MOTION: David/Moore - To approve October 26, 2021, Commission Special Meeting
Minutes as amended.
October 26, 2021, Special Meeting Minutes passed unanimously on a 5 to 0 vote.
F. Upcoming Educational Campaign Presentation (This item was added to the
agenda)
Assistant to the Town Manager Terisha Cuebas presented a PowerPoint presentation
highlighting pertinent dates relevant to Educational Campaign.
G. Discussion of Procedures of Meetings. Commissioner Gossett -Seidman (Added
to the agenda)
Commissioner Gossett -Seidman discussed October 26, 2021, Town Commission
meeting video/audio recording. She expressed concerns with transparency due to the
cameras being off during recess. She suggested that cameras and audio remain on
during the meeting recess.
Town Manager Labadie clarified that a disclaimer could be displayed during the Town
Commission meeting recess.
Mr. Rich Pollack of the Coastal Star Newspaper commented about the public watching
the Town Commission during the meeting recess.
12. TOWN COMMISSION COMMENTS
Commissioner John Shoemaker reinforced the attendance at Town meetings for Town
Commission to receive input from the residents. He also commented about the following:
• The disrespect that police officers encountered during the erupted gas line issue
last week.
• An incident at a condominium involved a drunken driver crashing into a guard gate.
• A banner for Town Commission for future elections.
• Submitting an article on resident John Boden and Mr. Boden's book, the Klondike
Playboy.
Commissioner Evalyn David mentioned that the Town Commission welcomes
constructive criticism.

Commissioner Peggy Gossett -Seidman spoke about the 2022 Florida League of Cities
Legislative priorities involving Short -Term Rentals, Communications Services Tax
Reform (utility taxes), Tree Protection, Transportation Funding, and Economic
Development Incentives.
Vice Mayor Natasha Moore inquired about the following:1) the updated revenue
projection for water bills (water and sewer revenues) since the implementation of the rate
increase. She asked if this information could be available for an update at the December
meeting, and 2) the final numbers of what was transferred/taken from the unassigned
fund balance, and 3) when would the updated project plan for the Fire Rescue be shared.
Afterward, she wished everyone a Happy Thanksgiving.
Town Manager Labadie will send the raw data of the revenue projection for water bills to
the Town Commission. As for the final numbers of what was transferred/taken from the
unassigned fund balance, Town Manager Labadie explained that information would be
available in two weeks. He also provided a timeline for producing the updated project plan
for the Fire Rescue project. The EMS presentation will be on the Town Commission
agenda in December.
Mayor Douglas Hillman inquired about the next Financial Advisory Board meeting. He
suggested tasking the Financial Advisory Board with analyzing the reserves and where
they think Town's reserves should be. Vice Mayor Moore discussed the next steps that
she thought were important concerning the reserves. She mentioned that she is still
waiting on information from other municipalities and is gathering additional information.
Discussion following about the potential use of the reserves or bonds for the Fire Rescue
project.
Ordinance No. 2021-016 (Continuation)
The Town Commission continued its discussion about the ballot summary of the proposed
Charter amendment and agreed it should read as follows:
"To recognize the growth of costs and support the delivery of town services, including
items like the water treatment plant, library, police, and fire rescue, shall the Town of
Highland Beach amend its Charter at Section 2.01(30) to provide that the funding limits
be increased from the current limit of $350,000, which was established in 1991, to five
percent (5%) of the Town's total annual budget?"
MOTION: David/Shoemaker — To approve Ordinance No. 2021-016 as amended.
Ordinance No. 2021-016 passed on a 4 to 1 vote with Commissioner Gossett -
Seidman dissenting.

Town Attorney Torcivia had nothing to report.
